Reject the bid protest received on April 28, 2020, from Pacific Aquascape International, Inc. FE. Award a construction contract, in the amount of $1,425,500.00 to NR Development, Inc. for the Wilderness Park Pond Restoration Project — Ponds and Electrical Improvements, CIP No. 15-21D 3. Authorize the Assistant City Manager to execute any change orders or additional scopf.- of work for this project deemed necessary or desirable up to 10% of the construction contract amount. I - Sol 0 1 0 0 101 &*ei I On January 7, 2020, the City Clerk received and publicly opened three (3) bids for the Wilderness Park Ponds Restoration and Electrical System Improvements — CIP No. 15-21D). On January 7, 2020, the City received a bid protest from the representative of the second lowest bidder, Pacific Aquascape International, Inc. On January 10, 2020, NR Development, the lowest bidder provided a response to the bid protest. ACTION REQUESTED FOR THE WILDERNESS PARK POND RESTORATION PROJECT (CIP NO. 15- 21 D — PONDS AND ELECTRICAL) MAY 12, 2020 PAGE 2 At its meeting of January 28, 2019, the City Council rejected all bids received and authorized re - solicitation of bids for CIP No. 15-21 D. On April 2, 2020, and April 9, 2020, the Notice Inviting Bids for this project was published in the Downey Patriot. Addendum No. 1 was issued on April 14, 2020, to include new guidelines for the mandatory bid walk in response to COVID-19 required safety procedures, along with answers to pre -bid requests for information. Addendum No. 2 was issued on April 15, 2020, to include State of California's Contractor License requirements in response to a pre -bid request for information. Addendum No. 3 was issued on April 20, 2020, to answer various pre -bid requests for information. On April 23, 2020, the City Clerk received and publicly opened five (5) bids which ranged from $1,370,300 to $1,948,000, as shown on the attached bid summary (Attachment A). DD Systems, Inc. dba Ace Construction & Design, Inc., the apparent lowest bidder was deemed non -responsive as they did not include Addendum Nos. 1-3 in their submittal. The apparent second lowest bidder is NR Development, Inc. of Downey, California with a bid in the amount of $1,425,500. Staff has confirmed that NR Development, Inc. possesses the specified contractor license and that the license is current and in good standing. Verbal qualification interviews with randomly selected NR Development, Inc.'s references, as well as the listed subcontractors' references, were completed and the responses were all satisfactory. On April 28, 2020, the City received a bid protest letter from the apparent third lowest bidder, Pacific Aquascape International, Inc., disputing the experience of the pond restoration subcontractor, specifically as related to the ponds lining work. The ponds restoration subcontractor for NR Development, Inc. is Hydrology Group, Inc. which has designated a third - tier subcontractor, Conterra Inc. to perform the ponds lining portion of the project. The bid submittal from NR Development included experience and references as specified in the bid documents. Verbal qualification interviews with randomly selected references for the lake restoration subcontractor, Hydrology Group, Inc. and the pond liner installer, Conterra, Inc., were completed and the responses were all satisfactory. Moreover, the bid protest by Pacific Aquascape International, Inc. has been reviewed and analyzed by the City's outside legal counsel with expertise in Public Contract Law and it has been determined that the bid protest is without merit. Below is a summary of the scope of work, implementation schedule and other relevant data: WILDERNESS PARK POND RESTORATION — Ponds and Electrical System Improvement • Restoring the wetlands habitat at two existing ponds at Wilderness park • Replacing invasive plant species with native plants • Installation of the 40 mi. pond liner • Construction of naturalized hardened shoreline • Installation of New aeration system to improve water quality • Construction of new walking trail segments • Installation of a new pedestrian bridge • Construction of a new pond outlook area • Construction of Dry creek beds • Installation of educational wayfinding signage to facilitate wetlands and native habitat 'awareness ACTION REQUESTED FOR THE WILDERNESS PARK POND RESTORATION PROJECT (CIP NO. 15- 21 D - PONDS AND ELECTRICAL) MAY 12, 2020 PAGE 3 Reconstruct concrete walkways around the park's community building Realign Electrical Vehicle Charging Station Install new electrical enclosure It is projected that construction would start on May 26, 2020, and be complete by the end of October of 2020. The estimated project cost summary is attached to this report (Attachment C). Quality of Life, Neighborhood & Infrastructure The total estimated cost of the project, including construction costs (based on the construction bid amount), contingencies, design, inspection, construction engineering and management services, material testing, and City -procured electrical equipment; is $1,792,045.00. The City's 2019-20 Capital Improvement Program includes the Wilderness Park Pond Restoration Project. This project is funded through the Measure S proceeds as well as grant funding from San Gabriel and Lower Los Angeles Rivers and Mountains Conservancy and Habitat Conservation Fund, as well as $200,000 in matching fund through General Fund (Account Nos. 26-1-7706 and 40-1-7706).
