MEETING MINUTES OF THE
DOWNEY CEMETERY DISTRICT BOARD OF TRUSTEES
January 7, 2020
The Downey Cemetery District Board of Trustees held a Meeting on January 7, 2020 at 5:00 p.m., in the
City Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Chair,
David R. Gafin, presiding.

John Unkovich, Trustee
Absent: Jason Chacon, District Director
Also Present: Pam Passow, Parks and Recreation Director

Welcome to Members and Guests:
Chair Gafin welcomed and thanked members and guests.
Written Communication:
1. Approve Board Minutes of December 3, 2019.
Chair Gafin abstained since he was absent at the December 3rd meeting. Chair Gafin took motion;
Vice Chair Heyman had no exceptions to the minutes. Trustee Unkovich accepted the minutes; Chair
Gafin motioned to second, all were in favor and motion passed 2-0.

Chair, David R Gafin asked the board for comments, no comments were given. Chair Gafin motioned to
accept the activity report of the second quarter of niche sales. Trustee Unkovich seconded the motion, all
were in favor and the motion passed 3-0.
Director Communication:
1. Property Damage Update
Director Passow stated the following; two out of the three breaches have been repaired. The third hole
is too costly to get done, so bids are being taken and expected to get completed fairly soon. The first
two breaches were paid by Public Works.
2. Cemetery Stretch Insurance Coverage Update
Director Passow commented that until the breach is repaired, the cemetery will not be able to
upgrade the insurance. Taking this incident in consideration, we now know that it is an issue
when it comes to not having proper insurance. In the future when an incident occurs where the
driver does not have proper insurance, the cemetery stretch insurance will be able to cover the
damages. Chair Gafin asked: assuming the three prior incidents that happened, was the cemetery
not able to recover anything from drivers insurance? Director Passow stated that she believes that
in past before she was Director, Public Works had fixed the breaches. Normally, when the driver
is responsible for the damages, the City goes after the drivers insurance and that is how it has
worked. That is how the whole process normally goes, if the drivers had current insurance, the
breach would have been fixed by them. Unfortunately, there was a lapse in the drivers insurance
between the time they had insurance, this incident and the new insurance. Chair Gafin asked if the
Stretch insurance for additional property coverage was $100,000. Director Passow confirmed
Chair Gafrn's question and stated that it will cover damages like these in the future. Trustee
Unkovich asked if he can request that Downey Construction also be allowed to bid in the final
repair. Ruben Rodriguez from Downey Construction bid the three holes around $8,000 and
estimated the first breach at $6,000. Director Passow commented that she is sure District Director
Chacon has shared it with Public Works, so that Downey Contraction is in the bid but she will go
ahead and make sure. Vice Chair Heyman commented that he is glad that two of the three
breaches have been repaired, he thanked Publics Works and Delfino. He asked if there was any
timeline as to when we can expect bids to repair the first breach, since it has been there for about
three to four months. Director Passow answered that the first breach will be repaired soon. Chair
Gafin asked if there has been any discussion with the City Attorney as to going after the owner of
the vehicle. Director Passow stated that the City's attorney is not the attorney for the cemetery. If
the City decides to go through the City Attorney, it would be an expensive fee. The County was
asked to go through with their attorneys and they also stated that they were not attorneys for the
cemetery. This district is independent so any services needed, we pay for it. The idea of going
after the vehicles' owner in reality would be too expensive due to the attorney costs; it would
outweigh the actual breach repair amount. Chair Gafin stated that he is very glad that his fellow
trustees approved the additional insurance policy.
3. Cemetery District & LAFCO Meeting Update
Director Passow stated that she and District Director Chacon met with the other cemetery districts
along with LAFCO, to talk about re -districting. For now, there is no revenue coming in except for
the property tax. If the City has a larger base this would hopefully bring larger revenue in the
future. Chair Gafin commented that it was always a concern to his recollection that it may cost
the district $50,000 to incorporate and make an extra $500 a year, it's just not going to pay out.
Until the district gets hard numbers to know whether we incorporate additional properties that are
not part of other districts and get a financial fix, to see what we are going to make out of it verses
the cost. Director Passow stated that they have requested to Los Angeles County several times for
an estimate to be provided of what will be made and they have not provided projections due to the
fluctuation of each year. If the district will be re -districting, the best way to do it is to share the
costs of the expense of doing this with other districts otherwise it won't be worth it. Vice Chair
Heyman asked who organized the meeting and who participated. Director Passow answered that
LAFCO was the one that organized the meeting. Little Lake, La Mirada, and Artesia attended and
the districts involved knew that Downey wanted to re -district as well. Vice Chair Heyman
requested for the next meeting, a list of the staff from the districts and LAFCO that participated in
the call.
Trustee Reports/Discussion:
Trustee Unkovich commented that the process on the wall is great, that was his main concern and is
pleased with the progress.

adjourned at 5:17 p.m.
