Vice Chair Duarte called the January 15, 2020, Regular Meeting of the Planning Commission to order at 6:33 p.m., at Downey City Hall, 11111 Brookshire Avenue, Downey, CA. After the flag salute, Secretary Cavanagh called roll. COMMISSIONERS PRESENT: Patrick Owens, District 2 Dimitrios Spathopoulos, District 4 Nolveris Frometa, District 5 Miguel Duarte, District 1, Vice Chair COMMISSIONERS ABSENT: Steven Dominguez, District 3, Chair OTHERS PRESENT: Aldo E. Schindler, Director of Community Development Yvette Abich Garcia, City Attorney Crystal Landavazo, City Planner Guillermo Arreola, Principal Planner Alfonso Hernandez, Senior Planner Irving Anaya, Associate Planner Madalyn Welch, Assistant Planner Mary Cavanagh, Secretary PLANNING COMMISSIONER ANNOUNCEMENTS; REQUEST FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: PRESENTATIONS: 1. Legislative updates: Housing Director of Community Development Aldo Schindler introduced Lauren Langer, with Best, Best & Krieger, to present the 2019 legislative updates for Housing and Land Use. Lauren Langer gave a PowerPoint presentation of the new Housing Bills that began in 2017, to support and promote Housing within the State of California. Ms. Langer reviewed the State’s new 2019 legislation that included Accessory Dwelling Units (ADU); the Housing Crisis Act; stricter state enforcement of housing laws; changes to Density Bonus law to promote 100% affordable housing developments; and objective development standards. The state’s objective for these updates is to increase housing, primarily affordable housing. The new legislation requires streamlining approval processes and modifying local residential zoning and land use designations to increase residential development within the City. The Commissioners thanked Ms. Langer for presenting a very clear and detailed report. REPORT ON CITY COUNCIL ACTION: The City Council approved a Shopping Cart Ordinance, and a Scooter Program. Sun Scooter will be providing 100 scooters throughout the City in two phases, distributing 50 scooters during each phase. Draft Planning Commission January 15, 2020 Minutes - 2 - PUBLIC HEARINGS: 2. PLN-19-00134 (Variance): Vice Chair Dominguez opened the public hearing for PLN-19-00134 and Ms. Cavanagh affirmed proof of publication. Director of Community Development Schindler advised the Commission that the applicant has withdrawn their application; hence, there will be no public hearing. NON-AGENDA PUBLIC COMMENTS: Luis Rodriguez, formerly associated with the owner of property located at 12213 Gneiss Avenue (PLN-19-00134), requested that his name be removed from the original application and related items. City Planner Yvette Garcia advised the Commission that the application is withdrawn and therefore closed. The information cannot be removed from the file. If the applicant files another request, it will not include the information from the previous record. CONSENT CALENDAR ITEMS: 3. General Plan Consistency Finding: A request to find that the sale of City-Owned property is consistent with the General Plan for property located at 9340 Stewart & Gray Road, zoned M-2 (General Manufacturing) 4. Extension of Tentative Parcel Map No. 78275: A one year extension of a tentative parcel map that will consolidate two lots into one parcel 5. Approval of the Minutes from May 15, 2019 6. Approval of the Minutes from December 4, 2019 It was moved by Commissioner Frometa and seconded by Commissioner Spathopoulos, and passed by a vote of 4-0-1, to approve the items of the Consent Calendar, with Commissioner Owens abstaining from item No. 6 of the Consent Calendar. OTHER BUSINESS: Election of Officers Commissioner Owens nominated Vice Chair Duarte as Chair. It was moved by Chair Owens, seconded by Commissioner Duarte, and passed by a 4-0-1 vote, with Chair Dominguez absent, to elect Vice Chair Duarte as Chair. Commissioner Owens nominated Commissioner Frometa as Vice Chair. It was moved by Vice Chair Dominguez, seconded by Chair Owens, and passed by a 4-0-1 vote with Chair Dominguez absent, to elect Commissioner Duarte as Vice Chair. STAFF MEMBER COMMENTS: None.
