The Building Standards Commission adopts a compilation of building regulations every three years. These regulations, which are commonly referred to as the "Building Code," include: • California Building Code; • California Residential Code; • California Electrical Code; • California Mechanical Code; • California Plumbing Code; • California Energy Code; • California Historical Building Code; • California Existing Building Code; • California Referenced Standards Code; and • California Green Building Standards Code. The 2019 codes become effective on January 1, 2020, and apply to any project submitted for plan check thereafter. In order for the City of Downey to maintain its local amendments to the aforementioned codes, the City must readopt said amendments with the codes. The City Council introduced the ordinances at their November 20, 2019 meeting, and thus are scheduling this matter for public hearing at its January 14, 2020 meeting. Accordingly, a notice of the public hearing was published in the Downey Patriot for the forecasted hearing on this topic for the January 14, 2020 City Council Meeting. r •: Through the code adoption process, the Building Standards Commission selects and approves a model code that will apply statewide. The 2019 codes adopted by the Building Standards Commission strive to make all structures more energy efficient and structurally safer over the 2016 codes. As part of these codes, Chapters 11A and 11 B of the Building Code contain the accessibility standards for residential and commercial developments. In the State of California, these two chapters are consistent with, but enforced in lieu of, the American with Disability Act (ADA). Local jurisdictions are authorized to further modify the code to add more restrictive provisions based on their specific local geologic, climatic, and topographic conditions. All local amendments must be more restrictive than the State Codes and must be substantiated with findings, per California Health & Safety Code Section 17958. For the City of Downey, the "Building Code" is contained within Article VIII of the Municipal Code. The Building Standards Commission does not adopt the administration chapter of the California Codes therefor the City Council of Downey needs to adopt its own administration chapter. Local amendments are contained in the attached ordinances and are intended to address the unique conditions that the City of Downey incurs, such as being in a liquefaction area and large seismic 2019 BUILDING CODE JANUARY 14, 2020 PAGE 4 zone. The proposed local amendments are structural requirements consistent with local Los Angeles area cites and county. Accordingly, staff does not feel this additional restriction will create an undue burden on homeowners and developers. SECTIONS 8999.20-8999.48 The provisions of this chapter shall serve as the administrative, organizational and enforcement rules and regulations for all of this title. SECTIONS 8000-8029 The amendments to these sections are related to structural changes to be consistent with the surrounding Los Angeles city and county. SECTION 8030 The provisions of this Section shall apply to intermodal shipping containers that may be repurposed for use as buildings or structures or as a part of buildings or structures. SECTIONS 8993-8999.17 The amendments to these sections are related to structural changes to be consistent with the surrounding Los Angeles city and county. ATTACHMENTS Attachment A — Building Code Ordinance Attachment B — Electrical Code Ordinance Attachment C — Mechanical Code Ordinance Attachment D — Plumbing Code Ordinance Attachment E — Historical Building Code Ordinance Attachment F — Green Building Standards Code Ordinance Attachment G — Energy Code Ordinance Attachment H —Administrative Building and Housing Code Ordinance Attachment I — Existing Building Code Ordinance Attachment J — Referenced Standards Code Ordinance Attachment K — Residential Code Ordinance .Orr _Nrf T-(17#7 ors,10A If OF DOWNEY MUNICIPAL•r ADOPTING • CALIFORNIA BUILDING• i AND MAKING LOCALAMENDMENTS ME12ETO WHEREAS, Sections 17922, 17958, and 18941.5 of the California Health and Safety Code provide that the governing body of every city or county shall adopt ordinances or regulations imposing the same requirements as those contained in the most recently adopted version of the California Building Standards Code; and, WHEREAS, Sections 17958, 17958.5, 17958.7, and 18941.5 of the California Health & Safety Code provide that a city or county may make such changes or modifications to the requirements contained in the California Building Standards Code which are reasonably necessary because of local climatic, geological, or topographical conditions; and, WHEREAS, Sections 17958, 17958.7, and 18941.5 of the California Health & Safety Code provide that prior to making any change or modification to the California Building Standards Code authorized by the Health & Safety Code, the City Council of the City of Downey is required to make an express finding that such modifications or changes are reasonably necessary because of local climatic, geological, or topographical conditions; and, WHEREAS, the City Council of the City of Downey is not required to make an express finding for amendments necessary to carry out the application of the Building Standards Code and/or that do not otherwise modify a Building Standard; and, WHEREAS, because the City of Downey is in a liquefaction zone, the flood hazard section of this code has been amended; and, WHEREAS, the City of Downey is in Climate Zone 8 and, therefore, is required to have more stringent energy efficiency requirements; and, WHEREAS, the City of Downey is subject to ground tremors from large seismic events along, but not limited to, the San Andreas Fault; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Findings. The City Council hereby finds that the proposed amendments to the 2019 California Building Code are reasonably necessary because of local climatic, geologic of topographic conditions, and adopts the findings provided below to support the modifications to the 2019 California Building Code. The City Council further finds that some changes and modifications are of an administrative or procedural nature, or concern themselves with subjects not covered by the code, or are reasonably necessary to safeguard life and property within the City. The City Council hereby adopts the following (Climatic, geological, and topographical, where applicable) findings to support the proposed amendments to the 2019 California Building Code made in this Ordinance: I. Climatic Conditions A. The jurisdiction of the City of Downey (or, "City") is located in a semi -arid Mediterranean type climate. It annually experiences extended periods of high temperatures with little or no precipitation. For example, during July, August and September, temperatures often exceed 100 degrees Fahrenheit. During the same months humidity is usually less than 40%, and humidity measurements less than 10% are not uncommon. These conditions contribute to an increased likelihood of fire. Moreover, minor fires have a greater tendency of spreading rapidly due to such conditions. The City, being in the Southern California area, is also subject to "Sundowner" or "Santa Ana" winds that, should a fire occur, cause the fire to spread rapidly over wood shake roofs which are common in the residential areas. These hot, dry (Santa Ana) winds may reach speeds of 70 M.P.H. or greater. These climatic conditions cause extreme drying of vegetation and common building materials. Frequent periods of drought and low humidity add to the fire danger. This predisposes the area to large destructive fires (conflagration). In addition to directly damaging or destroying buildings, these fires are also prone to disrupt utility services throughout the City. Obstacles generated by a strong wind, such as fallen trees, street lights and utility poles, and the requirement to climb 75 feet vertically up flights of stairs will greatly impact the response time to reach an incident scene. Additionally, there is a significant increase in the amount of wind force at 60 feet above the ground. Use of aerial type fire -fighting apparatus above this height would place rescue personnel at increased risk of injury. B. Water demand in this densely populated area far exceeds the quantity supplied by natural precipitation; and although the population continues to grow, the already -taxed water supply does not. California is projected to increase in population by nearly 10 million over the next quarter of a century with 50 percent of that growth centered in Southern California. Due to storage capacities and consumption, and a limited amount of rainfall, future water allocation is not fully dependable. This necessitates the need for additional and on-site fire protection features. It would also leave tall buildings vulnerable to uncontrolled fires due to a lack of available water and an inability to pump sufficient quantities of available water to floors in a fire. C, These dry climatic conditions and winds contribute to the rapid spread of even small fires originating in high-density housing or vegetation. These fires spread very quickly and create a need for increased levels of fire protection. The added protection of fire sprinkler systems and other fire protection features will supplement normal fire department response by providing immediate protection for the building occupants and by containing and controlling the fire spread to the area of origin. Fire sprinkler systems will also reduce the use of water for firefighting by as much as 50 to 75 percent. Topographical conditions A. Development has occurred in the City and continues to occur in the City and such development has resulted in severe traffic congestion during peak business hours, weekends and holidays, thus decreasing the response time of fire and emergency service vehicles, particularly on the following streets and highways: Florence Avenue, Firestone Boulevard, Imperial Highway, Paramount Boulevard, Lakewood Boulevard, Brookshire Avenue, Bellflower Boulevard. B. These topographical conditions combine to create a situation which places fire department response time to fire occurrences at risk, and makes it necessary to provide automatic on-site fire -extinguishing systems and other protection • 1 r 1 0 measures to protect occupants and property. Due to these topographical conditions and the expected infrastructure damage inherent in seismic zones described below, it is prudent to rely on automatic fire sprinkler systems to mitigate extended fire department response time and keep fires manageable with reduced fire flow (water) requirements for a given structure. Numerous fires have occurred within the City in residential structures (houses, apartments, hotels, motels, and dormitories) over the past several years that have automatic fire protection systems, and in all of these fires, the automatic fire protection systems have successfully controlled and/or suppressed the fire before the emergency response personnel have been able to arrive at the structure. Additional fire protection is also justified to match the current resources of firefighting equipment and personnel within the fire department. Ill. Geological Conditions A. The City of Downey is located in Southern California, in an extremely active seismic region, with high levels of historic earthquake shaking in the recent past (earthquakes measuring larger than a magnitude 5 on the Richter Scale) and can be expected to experience significant strong ground shaking within the foreseeable future. The City is a densely populated area that has buildings constructed over and near a vast and complex network of faults that increase the likelihood of catastrophic damage when a seismic event occurs and which are believed to be capable of producing future earthquakes similar or greater in size to the 1994 Northridge, the 1987 Whittier Narrows Earthquake, the 1971 Sylmar earthquakes and 1933 Long Beach Earthquake. The seismotectonic setting of the City is dominated by the Norwalk fault, which traverses the northern portion of the City. The City is also in close proximity to the San Andreas Fault, which is located 40 miles to the northeast, the Whittier fault, located 10 miles to the northeast and the Newport -Inglewood fault, located 10 miles to the southwest. In the event of a severe earthquake, these faults present the potential for catastrophic damage, including fire, damage to roadways and other impairments of emergency apparatus. Existing and planned developments are at risk from structural damage from earthquake faults. Improved standards are necessary to ensure that maximum safety is provided to persons and property. B. Previous earthquakes have been accompanied by disruption of traffic flow and fires. