Award Contract to NR Development for Wilderness Park Pond Restoration ProjectCITY MANAGER •': HONORABLE MAY•' AND MEMBERS OF THE CITY COUNCIL • OFFICE OF THE CITY MANAGER JOHN OSKOUI, SUBJECT: WILDERNESS PARK PO11D RESTORATIO11 PROJECT AWARD CONSTRUCTION CONTRACTS FOR DEMOLITION, GRADING AND CONCRETE IMPROVEMENTS• AND IRRIGATION AND LADSCAPE IMPROVEMENTS• AND REJECT ALL BIDS RECEIVED FOR POND IMPROVEMENTS (CIP NO. 15-21D) It is recommended that the City Council: 1. Award a construction contract to NR Development in the amount of $1,475,500.00 for the Wilderness Park Pond Restoration Project's Demolition, Grading, and Concrete Improvements (CIP No. 15-21C). 2. Award a construction contract to Marina Landscape, Inc. in the amount of $729,000.00 for the Wilderness Park Pond Restoration Project's Irrigation and Landscape Improvements (CIP No. 15-21E). 3. Authorize the Assistant City Manager to execute any change orders or additional scope of work for the Wilderness Park Pond Restoration Project's Demolition, Grading and Concrete Improvements and Irrigation and Landscape Improvements up to 10% of the value of the bid amounts. 4. Reject all bids received for the Wilderness Park Pond Restoration Project's Pond Improvements (CIP No. 15-21 D) and authorize re -advertisement for bids. • On October 10, 2019, the City Clerk received and publicly opened five (5) bids for the Wilderness Park Ponds Restoration Project. On October 14, 2019, the City received a bid protest from the representative of the second lowest bidder. After reviewing the bids received and analyzing the current construction market conditions, the City Council rejected the five submitted bids and authorized staff to resolicit for construction bids in a more effective and economically efficient manner utilizing the "multi -prime" procurement method. In order to accommodate the "multi prime" modality of bidding the project, it has been divided into three separate projects as follows: a) Demolition, grading and construction of new concrete improvements. WILDERNESS PARK PONDS RESTORATION MULTI PROJECT (CIP NO. 15-21 C, CIP NO. 12-21 D, CIP NO. 15-21E) JANUARY 28, 2020 PAGE 2 b) Installation of a new irrigation system and new landscape improvements. c) Replacement of pond's liner, installation of new shoreline as well as new electrical and mechanical systems for pond's circulation and filtering needs. Additionally, the City will procure a new pedestrian bridge to be installed as part of the Pond Improvements (CIP No. 15-21 D) On November 14, 2019, and November 21, 2019, the Notice Inviting Bids for the three aforementioned projects was published in the Downey Patriot. On December 16, 2019, as related to CIP No.15-21C an addendum (Addendum No.1) was issued to include removal of any accumulated rain water from the previously emptied ponds and instructions on use of existing spoils for pond infill. Additionally, this addendum provided answers to pre-bid requests for information. Two more addendums (Addendum Nos. 2 and 3) were issued on January 3, 2020, to include temporary fencing in the scope of work and to provide additional information on site preparation for the hydro -seeding operation. On January 7, 2020, the City Clerk received and publicly opened eight (8) bids which ranged from $1,475,500 to $2,350,000, as shown on the attached bid summary (Attachment A) for CIP No. 15-21C, Demolition, Grading, and Concrete Improvements. Crosby Plumbing (the highest bidder) was deemed non-responsive as they did not include Addendum No. 3 in their submittal. The lowest responsive and responsible bidder is NR Development, Inc. with a bid in the amount of $1,475,500. Staff has confirmed that NR Development, Inc. possesses the specified contractor license and that the license is current and in good standing. Additionally, verbal qualification interviews with randomly selected NR Development, Inc.'s references are complete and the responses were all satisfactory. On January 7, 2020, the City Clerk received and publicly opened five (5) bids which ranged from $729,000 to $1,040,230, as shown on the attached bid summary (Attachment B) for CIP No. 15- 21 E, Irrigation and Landscape Improvements. The lowest responsive and responsible bidder is Marina Landscape, Inc. with a bid in the amount of $729,000. Staff has confirmed that Marina Landscape, Inc. possesses the specified contractor license and that the license is current and in good standing. Additionally, verbal qualification interviews with randomly selected Marina Landscape, Inc.'s references are complete and the responses were all satisfactory. On January 7, 2020, the City Clerk received and publicly opened three (3) bids which ranged from $1,665,500 to $1,810,000, as shown on the attached bid summary (Attachment C) for CIP No. 15-21D. On January 8, 2020, the City received a bid protest from the representative of the second lowest bidder, Pacific Aquascape International. On January 10, 2020, NR Development, the lowest bidder provided a response to the bid protest. Section 21 of the bid documents states that "The City reserves the right to reject any or all proposals and to waive any or all information or technical defects, as the interest of the City may require. Award of Contract or rejection of Bid proposals will be made by the City within 45 calendar days following the Bid opening." Upon reviewing the bid protest and the corresponding response, staff recommends that the City Council reject all bids received as related to the WILDERNESS PARK PONDS RESTORATION MULTI PROJECT (CIP NO. 15-21 C, CIP NO. 12-21 D, CIP NO. 15-21E) JANUARY 28, 2020 PAGE 3 Wilderness Park Pond Project Pond Improvements Multi CIP No.15-21 DI and authorize re - solicitation of bids. Below is a summary of the scope of work, implementation schedule and other relevant data related to each project: WILDERNESS PARK POND RESTORATION PROJECT (CIP 15-21C)- Demolition, Grading, and Concrete Improvements •Demolition and removal of existing lawn *Grading •Construction of concrete walking paths •Concrete improvements around Community Building WILDERNESS PARK POND RESTORATION PROJECT (CIP No. 15-21 D)- Pond Improvements Restoring the wetlands habitat at two existing ponds at Wilderness park *Replacement of existing invasive plants with specific native species •Installation of 40 ml. thick pond liners •Installation of hardened shoreline • Installation of new aeration system to improve water quality •Construction of new trail segments •Installation of a new pedestrian bridge supplied by the City •Installation of dry creek beds •Installation of educational wayfinding signage to facilitate wetlands and native habitat awareness *Removal and replacement of existing damaged concrete around the Community Building •Realignment of Electrical Vehicle Charging Station WILDERNESS PARK POND RESTORATION (CIP No. 15-21 E)- Irrigation and Landscape Improvements • Installation of a new irrigation system *Installation of new turf Staff respectfully requests that the City Council: Award a construction contract in the amount of $1,475,500 to NR Development, Inc. for the Wilderness Park Pond Restoration Project (CIP No. 15-21 C) Demolition, Grading and Concrete Improvements. 2. Award a construction contract in the amount of $729,000 to Marina Landscape, Inc. for the Wilderness Park Pond Restoration Project (CIP No. 15-21 E) Irrigation and Landscape Improvements. 3. Reject all bids received for the Wilderness Park Pond Restoration Project (CIP No. 15- 21 D ) Ponds Improvements and authorize re -solicitation of bids. Construction will start on February 17, 2019, and be completed on October 16, 2020. The Estimated Project Cost Summary is attached to this report (Attachment E). Quality of Life, Infrastructure & Parks The total estimated cost of the project, including construction costs (based on the construction bid amount, estimated construction costs and contingencies, design, inspection, construction engineering and management services and material testing) is $5,415,207.
