Pursuant to General Rule 7.6.3 of General Order ("GO") 96-B, Golden State Water
Company ("GSWC") respectfully requests California Public Utilities Commission
("Commission") review of the Water Division's ("WD") disposition rejecting Advice Letter
("AL") 1795 -WA dated January 17, 2020 ("Disposition"). As discussed in detail below, AL
1795 -WA should be approved because the costs to be tracked are substantial and not de minimis,
significant costs are likely to occur before the decision in GSWC's next rate case, and the
potential threat to public health associated with Polyfluoroalkyl Substances ("PFAS") overrides
any other concerns. Contrary to WD's strict adherence to formulaic tests, the Commission has
readily acknowledged that public policy considerations may warrant the establishment of a
memorandum account regardless of any other circumstances. The burgeoning public health
crisis associated with PFAS confronting water systems is exactly such a public policy
consideration.
I. Backgroundo
A. Polyfluoroalkyl(Substancesm
PFAS are a class of chemicals of growing public concern and disrepute. Decades of
steadily rising alarm as these "forever chemicals" were found to persist in the environment and
accumulate in the human body failed to spur concerted action until recently. First there were
lawsuits against chemical companies producing PFAS, then slowly there came
acknowledgements from scientists and then governments and regulators of potential harm, and
now alarms are being sounded around the world as these substances continue to be found
virtually everywhere people look for them, most notably in the water coming out of taps around

the world. At the same time that knowledge of their prevalence and persistence has grown, they
have been linked with increasing confidence to various adverse health effects, including
developmental irregularities, immune system dysfunction, and cancer.'

In recent years, public perception has increasingly been shaped by media through
compelling narratives. Most recently, the critically acclaimed Hollywood film starring Mark
Ruffalo and Anne Hathaway titled Dark Waters was released in November 2019 depicting a
lawyer's 20 -year legal battle to hold a chemical manufacturer accountable for the adverse health
effects experienced by the residents of Parkersburg, West Virginia where the water supply had
been contaminated by years of PFAS discharges. The makers of the film, and the real-life
characters portrayed therein, have used it as a platform to spread public awareness of the threat
of PFAS, taking their message all the way to the U.S. Congress.' The New York Tinges Magazine
article on which the writers based their film lays out parallels to GSWC's present situation:
Joseph Kiger, a night -school teacher in Parkersburg, called Bilott
to ask for help. About nine months earlier, he received a peculiar
note from the Lubeck water district. It arrived on Halloween day,
enclosed in the monthly water bill. The note explained that an
unregulated chemical named PFOA had been detected in the
drinking water in "low concentrations," but that it was not a
health risk.
No one knows for certain how much PFOA is safe to drink.... The
nonprofit Environmental Working Group analyzed two years of
E.P.A. survey data to find that [the "approximate" safe level] had
been exceeded in some cases by factors of 100 or more in 94
water systems across 27 states. Below, the estimated number of
people in each state whose drinking water is affected.

Anyone exposed to such narratives is likely to be alarmed if they receive a similar letter
from their water utility stating that PFAS has been detected in their water supply. As the co-
author of a recent Environmental Working Group study that found PFAS in municipal water
systems across the United States told BuzzFeed News, "PFAS in drinking water is not okay."'
GSWC could not possibly argue the contrary to its customers. Any customer receiving notice
that PFAS is in their drinking water would reasonably expect that action be taken to test,
monitor, and remediate their water supply. If there is undue delay in taking such actions, anger
is an entirely appropriate response.
2. Governmentoketiono
While California has not yet established a drinking water standard, governments around
the world have started developing restrictions. The U.S. Environmental Protection Agency
("U.S. EPA") has classified PFAS as an "emerging contaminant" but has delayed setting a
national standard for limiting the levels in drinking water. In 2016, the agency issued a
nonbinding health advisory for two of the most common PFAS, perfluorooctanoic ("PFOA") and
perfluorooctanesulfonic acid ("PFOS"), recommending that water utilities notify the public if
levels of the chemicals reached a combined 70 parts per trillion ("ppt").
As public alarm has risen, governments have started taking action. On July 31, 2019,
California Governor Gavin Newsom approved Assembly Bill No. 756 ("AB 756") which
authorizes the State Water Resources Control Board ("SWRCB") to order a public water system
to monitor for PFAS more broadly. AB 756 took effect on January 1, 2020.
On August 23, 2019, the SWRCB announced updated guidelines for local water
agencies to follow in detecting and reporting the presence of PFOA and PFOS in drinking water.
The SWRCB also announced it has begun the process of establishing regulatory standards for
these chemicals. The updated state guidelines lower the current notification levels from 14 ppt to
5.1 ppt for PFOA and from 13 ppt to 6.5 ppt for PFOS. Notification levels are a precautionary
health -based measure for concentrations in drinking water that warrant notification and further
monitoring and assessment. Public water systems are encouraged to test their water for
contaminants with notification levels, and in some circumstances may be ordered to test. If the
systems do test, they are required to report exceedances to their governing boards and the
SWRCB and are urged to report this information to customers.

