HomeMy WebLinkAboutResolution No. 20-7944 - Declaring Intention to Levy and Collect Lighting & Landscaping Assessments (AD 121)A RESOLUTION OF THE CITY COUNCIL OF THE CITY I DOWNEY DECLARING ITS INTENTION TO LEVY AND COLLE LIGHTING AND LANDSCAPING ASSESSMENTS WITHIN TH LIGHTING AND LANDSCAPING DISTRICT, ASSESSME I DISTRICT121, FOR FISCAL YEAR 2020-2021; AND SET A PUBLI HEARING FOR JUNE 23, 2020 ON THE PROPOSED ASSESSMENTS WHEREAS, the City Council of the City of Downey (City Council) by Resolution No. 20- 7937, proposed to levy and collect assessments within the Lighting and -andscaping District, Assessment District 121 (District) pursuant to the provisions of thn- -andscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and 9ighways Code; and WHEREAS, by said Resolution No. 20-7937, the City Council ordered the Director of Public Works to prepare and file an Engineer's Report for the District for the Fiscal Year 2020- 2021 pursuant to the Landscaping and Lighting Act of 1972 per Section 22565 of the California Streets and Highways Code; and WHEREAS, the City Council has determined that it is necessary that assessments be levied on all assessable lots and parcels in the District for fiscal year 2020-2021, as set forth in the Engineer's Report. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES WEVEBY TESOLVE AS FOLLOWS: SECTION 1. That in order to maintain and service street lighting facilities and on - street and public facilities landscaping within the District for Fiscal Year 2020-2021, it is the to the provisions of the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of said Code). SECTION 2. That the maintenance and servicing of the public lighting facilities on and along public streets and places within the District will be, in the opinion of the City Council of the City of Downey, to the benefit of the assessable properties within the District. Assessable properties are those within the District that have been annexed into the District by previous resolutions caused by voluntary installation of street lights and by requirements of various planning cases or Section 8002 of the Downey Municipal Code. SECTION 3. That the maintenance and servicing of the landscaping in, on and along public streets and places within the District will be, in the opinion of the City Council of the City of Downey, to the benefit of the assessable properties within the District. Assessable properties are those within the District known as Zone 111. SECTION 4. That reference hereby is made to the Engineer's Report of the Engineer on file with the City Clerk and available for public inspection, of the proposed assessments upon assessable lots and parcels of land within the District, including changes I irom the previous fiscal year's assessment and assessable lots. SECTION 5. The Street Light Improvements and Safety Lighting and Traffic Signal Improvements provided by the District and associated with the zones described in the Engineer's Report incorporate various landscaping and lighting improvements that are maintained and serviced for the benefit of real property within the District. PAGE 2 SECTION 6. That assessments for all zones will be less than, or equal to, the maximum assessments. Any such protest shall state all grounds of the objection, and if filed by the property owner, shall contain a description sufficient to identify the property. SECTION 8. The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be published, posted, and mailed in the mannet required by Part 2 of Division 15 of the Streets and Highways Code.