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create obstacles similar to those indicated under the high wind section above. This situation creates the need for both additional fire protection and automatic on-site fire protection for building occupants. IV. SECTION 8003 — Section 1613.5.2 is added to Chapter 16 of the 2019 Edition of the California Building Code to read as follows: 1613.5.2 Wood diaphragms. Modify ASCE 7 Section 12.11.2.2.3 as follows: 12.11.2.2.3 Wood diaphragms. The anchorage of concrete or masonry structural walls to wood diaphragms shall be in accordance with AWC SDPWS 4.1.5.1 and this section. Continuous ties required by this section shall be in addition to the diaphragm sheathing. Anchorage shall not be accomplished by use of toenails or nails subject to withdrawal, nor shall wood ledgers or framing be used in cross -grain bending or cross -grain tension. The diaphragm sheathing shall not be considered effective for providing the ties or struts required by this section For structures assigned to Seismic Design Category D, E or F, wood diaphragms supporting concrete or masonry walls shall comply with the following: 1. The spacing of continuous ties shall not exceed 40 feet. Added chords of diaphragms may be used to form subdiaphragms to transmit the anchorage forces to the main continuous crossties. 2. The maximum diaphragm shear used to determine the depth of the subdiaphragm shall not exceed 75% of the maximum diaphragm shear. Modify ASCE 7 Section 12.12.3 Equation 12.12-1 as (5m = Cu(5 m" M�.�3�1\ ---I� ' ' SECTION 8005 — Section 1613.6 is added to Chapter 16 of the 2019 Edition of the California Building Code to reed as follows: i613.GSeismic design provisions for hillside buildings. 1613.6.1 Purpose. The purpose of this section is to establish minimum regulations for the design and construction of new buildings and additions to existing buildings when constructing such buildings on or into slopes steeper than one unit vertical in three units horizontal (33.3Y6). These regulations establish minimum standards for seismic force noniahanue to reduce the risk of injury or loss of life in the event ufearthquakes. 1613.8.2 Scope. The provisions of this section shall apply to the design of the lateral -force -resisting system for hillside buildings at and below the base level diaphragm. The design of the lateral— force—resisting system above the base level diaphragm shall be in accordance with the provisions for seismic and wind design on required elsewhere in this division. Exception: Non -habitable accessory buildings and decks not supporting or supported from the main building are exempt from these regulations. 1613.6.3 Definitions. For the purposes ofthis section certain terms are defined aafollows: BASE LEVEL DIAPHRAGM is the floor at, or closest to, the top of the highest level of the foundation. DIAPHRAGM ANCHORS are assemblies that connect a diaphragm to the adjacent foundation at the uphill diaphragm edge. DOWNHILL DIRECTION is the descending direction of the slope approximately perpendicular tothe slope contours. FOUNDATION is concrete or masonry which supports e bui|ding, including fooUngo, stem vva||o, retaining walls, and grade beams. FOUNDATION EXTENDING IN THE DOWNHILL DIRECTION isafoundation running downhill and approximately perpendicular tothe uphill foundation. HILLSIDE BUILDING is any building or portion thereof constructed on or into e slope steeper than one unit vertical in three units horizontal (33.3Y6). If only e portion of the building is supported on or into the slope, these regulations apply tothe entire building. PRIMARY ANCHORS are diaphragm anchors designed for and providing a direct connection as described in Sections 1613.6.5 and 1613.6.7.3 between the diaphragm and the uphill foundation. SECONDARY ANCHORS are diaphragm anchors designed for and providing a redundant diaphragm tofoundation connection, aadescribed inSections 1S13.0.Gand 1813.G.7.4. UPHILL DIAPHRAGM EDGE is the edge of the diaphragm adjacent and closest to the highest ground level atthe perimeter ofthe diaphragm. UPHILL FOUNDATION is the foundation parallel and closest to the uphill diaphragm edge 1613.6.4 Analysis and design. 1613L6.4.1 General. Every hillside building within the scope of this section shall be ana|yzed, designed, and constructed in accordance with the provisions of this division. When the code - prescribed wind design produces greater affects, the wind design shall gnvenn, but detailing requirements and limitations prescribed in this and referenced sections shall be followed. 1613.6.4,2 Base level diaphragm -downhill direction. The following provisions shall apply to the seismic analysis and design of the connections for the base level diaphragm in the downhill direction. 1613'6.4.2'1 Base for lateral force design defined. For seismic forces acting in the downhill direotion, the base of the building shall be the floor at orclosest to the top of the highest level of the foundation. 1813.6.4.2.2 Base shear. In developing the base shear for seismic design, the response modification coefficient (R) shall not exceed 5 for bearing vva|| and building frame systems. The total base shear shall include the forces tributary to the base level diaphragm including forces from the base level diaphragm. 1613.6.5 Base shear resistance -primary anchors. 1613.6.5.1 General. The base shear in the downhill direction shall be resisted through primary anchors from diaphragm struts provided in the base level diaphragm to the foundation. 1613.6.6.2 Location of primary anchors. Aprimary anchor and diaphragm strut shall be provided in line with each foundation extending in the downhill direction. primary anchors and diaphragm struts shall also be provided vvhmra interior vertical lateral -force -resisting elements occur above and in contact with the base level diaphragm. The spacing of primary anchors and diaphragm struts or collectors shall innncase exceed 3Ufeet (9144mm). 1613.6.5.3 Design of primary anchors and diaphragm struts. Primary anchors and diaphragm struts shall be designed in accordance with the requirements ofSection 1613.0.8. 1613.6.5.4 Limitations. The following |ehana/'fonoe'nasimbng elements shall not be designed to resist seismic forces be/ovvthe base level diaphragm in the downhill direction: 1. Wood structural panel wall sheathing, 2. Cement plaster and lath, 3. Gypsum wallboard, and 4. Tension only braced frames. Braced frames designed in accordance with the requirements ufSection 2205.2.1.2 may be used to transfer forces from the primary anchors and diaphragm struts to the foundation provided lateral forces do not induce flexural stresses in any member of the frame or in the diaphragm struts. Deflections of frames shall account for the variation in slope of diagonal members when the frame is not rectangular. 1613'6.6 Base shear resistance -secondary anchors. 1613.6.6.1 General. In addition tothe primary anchors required by Section 1813.0.5' the base shear in the downhill direction ehe|| be resisted through secondary anchors in the uphill foundation connected todiaphragm struts inthe base level diaphragm. Exception: Secondary anchors are not required xvhens foundations extending in the downhill direction spaced at not more than 30 feet (9144 nnnn) on center extend up to and are directly connected to the base level diaphragm for at least 70% of the diaphragm depth. 1613.6.6.2 Secondary anchor capacity and spacing. Secondary anchors at the base level diaphragm shall be designed fora minimum force equal to the base shear, including forces tributary to the base level diaphragm, but not less than GOO pounds per lineal foot (876 kN/n) based on Allowable Stress Design (ASD) levels. The secondary anchors shall be uniformly distributed along the uphill diaphragm edge and shall be spaced a maximum of 4 feet (1219 mm) on center. 1613.6.6.3 Design. Secondary anchors and diaphragm struts shall be designed in accordance with Section 1613.6.8. 1613.6.7 Diaphragms ba!ovv the base |ewe|+dom/nh||| direction. The following provisions ehe|/ apply to the lateral analysis and design of the connections for all diaphragms below the base level diaphragm in the downhill direction. 1613.6.7.1 Diaphragm defined. Every floor level below the base level diaphragm shall be designed gnadiaphragm. 1813.6.7.2 Design force. Each diaphragm below the base /eve/ diaphragm shall be designed for all tributary loads at that level using a minimum seismic force factor not |eeo than the base shear coefficient. 1613.6.7.3 Design force resistance -primary anchors. The design force described in Section 1613.6.7.2 shall be resisted through primary anchors from diaphragm struts provided in each diaphragm tothe foundation. Primary anchors shall be provided and designed in accordance with the requirements and limitations ofSection 1613.8.5. 1813.6.7.4 Daa|0n force resistance -secondary anchors. 1613.6.7.4.1 General. In addition tothe primary anchors required in Section 1013.6.7.3. the design force /n the downhill direction ohoU be resisted through secondary anchors in the uphill foundation connected hmdiaphragm struts ineach diaphragm below the base level, Exception: Secondary anchors are not required where foundations extending in the downhill dineodon, spaced at not more than 30 feet /9144 mm) on nenter, extend up to and are directly connected to each diaphragm below the base level for at least 70% of the diaphragm depth. 1613'6.7.4.2 Secondary anchor capacity. Secondary anchors at each diaphragm be/owthe base level diaphragm mha|l be designed for o minimum force equal to the design force but not less than 300 pounds per lineal foot (4.38 hN/rn) based on Allowable Stress Design (ASD) levels. The secondary anchors shall be uniformly distributed along the uphill diaphragm edge and shall be spaced amaximum of4feet (i210mm) oncenter. 1613.6.7.4.3 Design. Secondary anchors and diaphragm struts shall be designed in accordance with Section 1613.6.8. 1613.6.8 Primary and secondary anchorage and diaphragm strut design. Primary and secondary anchors and diaphragm struts shall be designed in accordance with the following provisions: 1. Fasteners. All bo/ted fasteners used hndevelop connections towood members shall be provided with square plate vvaeheno at all bolt heads and nuts. Washers shall be minimum 0.229 inch by 3 inches by 3 inches (5.82 mnnn by 70 mm by 76 mm) in size. Nuts shall be tightened to finger tight p/Ve one half (1/2) wrench turn prior tocovering the framing, Fastening. The diaphragm to foundation anchorage shall not be accomplished by the use of 3. Size ofWood Members. Wood diaphragm struts collectors, and other wood members connected to primary anchors shall not be less than 3 inch (76 mm) nominal width. The effects of eccentricity onwood members shall beevaluated oorequired per Item R. 4. Design. Primary and secondary anchorage, including diaphragm ohutn, sp/ioea, and collectors shall bedesigned for 12596ofthe tributary force. 5. Allowable Stress Increase. The one-third allowable ntnsso increase permitted under Section 1605.3.2 shall not be taken when the working (allowable) stress design method is used. O. Steel Element of Structural VVa|| Anchorage System. The strength design hunceo for steel elements of the structural wall anchorage ayebam, with the exception of anchor bolts and reinforcing steel, shall be increased by 1.4 times the forces otherwise required. 