In addition to the updated notification levels, the SWRCB has requested that the Office of
California Environmental Health Hazard Assessment ("OEHHA") develop public health goals
("PHGs") for both PFOA and PFOS, the next step in the process of establishing regulatory
standards, or maximum contaminant levels ("MCLs"), in drinking water. Other chemicals in the
broader group of PFAS may be considered later, either individually or grouped, as data permits.
Unlike other states, California has not developed its own PHGs at this time.
Other states, however, have begun to issue PFAS drinking water regulations. New
Hampshire for example, after extensive evaluation of the health risks established an MCL for
PFOA at 12 ppt and PFOS at 15 ppt. New Jersey's proposed MCL would set PFOA at 14 ppt
and PFOS at 13 ppt. Massachusetts recently proposed an MCL that would set a combined limit
of 20 ppt for six PFAS compounds. Vermont's drinking water limit for both PFOA and PFOS is
20 ppt.
Similar to what these states have already done to establish their respective drinking water
standards, the SWRCB is in the process of conducting a statewide assessment to determine the
scope of PFAS contamination in water systems and groundwater. In March 2019 public water
systems were ordered to sample (quarterly for one year) about 600 drinking water supply wells
where contamination is considered more likely, and near locations where PFAS was previously
found. GSWC was mandated to test 19 of its approximately 235 wells, one of which was found
to have levels of PFOS that exceeded the notification level of 13 ppt. Consistent with the
SWRCB's requirements and recommendations, GSWC is incurring additional costs in order to
provide timely notifications to governing bodies and customers and proactively address the issue.
Anticipating that affected customers would be alarmed, GSWC took the well out of service and
is planning for treatment and remediation. Additionally, PFOS was detected in additional wells
that are already equipped with the necessary treatment equipment but treatment and monitoring
costs associated with the treatment process will increase. Following this initial phase, the
assessment will likely focus on sampling water sources near industrial sites and at wastewater
treatment facilities. As a result, GSWC anticipates additional testing requirements of its
remaining wells. Given the growing public concern and the expected expansion of SWRCB
requirements, GSWC is expecting to be required by the SWRCB to test all of its wells.
B. ALo1795-WAo
In the midst of these developments, GSWC submitted AL 1795-W on October 31, 2019,
as supplemented and replaced by AL 1795 -WA on December 5, 2019, seeking authorization to
establish the Polyfluoroalkyl Substances Memorandum Account ("PFASMA") to record
incremental expenses and carrying costs of new facilities costs, that are not otherwise covered in
GSWC's revenue requirement, to comply with the regulatory standards set by the SWRCB to
detect, monitor and report PFAS in drinking water. GSWC would record the carrying costs at its
ME
adopted rate of return for all incremental plant investment, such as treatment facilities to remove
PFAS, in the PFASMA.
In the event that GSWC lost a well source due to PFAS and made incremental plant
investment such as addition and/or modification of facilities (wells, treatment plants, etc.),
GSWC would demonstrate that the incremental plant investment was necessary to meet the water
system's demand, and provide the most cost-effective water supply. AL 1795 -WA was not
protested by any party.
WD issued its Disposition on January 17, 2020, applying the test established in D.02-08-
054 whereby the "establishment of a memorandum account is appropriate when the following
four conditions exist:
a) The expense is caused by an event of an exceptional nature that
is not under the utility's control;
b) The expense cannot have been reasonably foreseen in the
utility's last general rate case and will occur before the utility's
next scheduled rate case;
c) The expense is of a substantial nature as to the amount of money
involved; and
d) The ratepayers will benefit by the memorandum account
treatment. "b
WD rejected AL 1795 -WA on two of the above criteria: (1) "the water testing costs are not
substantial in nature as to the amount of money involved," and (2) "given the State Water
Resources Control Board's expected timeline for implementing a maximum contaminant level
(MCL) for Polyfluoroalkyl Substances, any needed treatment costs will not occur before
GSWC's next scheduled rate case in July 2020 or the rate case there after in July 2023." For the
reasons sets forth below, GSWC respectfully requests that the Commission reverse the
Disposition and approve AL 1795 -WA and its underlying request to establish the PFASMA.
II. Discussiono
A. TheacostsdocbectrackeddndheaPFASMAaarecsubstantialaandaaremot(deo
minimis.o
The Commission's standard for the "substantial cost" prong of the four -prong test for the
establishment of memorandum accounts is not well-defined but is sometimes considered to be

