Minutes - 03-10-20 - Special MeetingCity Council Minutes Special Meeting – March 10, 2020 1 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY SPECIAL MEETING MARCH 10, 2020 The City Council of the City of Downey held a Special City Council Meeting on March 10, 2020, at 5:37 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, with Mayor Pacheco presiding. PRESENT: Council Members: Blanca Pacheco Mayor Claudia M. Frometa Mayor Pro Tem Sean Ashton Council Member (excused) Rick Rodriguez Council Member Alex Saab Council Member ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Alicia Duarte, CMC, City Clerk APPROVED CLOSED SESSION MINUTES It was moved by Council Member Saab, seconded by Mayor Pro Tem Frometa to approve the Closed Session Minutes of February 11, 2020, so ordered by Mayor Pacheco. PUBLIC COMMENT ON CLOSED SESSION AGENDA ITEMS Mayor Pacheco asked if there was anyone present who would like to comment on Closed Session Items. Having no one come forward, Mayor Pacheco closed public comment. RECESSED TO CLOSED SESSION Mayor Pacheco announced the City Council is recessing to Closed Session at 5:38 p.m. to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.9(d)(1) – Conference with Legal Counsel – Pending Litigation – City of Downey v. Martin Colin, et al., Los Angeles Superior Court Case No. VC067201; Martin Colin and Robert Maniaci v. City of Downey, et al, Los Angeles Superior Court, Case No. VC067201 (Cross-Complaint); Peter and Andrea Hartwick v. City of Downey, et al., Los Angeles Superior Court Case No. VC067201 (Cross-Complaint). 2. Government Code Section 54956.9(d)(1) – Conference with Legal Counsel – Pending Litigation – Joseph Barreda v. City of Downey, et al., U.S. District Court, Central District of California, Case No. 2:19-cv-02508-DSF. 3. Government Code Section 54957.6 - Conference with labor negotiators John Oskoui/James McQueen re: direction for labor negotiations with Downey Police Officers’ Association. 4. Government Code Section 54956.9(d)(4) – Conference with Legal Counsel – Initiation of Litigation: One (1) potential case. City Council Minutes Special Meeting – March 10, 2020 2 RECONVENED SPECIAL CITY COUNCIL MEETING The Special City Council meeting reconvened in Open Session at 6:30 p.m. with Council Member Ashton excused. City Attorney Abich Garcia reported the closed session report as follows: In regards to Item No. 1, the City Council received a status report and provided direction to its legal counsel; in regards to Item No. 2, the City Council received a status report and provided direction to its legal counsel; in regards to Item No. 3, the City Council received a status report and provided direction to its labor negotiators; and, in regards to Item No. 4, following discussion by the City Council, there was a motion made by Council Member Saab, seconded Mayor Pro Tem Frometa and passed 4-0-1, with Council Member Ashton excused to join a consortium of cities to initiate litigation against Southern California Edison.