7. Primary Anchors. The load path for primary anchors and diaphragm struts shall be fully developed into the diaphragm and into the foundation. The foundation must be shown to be adequate tVresist the concentrated loads from the primary anchors. 8. Secondary Anchors. The load path for secondary anchors and diaphragm struts shall be fully developed in the diaphragm but need not be developed beyond the connection to the foundation. 8. Symmetry. All lateral force foundation anchorage and diaphragm strut connections shall be symmetrical. Eccentric connections may be permitted when demonstrated by calculation or tests that all components of force have been provided for in the structural analysis or tests. 10. Wood Ledgers. Wood ledgers shall not be used to resist cross -grain bending or cross -grain tension. 1613.6.9.1 General. 1nthe direction normal hothe downhill direction, lateral -force -resisting elements shall bedesigned inaccordance with the requirements ofthis section. 1613.6.9.2 Base shear. In developing the base shear for seismic design, the response modification coefficient (R) shall not exceed 5 for bearing wall and building frame systems. 1613'6.9.3 Vertical distribution of seismic forces. For seismic forces acting nomnm| to the downhill direction the distribution of seismic forces over the height of the building using Section 12.8.3 of ASCE 7 shall be determined using the height measured from the top of the lowest level of the building foundation. 1613'6.9.4 Drift limitations. The story drift below the base level diaphragm shall not exceed 0.007 times the story height at strength design force level. The total drift from the bane level diaphragm to the top of the foundation shall not exceed 3/4 inch (19 mm). Where the story height or the height from the base level diaphragm to the top of the foundation varies because of stepped footing or story offset, the height shall be measured from the average height of the top of the foundation. The story drift shall not be reduced by the effect of horizontal diaphragm stiffness. 1613.G.9'5Distribution oflateral forces. 1613.6,9.5.1 General, The design lateral force shall be distributed to lateral -force -resisting elements of varying heights in accordance with the stiffness of each individual element. 1613'6.9.5.2 Wood structural panel sheathed walls. The stiffness of g stepped wood structural panel shear vve|| may be determined by dividing the xva|| into adjacent rectangular e|emnento, subject to the same top of wall deflection. Deflections of shear walls ey be eaUnnabad by AVVC SDPVVG Section 4.3.2. Sheathing and fastening requirements for the stiffest section shall be used for the entire vve|i Each section of wall shall be anchored for shear and uplift at each step. The minimum *RDINANCE NO. PAGE 10 horizontal length of a step shall be 8 feet (2438 mm) and the maximum vertical height of a step shall be 2 feet 8 inches (813 mm). 1613.6.9.5.3 Reinforced concrete or masonry shear walls. Reinforced concrete or masonry shear walls shall have forces distributed in proportion to the rigidity of each section of the wall. 1613.6.9.6 Limitations. The following lateral force -resisting -elements shall not be designed to resist lateral forces below the base level diaphragm in the direction normal to the downhill direction: 1. Cement plaster and lath, 2. Gypsum wallboard, and 3. Tension -only braced frames. Braced frames designed in accordance with the requirements of Section 2205.2.1.2 of this Code may be designed as lateral -force -resisting elements in the direction normal to the downhill direction, provided lateral forces do not induce flexural stresses in any member of the frame. Deflections of frames shall account for the variation in slope of diagonal members when the frame is not rectangular. 1613.6.10 Specific design provisions. 1613.6.10.1 Footings and grade beams. All footings and grade beams shall comply with the following: 1. Grade beams shall extend at least 12 inches (305 mm) below the lowest adjacent grade and provide a minimum 24 inch (610 mm) distance horizontally from the bottom outside face of the grade beam to the face of the descending slope. 2. Continuous footings shall be reinforced with at least two No. 4 reinforcing bars at the top and two No. 4 reinforcing bars at the bottom. 3. All main footing and grade beam reinforcement steel shall be bent into the intersecting footing and fully developed around each corner and intersection. 4. All concrete stem walls shall extend from the foundation and reinforced as required for concrete or masonry walls. 1613.6.10.2 Protection against decay and termites. All wood to earth separation shall comply with the following: 1. Where a footing or grade beam extends across a descending slope, the stem wall, grade beam, or footing shall extend up to a minimum 18 inches (457 mm) above the highest adjacent grade. Exception: At paved garage and doorway entrances to the building, the stem wall need only extend to the finished concrete slab, provided the wood framing is protected with a moisture proof barrier. 2. Wood ledgers supporting a vertical load of more than 100 pounds per lineal foot (1.46 kN/m) based on Allowable Stress Design (ASD) levels and located within 48 inches (1219 mm) of adjacent grade are prohibited. Galvanized steel ledgers and anchor bolts, with or without wood nailers, or treated or decay resistant sill plates supported on a concrete or masonry seat, may be used. 1613.6.10.3 Sill plates. All sill plates and anchorage shall comply with the following: 1. All wood framed walls, including nonbearing walls, when resting on a footing, foundation, or grade beam stem wall, shall be supported on wood sill plates bearing on a level surface. 9 r A 0 2. Power -driven fasteners shall not be used to anchor sill plates except at interior nonbearing walls not designed as shear walls. 1613.6.10.4 Column base plate anchorage. The base of isolated wood posts (not framed into a stud wall) supporting a vertical load of 4,000 pounds (17.8 kN) based on Allowable Stress Design (ASD) levels or more and the base plate for a steel column shall comply with the following: 1. When the post or column is supported on a pedestal extending above the top of a footing or grade beam, the pedestal shall be designed and reinforced as required for concrete or masonry columns. The pedestal shall be reinforced with a minimum of four No. 4 bars extending to the bottom of the footing or grade beam. The top of exterior pedestals shall be sloped for positive drainage. 2. The base plate anchor bolts or the embedded portion of the post base, and the vertical reinforcing bars for the pedestal, shall be confined with two No. 4 or three No. 3 ties within the top 5 inches (127 mm) of the concrete or masonry pedestal. The base plate anchor bolts shall be embedded a minimum of 20 bolt diameters into the concrete or masonry pedestal. The base plate anchor bolts and post bases shall be galvanized and each anchor bolt shall have at least 2 galvanized nuts above the base plate. 1613.6.10.5 Steel beam to column supports. All steel beam to column supports shall be positively braced in each direction. Steel beams shall have stiffener plates installed on each side of the beam web at the column. The stiffener plates shall be welded to each beam flange and the beam web. Each brace connection or structural member shall consist of at least two 5/8 inch (15.9 mm) diameter machine bolts. SECTION 8006 — Section 1613.7 is added to Chapter 16 of the 2019 Edition of the California Building Code to read as follows: 1613.7 Suspended ceilings. Minimum design and installation standards for suspended ceilings shall be determined in accordance with the requirements of Section 2506.2.1 of this Code and this section. 1613.7.1 Scope. This part contains special requirements for suspended ceilings and lighting systems. Provisions of Section 13.5.6 of ASCE 7 shall apply except as modified herein. 1613.7.2 General. The suspended ceilings and lighting systems shall be limited to 6 feet (1828 mm) below the structural deck unless the lateral bracing is designed by a licensed engineer or architect. 1613.7.3 Sprinkler heads. All sprinkler heads (drops) except fire -resistance -rated floor/ceiling or roof/ceiling assemblies, shall be designed to allow for free movement of the sprinkler pipes with oversize rings, sleeves or adaptors through the ceiling tile. Sprinkler heads and other penetrations shall have a 2 inch (50mm) oversize ring, sleeve, or adapter through the ceiling the to allow for free movement of at least 1 inch (25mm) in all horizontal directions. Alternatively, a swing joint that can accommodate 1 inch (25 mm) of ceiling movement in all horizontal directions is permitted to be provided at the top of the sprinkler head extension. Sprinkler heads penetrating fire -resistance -rated floor/ceiling or roof/ceiling assemblies shall comply with Section 714 of this Code. 1613.7.4 Special requirements for means of egress. Suspended ceiling assemblies located along means of egress serving an occupant load of 30 or more shall comply with the following provisions. 1613.7.4.1 General. Ceiling suspension systems shall be connected and braced with vertical hangers attached directly to the structural deck along the means of egress serving an occupant load of 30 or more and at lobbies' accessory to Group A Occupancies. Spacing of vertical hangers shall not exceed 2 feet (610 mm) on center along the entire length of the suspended ceiling assembly located along the means of egress or at the lobby. 1613.7.4.2 Assembly device. All lay -in panels shall be secured to the suspension ceiling assembly with two hold-down clips minimum for each tile within a 4 -foot (1219 mm) radius of the exit lights and exit signs. 1613.7.4.3 Emergency systems. Independent supports and braces shall be provided for light fixtures required for exit illumination. Power supply for exit illumination shall comply with the requirements of Section 1008.3 of this Code. 1613.7.4.4 Supports for appendage. Separate support from the structural deck shall be provided for all appendages such as light fixtures, air diffusers, exit signs, and similar elements. SECTION 8007 — Section 1704.6 of the 2019 Edition of the California Building Code is amended to read as follows: 1704.6 Structural observations. Where required by the provisions of Section 1704.6.1, 1704.6.2 or 1704.6.3, the owner or the owner's authorized agent shall employ structural observer to perform structural observations. Structural observation does not include or waive the responsibility for the inspections in Section 110 or the special inspections in Section 1705 or other sections of this code. The structural observer shall be one of the following individuals: 1. The registered design professional responsible for the structural design, or 2. A registered design professional designated by the registered design professional responsible for the structural design. Prior to the commencement of observations, the structural observer shall submit to the building official a written statement identifying the frequency and extent of structural observations. The owner or owner's authorized agent shall coordinate and call a preconstruction meeting between the structural observer, contractors, affected subcontractors and special inspectors. The structural observer shall preside over the meeting. The purpose of the meeting shall be to identify the major structural elements and connections that affect the vertical and lateral load resisting systems of the structure and to review scheduling of the required observations. A record of the meeting shall be included in the report submitted to the building official. Observed deficiencies shall be reported in writing to the owner or owner's authorized agent, special inspector, contractor and the building official. Upon the form prescribed by the building official, the structural observer shall submit to the building official a written statement at each significant construction stage stating that the site visits have been made and identifying any reported deficiencies which, to the best of the structural observer's knowledge, have not been resolved. A final report by the structural observer which states that all observed deficiencies have been resolved is required before acceptance of the work by the building official. SECTION 8008 — Section 1704.6.2 of the 2019 Edition of the California Building Code is amended to read as follows: 1704.6.2 Structural observations for seismic resistance. Structural observations shall be provided for those structures assigned to Seismic Design Category D, E or F where one or more of the following conditions exist: 1. The structure is classified as Risk Category III or IV. 2. The structure is classified as Risk Category I or Il, and a lateral design is required for the structure or portion thereof. Exception: One-story wood framed Group R-3 and Group U Occupancies less than 2,000 square feet in area, provided the adjacent grade is not steeper than 1 unit vertical in 10 units horizontal (10% sloped), assigned to Seismic Design Category D. • i 0 0; UACIMIK SECTION 8009 — Section 1705.12 of the 2019 Edition of the California Building Code is amended to read as follows: 1705.12 Special inspections for seismic resistance. Special inspections for seismic resistance shall be required as specified in Sections 1705.12.1 through 1705.12.9, unless exempted by the exceptions of Section 1704.2. Exception: The special inspections specified in Sections 1705.12.1 through 1705.12.9 are not required for structures designed and constructed in accordance with one of the following: 1. The structure consists of light -frame construction; the design spectral response acceleration at short periods, SDS, as determined in Section 1613.2.4, does not exceed 0.5; and the building height of the structure does not exceed 35 feet (10 668 mm). 