expenditures that exceed either 1% of the total revenue requirement or 2% of the estimated
operating costs.7 Applied to GSWC, these standards would require costs exceeding
approximately $3.2 million or $5.0 million, respectively. Contrary to WD's determination,
GSWC sees the costs related to PFAS as potentially exceeding these amounts. Further, in
GSWC's experience, ALs requesting the establishment of a memorandum account have
previously been approved with estimated costs well below these standards.$
The Disposition fails to consider most of the relevant costs, stating only that "the
estimated testing costs are de minimis and readily absorbable within the revenue requirement
authorized by the Commission."9 "Testing costs" are not the only costs that will be recorded in
the PFASMA, and although WD does not detail the figures it is referencing, it appears that it
only considered the initial testing costs. GSWC provided a numerical cost estimate of $300,000
- $400,000 solely for the initial testing of its remaining approximately 200 wells, but as GSWC
explained in AL 1795 -WA, that hardly begins to account for all of the costs likely to occur:
GSWC estimates incremental costs for testing, monitoring,
notifying customers and remediation [for the wells already tested]
due to the new requirements. The costs will be substantial.
Additional monitoring and compliance requirements remain in flux
but are expected to increase substantially over the next year, and
therefore all of the costs to comply with AB 756 and future mandates
from the SWRCB are uncertain. Additionally, the treatment costs
associated with remedying issues associated with potential positive
detections are not estimable at this time. However, the costs will not
be inconsequential. Finally, the existence of the costs is not
speculative. 10
Admittedly, there is significant uncertainty in how many wells will be affected, how the
standards may evolve over time, and what the cost of appropriate treatment measures will be.
This uncertainty prevents GSWC from providing precise numerical estimates of the expected
costs. However, GSWC can say with confidence that additional wells will likely be affected, the
testing and remediation standards are only likely to become more stringent over time, and the
cost of appropriate treatment measures will vary by affected well. The Orange County Water
District expects to see nearly a third of its 200 groundwater wells shut down by the end of 2020
and anticipates spending up to $200 million constructing treatment facilities to remove PFAS
from its water supplies.' GSWC continues to decline to provide speculative figures, but

vehemently disagrees that the costs related to PFAS could reasonably be described as
`insubstantial' or `de minimis.'
Even if the Commission determines that the costs that GSWC is likely to incur fall below
the `1% of total revenue requirement' or `2% of estimated operating costs' standards sometimes
applied, the Commission has approved GSWC Advice Letters requesting the establishment of
memorandum accounts with forecasted expenses below these standards in the past. For example,
in 2011 GSWC submitted AL 1435-W requesting authorization to establish the General Office
Maintenance Memorandum Account ("GOMMA") with only $11,000 of specified costs
referenced. In 2010, GSWC submitted AL 1412-W requesting authorization to establish the
Oracle Technical Support Costs Memorandum Account ("OTSCMA") with an estimate of
annual costs of $540,000. AL 1435-W and AL 1412-W were both approved and the GOMMA
and OTSCMA were both established even though GSWC was not able to provide a specific cost
estimate exceeding either 1 % of GSWC's total revenue requirement or 2% of GSWC's estimated
operating costs.
B. SignificantoPFASmostsoaredikelycto(Dccurd)eforecGSWC'smextcratemase.cD
WD reasoned that SWRCB's "expected timeline for implementing" a MCL for HAS
meant that no "treatment costs" would occur before GSWC's next rate case scheduled for July
2020 or even before the rate case after that scheduled for July 2023. WD's reasoning is flawed
on a number of grounds.
First, the implementation of an MCL is not the starting point for compliance costs related
to SWRCB's regulation of PFAS. AB 756 went into effect on January 1, 2020 and already
imposes compliance obligations on GSWC. Further, SWRCB has already ordered testing that
resulted in significant compliance costs for GSWC.
Second, "treatment costs" are not the only costs to be tracked in the PFASMA. Costs
related to the implementation of SWRCB's regulation of PFAS include laboratory testing and
monitoring, customer/public notifications, and chemical and operating costs for treatment.
Testing, monitoring, and notification activities all forcibly occur in advance of treatment.
Third, July 2020 is the expected filing date for GSWC's next rate case with a
Commission decision expected by the end of 2021. Even if this timing were acceptable, which
as explained herein it is not, this timing is by no means certain. Delays have occurred in the past
and could occur in the future. For example, the decision in GSWC's 2014 rate case was delayed
12 months beyond the originally scheduled date. The anticipated time between GSWC filing its
rate case and the Commission issuing a decision, according to the rate case plan, is 18 months,
but for the three rate cases from 2011 to 2017 it has taken an average of 25 months. Even the
timeline provided by the rate case plan is unacceptable for an issue of this urgency, and the

