HomeMy WebLinkAboutMinutes 05-12-20 Special MeetingMINUTES OF COUNCILCITY OF OF DOWNEY MAY 12, SPECIAL MEETING The City Council of the City of Downey held a Special City Council Meeting on May 12, 2020, at 5:35 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, with Mayor Pacheco presiding. Council Members: Blanca Pacheco Claudia M. Frometa Sean Ashton Rick Rodriguez Alex Saab Mayor Mayor Pro Tern ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Alicia Duarte, CIVIC, City Clerk (teleconference) (excused) (teleconference) It was moved by Mayor Pro Tern Frometa, seconded by Council Member Saab to approve the Closed Session Minutes of March 10, 2020 and April 14 and 28, 2020, with Council Member Ashton abstaining from the Closed Session Minutes of March 10, 2020, so ordered by Mayor Pacheco. Mayor Pacheco asked City Clerk Duarte if there was anyone on the teleconference line who would like to comment on the Closed Session Items. Mayor Pacheco asked City Clerk Duarte if there were any written comments on the Closed Session Items. Having none, Mayor Pacheco closed public comment. • l • Mayor Pacheco announced the City Council is recessing to Closed Session at 5:37 p.m. to discuss matters under the authority of the following sections of the Government Code: Government Code Section 54957.6 - Conference with labor negotiators John Oskoui/James McQueen re: direction for labor negotiations with Downey Police Officers` Association. 2. Government Code Section 54956.95 — Liability Claim — Worker's Compensation Claim Claimant: Robert Linares Claim No.: Workers' Compensation Appeals Board Case # ADJ11562752 Agency claimed against: City of Downey 3. Initiation of Litigation: One (1) potential case. The Special City Council meeting reconvened in Open Session at 6:34 p.m. City Council Minutes Special Meeting — May 12, 2020 City Attorney Abich Garcia reported the closed session report as follows: In regards to Item No. 1, the City Council received a status report and provided direction to its labor negotiators; in regards to Item No. 2, the City Council received a status report from its legal counsel; in regards to Item No. 3, there was a motion made by Council Member Saab, seconded by Mayor Pro Tern Frometa and passed 4-0-1, with Council Member Rodriguez excused to authorize the City Attorney to initiate litigation against Jose Vasquez Bonilla and Alliance Insurance in subrogation in connection with worker's compensation matter, Linares vs. City of Downey.