2. The seismic force -resisting system of the structure consists of reinforced masonry or reinforced concrete; the design spectral response acceleration at short periods, SDS, as determined in Section 1613.2.4, does not exceed 0.5; and the building height of the structure does not exceed 25 feet (7620 mm) 3. The structure is a detached one- or two-family dwelling not exceeding two stories above grade plane, is not assigned to Seismic Design Category D, E or F, and does not have any of the following horizontal or vertical irregularities in accordance with Section 12.3 of ASCE 7: 3.1 Torsional or extreme torsional irregularity. 3.2 Nonparallel systems irregularity - 3.3 Stiffness -soft story or stiffness -extreme soft story irregularity. 3.4 Discontinuity in lateral strength -weak story irregularity. SECTION 8010 — Section 1807.1.4 of the 2019 Edition of the California Building Code is amended to read as follows: 1807.1.4 Permanent wood foundation systems. Permanent wood foundation systems shall be designed and installed in accordance with AWC PWF. Lumber and plywood shall be treated in accordance with AWPA U1 (Commodity Specification A, Special Requirement 4.2) and shall be identified in accordance with Section 2303.1.9.1. Permanent wood foundation systems shall not be used for structures assigned to Seismic Design Category D, E or F. SECTION 8011 — Section 1807.1.6 of the 2019 Edition of the California Building Code is amended to read as follows: 1807.1.6 Prescriptive design of concrete and masonry foundation walls. Concrete and masonry foundation walls that are laterally supported at the top and bottom shall be permitted to be designed and constructed in accordance with this section. Prescriptive design of foundation walls shall not be used for structures assigned to Seismic Design Category D, E or F. SECTION 8012 — Section 1807.2 of the 2019 Edition of the California Building Code is amended to read as follows: 1807.2 Retaining walls. Retaining walls shall be designed in accordance with Section 1807.2.1 through 1807.2.3. Retaining walls assigned to Seismic Design Category D, E or F shall not be partially or wholly constructed of wood. SECTION 8013 — Section 1807.3.1 of the 2019 Edition of the California Building Code is amended to read as follows: ail 1 •' 1:1-11MME, 1807.3.1 Limitations. The design procedures outlined in this section are subject to the following limitations: 1. The frictional resistance for structural walls and slabs on silts and clays shall be limited to one- half of the normal force imposed on the soils by the weight of the fooling or slab. 2. Posts embedded in earth shall not be used to provide lateral support for structural or nonstructural materials such as plaster, masonry or concrete unless bracing is provided that develops the limited deflection required. Wood poles shall be treated in accordance with AWPA U1 for sawn timber posts (Commodity Specification A, Use Category 4B) and for round timber posts (Commodity Specification B, Use Category 4B). Wood poles and posts embedded in direct contact with soil shall not be used for structures assigned to Seismic Design Category D, E or F. Exception: Wood poles and posts embedded in direct contact with soil may be used to support uninhabitable, unoccupiable structures such as fences when approved by the building official. SECTION 8014 — Section 1809.3 of the 2019 Edition of the California Building Code is amended to read as follows: 1809.3 Stepped footings. The top surface of footings shall be level. The bottom surface of footings shall be permitted to have a slope not exceeding one unit vertical in 10 unit's horizontal (10 -percent slope). Footings shall be stepped where it is necessary to change the elevation of the top surface of the footing or where the surface of the ground slopes more than one unit vertical in 10 units horizontal (10 -percent slope). For structures assigned to Seismic Design Category D, E or F, the stepping requirement shall also apply to the top surface of continuous footings supporting walls. Footings shall be reinforced with four No. 4 deformed reinforcing bars. Two bars shall be placed at the top and bottom of the footings as shown in Figure 1809.3. SECTION 8019 — Section 1905.1 is amended and Sections 1905.1.9 thru 1905.1.11 are added to Chapter 19 of the 2019 Edition of the California Building Code to read as follows: 1905.1 General. The text of ACI 318 shall be modified as indicated in Sections 1905.1.1 through 1905.1.11. 1905.1.9 ACI 318, Section 18.7.5. Modify ACI 318, Section 18.7.5, by adding Section 18.7.5.7 and 18.7.5.8 as follows: 18.7.5.7 Where the calculated point of contraflexure is not within the middle half of the member clear height, provide transverse reinforcement as specified in ACI 318 Sections 18.7.5.1, Items (a) through (c), over the full height of the member. 18.7.5.8 — At any section where the design strength, cpPn, of the column is less than the sum of the shears Ve computed in accordance with ACI 318 Sections 18.7.6.1 and 18.6.5.1 for all the beams framing into the column above the level under consideration, transverse reinforcement as specified in ACI 318 Sections 18.7.5.1 through 18.7.5.3 shall be provided. For beams framing into opposite sides of the column, the moment components are permitted to be assumed to be of opposite sign. Modify ACI 318, Section 18.10.4, by adding Section 18.10.4.6 as follows: 18.10.4.6 — Walls and portions of walls with P,, > 0.35P,, shall not be considered to contribute to the calculated shear strength of the structure for resisting earthquake -induced forces. Such walls shall conform to the requirements of ACI 318 Section 18.14. 1905.1.11 ACI 318, Section 18.12.6. Modify ACI 318, by adding Section 18.12.6.2 as follows: 18.12.6.2 Collector and boundary elements in topping slabs placed over precast floor and roof elements shall not be less than 3 inches (76 mm) or 6 db in thickness, where db is the diameter of the largest reinforcement in the topping slab. SECTION 8020 — Section 2304.10.1 of the 2019 Edition of the California Building Code is amended to read as follows: 2304.10.1 Fastener requirements. Connections for wood members shall be designed in accordance with the appropriate methodology in Section 2302.1. The number and size of fasteners connecting wood members shall not be less than that set forth in Table 2304.10.1. Staple fasteners in Table 2304.10.1 shall not be used to resist or transfer seismic forces in structures assigned to Seismic Design Category D, E or F. Exception: Staples may be used to resist or transfer seismic forces when the allowable shear values are substantiated by cyclic testing and approved by the building official. I.-Iffiffia SECTION 8021 - Section 2304.10.2.1 is added to Chapter 23 of the 2019 Edition of the California Building Code to read as follows: 2304.10.2.1 Quality of nails. In Seismic Design Category D, E or F, mechanically driven nails used in wood structural panel shear walls shall meet the same dimensions as that required for hand -driven nails, including diameter, minimum length and minimum head diameter. Clipped head or box nails are not permitted in new construction. The allowable design value for clipped head nails in existing construction may be taken at no more than the nail -head -area ratio of that of the same size hand - driven nails. SECTION 8022 - Section 2304.12.5 of the 2019 Edition of the California Building Code is amended to read as follows: 2304.12.5 Wood used in retaining walls and cribs. Wood installed in retaining or crib walls shall be preservative treated in accordance with AWPA U1 for soil and fresh water use. Wood shall not be used in retaining or crib walls for structures assigned to Seismic Design Category D, E or F. SECTION 8023 - Section 2305.4 is added to Chapter 23 of the 2019 Edition of the California Building Code to read as follows: 2305.4 Hold-down connectors. In Seismic Design Category D, E or F, hold-down connectors shall be designed to resist shear wall overturning moments using approved cyclic load values or 75 percent of the allowable seismic load values that do not consider cyclic loading of the product. Connector bolts into wood framing shall require steel plate washers on the post on the opposite side of the anchorage device. Plate size shall be a minimum of 0.229 inch by 3 inches by 3 inches (5.82 mm by 76 mm by 76 mm) in size. Hold-down connectors shall be tightened to finger tight plus one half (1/2) wrench turn just prior to covering the wall framing. SECTION 8024 - Section 2306.2 of the 2019 Edition of the California Building Code is amended to read as follows: 2306.2 Wood -frame diaphragms. Wood -frame diaphragms shall be designed and constructed in accordance with AWC SDPWS. Where panels are fastened to framing members with staples, requirements and limitations of AWC SDPWS shall be met and the allowable shear values set forth in Table 2306.2(1) or 2306.2(2) shall only be permitted for structures assigned to Seismic Design Category A, B, or C. Exception: Allowable shear values where panels are fastened to framing members with staples may be used if such values are substantiated by cyclic testing and approved by the building official. The allowable shear values in Tables 2306.2(1) and 2306.2(2) are permitted to be increased 40 percent for wind design. Wood structural panel diaphragms used to resist seismic forces in structures assigned to Seismic Design Category D, E or F shall be applied directly to the framing members. Exception: Wood structural panel diaphragms are permitted to be fastened over solid lumber planking or laminated decking, provided the panel joints and lumber planking or laminated decking joints do not coincide. SECTION 8025 - Section 2306.3 of the 2019 Edition of the California Building Code is amended to read as follows: 2306.3 Wood -frame shear walls. Wood -frame shear walls shall be designed and constructed in accordance with AWC SDPWS. For structures assigned to Seismic Design Category D, E, or F, application of Tables 4.3A and 4.313 of AWC SDPWS shall include the following: 1. Wood structural panel thickness for shear walls shall not be less than 3/8 inch thick and studs shall not be spaced at more than 16 inches on center. 2. The maximum nominal unit shear capacities for 3/8 inch wood structural panels resisting seismic forces in structures assigned to Seismic Design Category D, E or F is 400 pounds per linear foot (plf). Exception: Other nominal unit shear capacities may be permitted if such values are substantiated by cyclic testing and approved by the building official. 