Commission's decision could experience delays independent of filing, over which GSWC has no
control.
Fourth, WD completely ignores the central fact that GSWC has already incurred costs
related to SWRCB's regulation of PFAS that would be tracked in the PFASMA. There is no
need to project when costs might begin to occur because costs have already occurred and
continue to accumulate. GSWC conducted testing, notified customers served by the
contaminated well at Norwalk, removed Norwalk from service, and is planning further testing
and eventual treatment of the contaminated well. Given the rising evidence of widespread HAS
contamination, GSWC is expecting to be required by SWRCB to test all of its wells far in
advance of SWRCB's final implementation of an MCL and anticipates additional contamination
will be detected in at least some of its approximately 200 other wells across the state, requiring
additional expenditures that collectively risk becoming quite substantial.
If the PFASMA is not in place, GSWC will not have the financial resources to take all
actions that it would otherwise consider prudent and reasonable in light of further detection of
PFAS; the denial of the establishment of the PFASMA would effectively tie GSWC's hands until
a decision is issued in its next rate case. The granting of GSWC's request for establishment of
the PFASMA would not be a blank check and would not guarantee recovery of any amounts
recorded therein. As with all memorandum accounts, recovery is still subject to a prudency
review by the Commission in which GSWC will bear the full burden of establishing the
reasonableness of any costs incurred. But without the PFASMA, GSWC would be forced to tell
customers, who may have received required notifications of PFAS contamination after SWRCB
mandated testing, that while it is aware of the contamination and understands their concern and
anger, it has not yet received the regulatory approvals from the Commission necessary for action
to protect their health, safety, and access to clean drinking water.
C. Other(publiccpolicyoconsiderations,m amelyctheathreatatocpublic(healthoando
generalaattitudesaamong(theq)ublic,ovvarrantaacstatemfocautionaando
preparednessaconsistentovithathecestablishment(nfdhecPFASMAcregardlessaofo
Commission(precedentaconcerninganemorandumaaccounts.o
Although GSWC's request to establish the PFASMA readily meets the four conditions
laid out by WD, it is important to note that WD is incorrect to treat the four -prong test as a list of
required conditions. As the Commission has noted before in reviewing its standards for
authorizing the establishment of memorandum accounts:
We have not applied a fixed set of factors in determining whether to
establish memorandum accounts for water utilities. Some of the
factors we have considered were articulated in Resolution No. W-
4276, D.02-08-054, and D.04-06-018, as DRA notes. In Standard
Practice U-27 W, paragraphs 25 and 44 contain similar lists of

factors. Even when the Commission has applied these factors, it has
not always applied all of them or required that they all be met before
authorizing a memorandum account. Thus, at different times, the
Commission has considered all these factors, considered only some
of these factors, or relied on other public policy considerations in
determining whether to authorize a memorandum account.
Regardless of the specific factors considered, the question presented
to the Commission in all instances is whether a utility should be
permitted to seek recovery of these costs at a later date without
encountering retroactive ratemaking issues.'-'
Regardless of the existence or lack of an MCL for PFAS from SWRCB, the U.S. EPA, or
any other state or federal regulatory agency, the need for testing, monitoring, notification, and
treatment is already known, by both GSWC and the public. Waiting for the finalization of those
regulatory processes will not reduce or mitigate the occurrence of costs. Indeed, there is more
reason to believe that undue delay will only exacerbate the costs, and more importantly the
accumulating harms of what the Los Angeles Times recently labelled "a public health crisis that
is playing out nationally."13 Customers would certainly wonder, however, why their water utility
and their state government waited so long to take action after the threat to public health was
known. Some would no doubt hear in their minds the voice of actor Mark Ruffalo from the
trailer for the film Dark Waters admonishing, "You knew. And still you did nothing.""
III. Conclusiono
For the reasons discussed herein, GSWC respectfully requests that the Commission
reverse WD's Disposition of Advice Letter 1795 -WA and grant the underlying request to
establish the PFASMA so that GSWC will be financially and organizationally prepared to take
all reasonable and prudent actions to protect California communities' access to safe and clean
drinking water.