3. Nails shall be placed not less than 1/2 inch in from the panel edges and not less than 3/8 inch from the edge of the connecting members for shear greater than 350 plf using ASD or 500 plf using LRFD. Nails shall be placed not less than 3/8 inch from panel edges and not less than 1/4 inch from the edge of the connecting members for shears of 350 plf or less using ASD or 500 plf or less using LRFD. 4. Table 4.3B application is not allowed for structures assigned to Seismic Design Category D, E, or F. For structures assigned to Seismic Design Category D, application of Table 4.3C of AWC SDPWS shall not be used below the top level in a multi-level building. The provisions of Section 3114 and other applicable sections of this code shall apply to intermodal shipping containers that are repurposed for use as buildings or structures or as a part of buildings Vrstructures. Exceptions: 1. Stationary storage battery arrays located in intermodal shipping containers complying with Chapter 12 of the California Fire Code. 2. Valid maintenance examination date Where approved by the building official, the markings and manufacturer's existing data plate are permitted to be removed from the intermodal shipping containers before they are repurposed for use as buildings or structures or as part of buildings or structures. 3114.4 Protection against decay and termites. Wood structural floors of intermodal shipping containers shall be protected from decay and termites in accordance with the applicable provisions of Section 2304.12.1.1. 3114.5 Under -floor ventilation. The space between the bottom of the floor joists and the earth under any intermodal shipping container, except spaces occupied by basements and cellars, shall be provided with ventilation in accordance with Section 1202.4. 3114.6 Roof assemblies. Intermodal shipping container roof assemblies shall comply with the applicable requirements of Chapter 15. Exception: Single -unit stand-alone intermodal shipping containers not attached to, or stacked vertically over, other intermodal shipping containers, buildings or structures. 3114.7 Joints and voids. Joints and voids that create concealed spaces between intermodal shipping containers, that are connected or stacked, at fire -resistance -rated walls, floor or floor/ceiling assemblies and roofs or roof/ceiling assemblies shall be protected by an approved fire-resistant joint system in accordance with Section 715. 3114.8 Structural. Intermodal shipping containers that conform to ISO 1496-1 and are repurposed for use as buildings or structures, or as a part of buildings or structures, shall be designed in accordance with Chapter 16 and this section. • 19 1 0 3114.8.1 Foundations. Intermodal shipping containers repurposed for use as a permanent building or structure shall be supported on foundations or other supporting structures designed and constructed in accordance with Chapters 16 through 23. 3114.8.1.1 Anchorage. Intermodal shipping containers shall be anchored to foundations or other supporting structures as necessary to provide a continuous load path for all applicable design and environmental loads in accordance with Chapter 16. 3114.8.2 Welds. All new welds and connections shall be equal to or greater than the original connections. 3114.8.3 Openings in containers. Where openings are made in container walls, floors, and roofs for doors, windows and other similar openings: 1. The openings shall be framed with steel elements that are designed in accordance with Chapter 16 and Chapter 22. 2. The cross section and material grade of any new steel element shall be equal to or greater than the steel element removed. 3114.8.4 Detailed structural design procedure. A structural analysis meeting the requirements of this section shall be provided to the building official to demonstrate the structural adequacy of the intermodal shipping containers. Exception: Intermodal shipping containers that meet the limitation of Section 3114.8.5.1 and designed in accordance with the simplified procedure in Section 3114.8.5. 3114.8.4.1 Material properties. Structural material properties for existing intermodal shipping container steel components shall be established by material testing where the steel grade and composition cannot be identified by the manufacturer's designation as to manufacture and mill test. 3114.8.4.2 Seismic design parameters. The seismic force -resisting system shall be designed and detailed in accordance with one of the following: 1. Where all or portions of the intermodal shipping container sides are considered to be the seismic force -resisting system, design and detailing shall be in accordance with the ASCE 7 Table 12.2-1 requirements for light -frame bearing -wall systems with shear panels of all other materials, Where portions of intermodal shipping container sides are retained, but are not considered to be the seismic force -resisting system, an independent seismic force - resisting system shall be selected, designed and detailed in accordance with ASCE 7 Table 12.2-1, or 3. Where portions of the intermodal shipping container sides are retained and integrated into a seismic force -resisting system other than as permitted by Section 3114.8.4.2 Item 1, seismic design parameters shall be developed from testing and analysis in accordance with Section 104.11 and ASCE 7 Section 12.2.1.1 or 12.2.1.2. 3114.8.4.3 Allowable shear value. The allowable shear values for the intermodal shipping container side walls and end walls shall be demonstrated by testing and analysis accordance with Section 104.11. Where penetrations are made in the side walls or end walls designated as part of the lateral force -resisting system, the penetrations shall be substantiated by rational analysis. 3114.8.5 Simplified structural design procedure of single -unit containers. Single -unit intermodal shipping containers conforming to the limitations of Section 3114.8.5.1 shall be permitted to be designed in accordance with Sections 3114.8.5.2 and 3114.8.5.3. 3114.8.5.1 Limitations. Use of Section 3114.8.5 is subject to all the following limitations: 1. The intermodal shipping container shall be a single stand-alone unit supported on a foundation and shall not be in contact with or supporting any other shipping container or other structure. 2. The intermodal shipping container's top and bottom rails, corner castings, and columns or any portion thereof shall not be notched, cut, or removed in any manner. 3. The intermodal shipping container shall be erected in a level and horizontal position with the floor located at the bottom. 3114.8.5.2 Structural design. Where permitted by Section 3114.8.5.1, single -unit stand- alone intermodal shipping containers shall be designed using the following assumptions for the side walls and end walls: 1. The appropriate detailing requirements contained in Chapters 16 through 23. 2. Response modification coefficient, R = 2, 3. Over strength factor, 0, = 2.5, 4. Deflection amplification factor, Cd = 2, and 5. Limits on structural height, h„ = 9.5 feet (2900 mm). 3114.8.5.3 Allowable shear value. The allowable shear values for the intermodal shipping container side walls (longitudinal) and end walls (transverse) for wind design and seismic design using the coefficients of Section 3114.8.5.2 shall be in accordance with Table 3114.8.5.3, provided that all of the following conditions are met: 1. The total linear length of all openings in any individual side walls or end walls shall be limited to not more than 50 percent of the length of that side walls or end walls, as shown in Figure 3114.8.5.3(1). 2. Any full height wall length, or portion thereof, less than 4 feet (305 mm) long shall not be considered as a portion of the lateral force -resisting system, as shown in Figure 3114.8.5.3(2). 3. All side walls or end walls used as part of the lateral force -resisting system shall have an existing or new boundary element on all sides to form a continuous load path, or paths, with adequate strength and stiffness to transfer all forces from the point of application to the final point of resistance, as shown in Figure 3114.8.5.3(3). 4. A maximum of one penetration not greater than a 6 -inch (152 mm) diameter hole for conduits, pipes, tubes or vents, or not greater than16 square inches (10 322MM2)for electrical boxes, is permitted for each individual 8 feet length (2438 mm) lateral force resisting wall. Penetrations located in walls that are not part of the wall lateral force resisting system shall not be limited in size or quantity. This chapter shall be known as the "Downey Administrative Building and Housing Code. 8999.20.2 Scope. The provisions of this chapter shall serve as the administrative, organizational and enforcement rules and regulations for all of this title and the property maintenance guidelines in Chapter 5. Exemption for Pending Applications. This chapter shall not apply to any building or structure for which application for a plan check, construction or demolition was made prior to January 1, 2020. Such buildings or structures shall be erected, constructed, enlarged, altered or repaired in accordance with the provisions in effect at the date of said application. 8999.20.3 Intent. The purpose of this chapter is to establish the minimum requirements to safeguard the public health, safety and general welfare through structural strength, means of egress, facilities, stability, sanitation, adequate light and ventilation, energy conservation, and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to firefighters and emergency responders during emergency operations. 8999.20.4 Referenced Codes. The Codes listed in Sections 8999..20.4.1 through 8999.20.4.10 and referenced elsewhere in this section, shall be considered part of the requirements of the municipal code to the prescribed extent of each such reference. 8999.20.4.1 Building Code. The provisions of this code shall apply to the constructions, alteration, relocation, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structures or any appurtenances connected or attached to such buildings or structures. Exception: Detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories above grade plane in height, shall comply with this code or the California Residential Code. Attachment "H" 8999.20.4.2 Residential Code. Detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories above grade plane in height, shall comply with this code or the California Residential Code. Exception: the following shall be permitted to be constructed in accordance with the California Residential Code where the provided with a residential fire sprinklers system complying with California Residential Code section R313: 1. Live/work units complying with the requirements of Section 419 of the California Building Code. 2. Owner -occupied lodging houses with five or fewer guestrooms. 3. A care facility with five or fewer persons receiving custodial care within a dwelling unit. 4. A care facility for five or fewer persons receiving medical care within the dwelling unit. 5. A care facility for five or fewer persons receiving care that are within the dwelling unit. 8999.20.4.3 Electric Code. The provisions of this code shall apply to the constructions, alteration, relocation, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structures or any appurtenances connected or attached to such buildings or structures. 8999.20.4.1 Gas. The provisions of the California Mechanical Code, California Code of Regulations, Title 24, Part 4 and/or the California Plumbing Code, California Code of Regulations, Title 24, Part 5 shall apply to the installation of gas piping from the point of delivery, gas appliances and related accessories as covered in this code. These requirements apply to gas piping systems extending from the point of delivery to the inlet connections of appliances and the installation and operation of residential and commercial gas appliances and related accessories. 8999.20.4.2 Mechanical. The provisions of the California Mechanical Code, California Code of Regulations, Title 24, Part 4 shall apply to the installation, alterations, repairs and replacement of mechanical systems, including equipment, appliances, fixtures, fittings and/or appurtenances, including ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other energy-related systems. 8999.20.4.3 Plumbing. The provisions of the California Plumbing Code, California Code of Regulations, Title 24, Part 5 shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The provisions of the International Private Sewage Disposal Code shall apply to private sewage disposal systems. 8999.20.4.4 Fire Prevention. The provisions of the California Fire Code, California Code of Regulations, Title 24, Part 9 as amended by Downey Municipal Article III Chapter 3 shall apply to matters affecting or relating to structures, processes and premises from the hazard of fire and explosion arising from the storage, handling or use of structures, materials or devices; from conditions hazardous to life, property or public welfare in the occupancy of structures or premises; and from the construction, extension, repair, alteration or removal of fire suppression and alarm systems or fire hazards in the structure or on the premises from occupancy or operation. 8999.20.4.5 Energy. The provisions of the California Energy Code, California Code of Regulations, Title 24, Part 6 shall apply to all matters governing the design and construction of buildings for energy efficiency. i i 0 1 ! Melm 8999.20.4.6 Historical. The provisions of the California Historical Building Code, California Code of Regulations, Title 24, Part 8 shall apply to the preservation, restoration, rehabilitation, relocation or reconstruction of buildings or properties designated as qualified historical buildings or properties (Chapter 8-2 of CNBC). The intent of the CHBC is to facilitate the preservation and continuing use of qualified historical buildings occupants and access for persons with disabilities. 8999.20.4.7 Existing Buildings. California Existing Building Code, California Code of Regulations, Title 24, Part 10, as amended by this code, shall apply to the repair, alteration, change of occupancy, addition to and relocation of existing buildings. 8999.20.4.8 Green Building. California Green Building Standards Code, California Code of Regulations, Title 24, Part 11, as amended by this code, shall apply to the planning, design, operation, construction, use, and occupancy of every newly constructed building or structure, unless otherwise indicated in this code, throughout the State of California. It is not the intent that this code substitute or be identified as meeting the certification requirements of any green building program. 8101.4.9 Referenced Standards. California Referenced Standards Code, California Code of Regulations, Title 24, Part 12 shall apply to recognized standards for various methods of construction, testing of materials and installations of materials and systems. 8999.22.1 General. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall apply. Where, in any specific case, different sections of this code specify different materials, methods of construction or other requirements, the most restrictive shall govern. 8999.22.2 Other Laws. The provisions of this chapter shall not be deemed to nullify any provisions of local, State or federal law. 8999.22.3 Application of References. References to chapter or section numbers, or to provisions not specifically identified by number, shall be construed to refer to such chapter, section or provision of this chapter. 8999.22.4 Referenced Codes and Standards. The codes and standards referenced in the codes shall be considered part of the requirements listed in section 8999.22.4 to the prescribed extent of each such reference and to further regulated in sections 8999.22.4.1 through 8999.22.4.4. 8999.22.4.1 Conflicts. Where conflicts occur between provisions listed in section 8999.21.4 and referenced codes or standards, the provisions of the code shall apply. 8999.22.4.2 Provisions in referenced codes and standards. Where the extent of the referenced to a referenced code or standard includes subject matter that is within the scope listed in section 8999.21.4, the provisions of section 8999.21.4, as applicable, shall take precedence over the provisions of the referenced code or standard. 8999.22.5 Partial Invalidity. If any part or provision of section 8999.21.4 is held to be illegal or void, this shall not have the effect of making void or illegal any of the other parts or provisions. 8999.22.6 Existing Structures. The legal occupancy of any structure existing on the date of adoption of the ordinance codified in this chapter shall be permitted to continue without change, except as is specifically covered in section 8999.22.4. *'I 1 0 1 2-11elM, 8999.22.6.1 Building not previously occupied. A building of portion of a building that has not been previously occupied or used for its intended purpose in accordance with the laws in existence at the time of its completions shall comply with the provisions of the California Building Code or California Residential Code, as applicable, for new construction or with any current permit for occupancy. 8999.22.6.2 Building previously Occupied. The legal occupancy of any building existing on the date of adoption of this code shall be permitted to continue without change, except as otherwise specifically provided on this code, the California Fire Code or California Existing Building Code, or as is deemed necessary by the building official for general safety and welfare of the occupants and the public. 8999.22.6.3 Additions, alterations or repairs. Additions, alterations or repairs to any structure shall conform to the requirements for a new structure without requiring the existing structure to comply with the requirements of this code, Additions, alterations, repairs and relocations shall not cause an existing structure to become unsafe or adversely affect the performance of the building. 8999.24 Division of Building and Safety. 8999.24.1 Creation of Enforcement Agency. The Division of Building Safety is hereby created and the official in charge thereof shall be known as the Building Official. 8999.24.2 Appointment. The building official shall be appointed by the chief appointing authority of the jurisdiction. 8999.24.3 Deputies, In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the Building Official shall have the authority to appoint a Deputy Building Official, related technical officers, inspectors, plan examiners and other employees. Such employees shall have powers as delegated by the Building Official. For the maintenance of existing properties, see the California Existing Building Code. 8999.26 Duties and Powers of Building Official. 8999.26.1 General. The Building Official is hereby authorized and directed to enforce the provisions listed in section 8999.20.4. The Building Official shall have the authority to render interpretations of the codes and to adopt policies and procedures in order to clarify the application of its provisions. Such interpretations, policies and procedures shall be in compliance with the intent and purpose listed in section 8999.20.4. Such policies and procedures shall not have the effect of waiving requirements specifically listed in section 8999.20.4. 8999.26.2 Applications and Permits. The Building Official shall receive applications, review construction documents and issue permits for the erection, alteration, and demolition and moving of buildings and structures, inspect the premises for which such permits have been issued and enforce compliance with the provisions of the codes. 8999.26.2.1 Determination of substantially improved of substantially damaged existing buildings and structures in flood hazard areas. For applications for reconstruction, rehabilitation, repair, alteration, addition or other improvement of existing buildings or structures located in flood hazard areas, the building official shall determine if the proposed work constitutes substantial improvement or repair of substantial damage. Where the building official determines that the proposed work constitutes substantial improvements • i 1 1 0 listed in section 8999.20.4, the building official shall require the building to meet the requirements of California Building Code section 1612 and California Residential Code section R322. 8999.26.3 Notices and Orders. The Building Official shall issue all necessary notices or orders to ensure compliance with the codes. 8999.26.4 Inspections. The Building Official shall make all of the required inspections, or the Building Official shall have the authority to accept reports of inspection by approved agencies or individuals. Reports of such inspections shall be in writing and be certified by a responsible officer of such approved agency or by the responsible individual. The Building Official is authorized to engage such expert opinion as deemed necessary to report upon unusual technical issues that arise, subject to the approval of the appointing authority. 8999.26.5 Identification. The Building Official shall carry proper identification when inspecting structures or premises in the performance of duties under the California Codes listed in section 8999.20.4. 8999.26.6 Right of Entry. Where it is necessary to make an inspection to enforce the provisions of the California Codes listed in section 8101.4, or where the Building Official has reasonable cause to believe that there exists in a structure or upon a premises a condition which is contrary to or in violation of the codes which makes the structure or premises unsafe, dangerous or hazardous, the Building Official is authorized to enter the structure or premises at reasonable times to inspect or to perform the duties imposed by the codes; provided, that if such structure or premises be occupied that credentials be presented to the occupant and entry requested. If such structure or premises is unoccupied, the Building Official shall first make a reasonable effort to locate the owner or other person having charge or control of the structure or premises and request entry. If entry is refused, the Building Official shall have recourse to the remedies provided by law to secure entry. 8999.26.7 Department Records. The Building Official shall keep official records of applications received, permits and certificates issued, fees collected, reports of inspections, and notices and orders issued. Such records shall be retained in the official records for the period required for retention of public records. 8999.26.8 Liability. The Building Official, member of the Board of Appeals or employee charged with the enforcement of the codes, while acting for the jurisdiction in good faith and without malice in the discharge of the duties required by the California Codes listed in section 8999.26.4 or other pertinent law or ordinance, shall not thereby be civilly or criminally rendered liable personally and is hereby relieved from personal liability for any damage accruing to persons or property as a result of any act or by reason of an act or omission in the discharge of official duties. 8999.26.8.1 Legal defense. Any suit or criminal complaint instituted against an officer or employee because of an act performed by that officer or employee in the lawful discharge of duties and under the provisions of the California Codes listed in section 8101.4 shall be defended by legal representative of the City until the final termination of the proceedings. The Building Official or any subordinate shall not be liable for cost in any action, suit or proceeding that is instituted in pursuance of the provisions of the codes. 8999.26.9 Approved Materials and Equipment. Materials, equipment and devices approved by the Building Official shall be constructed and installed in accordance with such approval. 8999.26.9.1 Used Materials and Equipment. Materials that are used shall meet the requirements of California Codes listed in section 8999.26.4 for new materials. Used equipment and devices shall not be reused unless approved by the Building Official. 8999.26.10 Modifications. Wherever there are practical difficulties involved in carrying out the provisions of the California Codes listed in section 8999.26.4, the Building Official shall have the authority to grant modifications for individual cases, upon application of the owner or owner's representative, provided the Building Official shall first find that special individual reason makes the strict letter of this code impractical and the modification is in compliance with the intent and purpose of the codes and that such modification does not lessen health, accessibility, life and fire safety, or structural requirements. The details of action granting modifications shall be recorded and entered in the files of the department of building safety. 8999.26.10.1 Flood hazard areas. The building official shall not grant modifications to any provision required in flood hazard areas as established by California Building Code section 1612.3 or California Residential Code section R302.2(1) unless a determination has been made that: 1. A showing of good and sufficient cause that the unique characteristics of the size, configuration or topography of the site render the elevation standards of California Building Code section 1612 or California Residential Code section R322inappropriate. 2. A determination that failure to grant the variance would result in exceptional hardship by rendering the lot undevelopable. 3. A determination that the granting of a variance will not result in increased flood heights, additional threats to public safety, extraordinary public expense, cause fraud on or victimization of the public, or conflict existing laws or ordinances. 4. A determination that the variance is the minimum necessary to afford relief, considering the flood hazard. 5. Submission to the applicant of written notice specifying the difference between the design flood elevation and elevation to which the building is to be commensurate with the increased risk result from the reduced floor elevation, and stating that construction below the design flood elevation increases risks to life and property. 8999.26.11 Alternative Materials, Design and Methods of Construction and Equipment. The provisions of the codes are not intended to prevent the installation of any material or to prohibit any design or method of construction not specifically prescribed by this code; provided, that any such alternative has been approved. An alternative material, design or method of construction shall be approved where the Building Official finds that the proposed design is satisfactory and complies with the intent of the provisions of the codes, and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in the codes in quality, strength, effectiveness, fire resistance, durability and safety. 8999.26.11.1 Research Reports. Supporting data, where necessary to assist in the approval of materials or assemblies not specifically provided for in the codes, shall consist of valid research reports from approved sources. 8999.26.11.2 Tests. Whenever there is insufficient evidence of compliance with the provisions of the codes, or evidence that a material or method does not conform to the • i I 1 0, requirements of this code, or in order to substantiate claims for alternative materials or methods, the Building Official shall have the authority to require tests as evidence of compliance to be made at no expense to the City. Test methods shall be as specified in the codes or by other recognized test standards. In the absence of recognized and accepted test methods, the Building Official shall approve the testing procedures. Tests shall be performed by an approved agency. Reports of such tests shall be retained by the Building Official for the period required for retention of public records. 8999.28 Permits. 8999.28.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the codes, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit. 8999.28.2 Work Exempt from Permit. Exemptions from permit requirements of the codes shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building: 1. One (1) story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed one hundred twenty (120) square feet (eleven (11) m2). 2. Walls/Fences not over forty-two (42") inches (one thousand and sixty-seven (1067) mm) high measured from the top wall/fence to highest finished grade. 3. Oil derricks. 4. Retaining walls that are not over four (4') feet (one thousand two hundred nineteen (1,219) mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or IIIA liquids. 5. Water tanks supported directly on grade if the capacity does not exceed five thousand (5,000) gallons (eighteen thousand nine hundred twenty-five (18,925) L) and the ratio of height to diameter or width does not exceed two (2) to one (1). 6. New or replace sidewalks, platform, decks and driveways less than eight hundred (800) square feet and does not disturb additional area and maintains the original line and grade, hydraulic capacity and original purpose of facility. 7. Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work. 8. Temporary motion picture, television and theater stage sets and scenery. 9. Prefabricated swimming pools accessory to a Group R-3 occupancy or a one (1) or two (2) family dwelling, that are less than twenty-four (24") inches (six hundred ten (610) mm) deep, do not exceed five thousand (5,000) gallons (eighteen thousand nine hundred twenty-five (18,925) L) and are installed entirely above ground. 10. Shade cloth structures constructed for nursery or agricultural purposes, not including service systems. 11. Swings, other playground equipment and tree houses accessory to detached one (1) and two (2) family dwellings. 12. Window awnings supported by an exterior wall that do not project more than fifty-four (54") inches (one thousand three hundred seventy-two (1,372) mm) from the exterior wall and do not require additional support of Group R-3 occupancies, a one (1) or two (2) family dwelling, and Group U occupancies. 13. Replacement, repair or overlay of one hundred (100) square feet or less of an existing roof covering within any twelve (12) month period on the same building. 14. Nonfixed and movable fixtures, cases, racks, counters and partitions five feet nine inches (69") or less (one thousand seven hundred fifty-three (1,753) mm) in height. Electrical: 1. Listed cord -and -plug connected temporary decorative lighting. 2. Reinstallations of attachment plug receptacles but not the outlets therefor. 3. Replacement of branch circuit over current devices of the required capacity in the same location. 4. Electrical wiring, devices, appliances, apparatus or equipment operating at less than twenty-five (25) volts and not capable of supplying more than fifty (50) watts of energy. 5. Minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles. 6. Installation or maintenance of communications wiring, devices, appliances, apparatus or equipment. 7. A permit shall not be required for the installation of any temporary system required for the testing or servicing of electrical equipment or apparatus. 8. Installations of railways for generation, transformation, transmission, energy storage, or distribution of power used exclusively for signaling and communications purpose. 9. Installations of communications equipment under the exclusive control of communications utilities located outdoors or in building spaces used exclusively for such installation. 10. Installation under the exclusive control of an electric utility here such installations a. Consist of service drops or service laterals and associated metering, or b. Are on property owned or leased by electric utility for the propose of communications, metering, generation, transformation, transmission, energy storage, or distribution of electric energy, or c. Are located in legally established easements or rights -of -ways, or d. Are located by other written agreement either designated by or recognized by public service commissions, utility commissions, or other regulatory agencies having jurisdiction for such installations. Theses written agreements shall be limited to installations for the purpose of communications, metering, generation, transformation, transmission, energy storage, or distribution of electric energy where legally established easements or right-of-ways cannot be obtained. Gas: 1. Portable heating, cooking or clothes drying appliances. 2. Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe. 3. Portable -fuel -cell appliances that are not connected to a fixed piping system and are not interconnected to a power grid. Mechanical: 1. Portable heating appliance, portable ventilation equipment, portable cooling unit, or portable evaporative cooler. 2. A closed system of steam, hot or chilled water piping within any heating or cooling equipment regulated by California Mechanical Code. 3 Replacement of any component part that does not alter its original and is in accordance with other applicable requirements of California Mechanical Code. 4. Replacement equipment that is part of the equipment for which a permit has been issued pursuant to the requirements of the California Mechanical Code. 5. A unit refrigerating system. Plumbing. 1. The stopping of leaks in drains, water, soil, waste or vent pipe; provided, however, that if any concealed trap, drain pipe, water, soil, waste or vent pipe becomes defective and it becomes necessary to remove and replace the same with the new material, such work shall be considered as new work and a permit shall be obtained and inspection made as provided in this code. 2. The clearing of stoppages or the repairing of leaks in pipes, valves or fixtures and the removal and reinstallation of water closets, provided such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures. 8999.28.2.1 Emergency Repairs. Where equipment replacements and repairs must be performed in an emergency situation, the permit application shall be submitted within the next working business day to the Building Official. 8999.28.2.2 Public Service Agencies. A permit shall not be required for the installation, alteration or repair of generation, transmission, distribution or metering or other related equipment that is under the ownership and control of public service agencies by established right. 8999.28.3 Application for Permit. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Department of Building Safety for that purpose. Such application shall: 1. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work. 3. Indicate the use and occupancy for which the proposed work is intended. 4. Be accompanied by construction documents and other information as required in Section 8999.32. 5. State the valuation of the proposed work. 6. Be signed by the applicant, or the applicant's authorized agent. ORDINANCE NO PAGE 10 7. Give such other data and information as required by the Building Official 8999.28.3.1 Action on Application. The Building Official shall examine or cause to be examined applications for permits and amendments thereto within a reasonable time after filing. If the application or the construction documents do not conform to the requirements of pertinent laws, the Building Official shall reject such application in writing, stating the reasons therefor. If the Building Official is satisfied that the proposed work conforms to the requirements of the codes, laws and ordinances applicable thereto, the Building Official shall issue a permit therefor as soon as practicable. 8999.28.3.2 Time Limitation of Application. An application for a permit for any proposed work shall be deemed to have been abandoned one hundred and eighty (180) days after the date of filing, unless such application has been pursed in good faith or a permit has been issued: except the Building Official is authorized to grant one (1) extension of time for additional periods not exceeding one hundred eighty (180) days each. The extension shall be requested in writing and justifiable cause demonstrated. An application shall not be extended if this chapter or any other pertinent laws or ordinances have been amended subsequent to the date of application. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. 8999.28.4 Application for demolition. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Department of Building Safety for that purpose. Such application shall: 1. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work. 3. Indicate the use and occupancy for the structure on the site or parcel. 4. The site plan shall show construction to be demolished and the location and size of existing structures and construction that are to remain on the site or parcel. 6. State the valuation of the proposed work. 7. Be signed by the applicant, or the applicant's authorized agent. 8. Give such other data and information as required by the Building Official. 9. The dates upon which demolition will begin, and the length of time the demolition activity will occur. 10. A cash/surety bond or depositor's cash book assignment, in a manner approved by the City Attorney, in amount equal to the estimated costs, plus ten percent (10%) of the work required to be done or other amount as determined by the Building Official. Such costs shall be as estimated by the Building Official. Exception: The building may waive the requirements of a cash/surety bond or depositor's cash book assignment at his/her discretion when the demolition is included in the permit for a new structure on the same site parcel. 011 1 0 MUCIMS If permittee, who has posted a cash/surety bond or depositor's cash book assignment, fails to strictly comply with any notice of default or if the city causes the abatement of an imminent hazard the Building Official shall proceed without delay, and without further notice or proceeding (except as otherwise required by law) to cause the required work to be done by contract or otherwise in his/her discretion, with all costs to be assessed against the permittee. The balance, if any, of such depositor's cash book assignment upon the completion of the work shall be returned to the depositor or to his/her successors or assigns after the deduction the cost of the work plus ten percent (10%0 thereof. If a cash/surety bond or depositor's cash book assignment has been posted, the Building Official shall return the cash/surety or release the cash book assignment to the depositor or the his/her successors or assigns upon the termination of the bond, except any portion thereof that may have been used or deducted as elsewhere provided in this chapter. 8999.28.4.1 Action on Application. The Building Official shall examine or cause to be examined applications for permits and amendments thereto within a reasonable time after filing. If the application or the construction documents do not conform to the requirements of pertinent laws, the Building Official shall reject such application in writing, stating the reasons therefor. If the Building Official is satisfied that the proposed work conforms to the requirements of the codes, laws and ordinances applicable thereto, the Building Official shall issue a permit therefor as soon as practicable. 8999.28.4.2 Time Limitation of Application. An application for a permit for any proposed work shall be deemed to have been abandoned one hundred and eighty (180) days after the date of filing, unless such application has been pursed in good faith or a permit has been issued: except the Building Official is authorized to grant one (1) extension of time for additional periods not exceeding one hundred eighty (180) days each. The extension shall be requested in writing and justifiable cause demonstrated. An application shall not be extended if this chapter or any other pertinent laws or ordinances have been amended subsequent to the date of application. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. 8999.28.5 Validity of Permit. The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code or of any other ordinance of the City. Permits presuming to give authority to violate or cancel the provisions of this code or other ordinances of the City shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the Building Official from requiring the correction of errors in the construction documents and other data. The Building Official is also authorized to prevent occupancy or use of a structure where in violation of this code or of any other ordinances of the City. 8999.28.6 Expiration. Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within twelve (12) months after its issuance, or if the work authorized on the site by such permit is abandoned for a period of one hundred eighty (180) days after the time the work is commenced. The Building Official is authorized to grant, in writing, up to one (1) extensions of time for action by the permittee for a period not exceeding one hundred eighty (180) days each time upon payment of appropriate fees and a written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. UTM�11 *01 Time limitation for permit as the result of code enforcement action shall expire by limitation and become null -and -void sixty (60) days after the date on which the permit is issued. The Building Official is authorized to grant, in writing, up to one (1) extensions of time for action by the permittee for a period not exceeding one hundred eighty (180) days each time upon payment of appropriate fees and a written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. 8999.28.7 Suspension or Revocation. The Building Official is authorized to suspend or revoke a permit issued under the provisions of the codes wherever the permit is issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions listed in section 8101.4. 8999.28.8 Placement of Permit. The building permit or copy shall be kept on the site of the work until the completion of the project. 8106.1 Live Loads Posted. Where the live loads for which each floor or portion thereof of a commercial or industrial building are or have been designed to exceed fifty (50) psf (two and four -tenths (2.40) kN/m2), such design live loads shall be conspicuously posted by the owner in that part of each story in which they apply, using durable signs. It shall be unlawful to remove or deface such notices, 8106.2 Issuance of Certificate of Occupancy. A certificate of occupancy required by section 8111 shall not be issued until the floor load signs, required by section 8106. 1, have been installed. 8106.3 Restrictions on Loading. It shall be unlawful to place, or cause or permit to be placed, on any floor or roof of a building, structure or portion thereof a load greater than is permitted by this code. 8999.32.1 General. Submittal documents consisting of construction documents, statements of special inspections, geotechnical report and other data shall be submitted in two (2) or more sets with each permit application. The construction documents shall be prepared by a registered design professional unless exempted by Section 5537 of the Business and Professions Code. Where special conditions exist, the Building Official is authorized to require additional construction documents to be prepared by a registered design professional. Exception: The Building Official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of construction documents is not necessary to obtain compliance with this code. 8999.32.2 Construction Documents. Construction documents shall be in accordance with Sections 8999.32.2.1 through 8999.32.2.8. 8999.32.2.1 Information on Construction Documents. Construction documents shall be dimensioned and drawn upon suitable material. Electronic media documents are permitted to be submitted when approved by the Building Official. Construction documents shall be of •.1 1 0 sufficient clarity to indicate the location, nature and extent of the work proposed and show in detail that it will conform to the provisions of this code and relevant laws, ordinances, rules and regulations, as determined by the Building Official. 8999.32.2.2 Fire Protection System Shop Drawings. Shop drawings for the fire protection system(s) shall be submitted to Fire Department indicate conformance to this California Building Code, California Fire Code and the construction documents and shall be approved prior to the start of system installation. Shop drawings shall contain all information as required by the referenced installation standards in California Building Code and California Fire Code. 8999.32.2.3 Means of Egress. The construction documents shall show in sufficient detail the location, construction, size and character of all portions of the means of egress in compliance with the provisions of this code. In other than occupancies in Groups R-2, R-3, and 1-1, the construction documents shall designate the number of occupants to be accommodated on every floor, and in all rooms and spaces. 8999.32.2.4 Exterior Wall Envelope. Construction documents for all buildings shall describe the exterior wall envelope in sufficient detail to determine compliance with this code. The construction documents shall provide details of the exterior wall envelope as required, including flashing, intersections with dissimilar materials, corners, end details, control joints, intersections at roof, eaves or parapets, means of drainage, water -resistive membrane and details around openings. The construction documents shall include manufacturer's installation instructions that provide supporting documentation that the proposed penetration and opening details described in the construction documents maintain the weather resistance of the exterior wall envelope. The supporting documentation shall fully describe the exterior wall system which was tested, where applicable, as well as the test procedure used. 8999.32.2.5 Exterior Balconies and elevated walking surfaces. Where balconies and elevated walking surfaces are exposed to water from direct or blowing rain or irrigation, and the structural framing is protected by an impervious moisture barrier, the contraction documents shall include details for all elements of the impervious moisture barrier system. The construction documents shall include the manufacturer's installation instructions. 8999.32.2.6 Site Plan. The construction documents submitted with the application for permit shall be accompanied by a site plan showing to scale the size and location of new construction and existing structures on the site, distances from lot lines, the established street grades and the proposed finished grades and, as applicable, flood hazard areas, floodways, and design flood elevations; and it shall be drawn in accordance with an accurate boundary line survey. The Building Official is authorized to waive or modify the requirement for a site plan when the application for permit is for alteration or repair or when otherwise warranted. 8999.32.2.6.1 Design flood elevations. Where design flood elevations are not specified, they shall be established in accordance with California Building Code section 1612.3.1 or California Residential Code R301.2(1) and R322. 8999.32.2.7 Structural Information. The construction documents shall provide the information specified in California Building Code Section 1603 or for buildings and structures utilizing braced wall design, and where required by the building official, braced wall lines 0`r 0, shall be identified on the construction documents. Pertinent information including, but not limited to, bracing methods, location and length of braced wall panels and foundation requirements of braced wall panels at top bottom shall be provided. 8999.32.2.8 Relocatable buildings. Construction documents for relocatable buildings shall comply with California Building Code section 3112. 8999.32.3 Examination of Documents. The Building Official shall examine or cause to be examined the accompanying submittal documents and shall ascertain by such examinations whether the construction indicated and described is in accordance with the requirements of the codes and other pertinent laws or ordinances. 8999.32.3.1 Approval of Construction Documents. When the Building Official issues a permit, the construction documents shall be approved, in writing or by stamp, as "Approved or Reviewed for Code Compliance." One (1) set of construction documents so reviewed shall be retained by the Building Official. The other set shall be returned to the applicant, shall be kept at the site of work and shall be open to inspection by the Building Official or a duly authorized representative. 8999.32.3.2 Previous Approvals. The Codes listed in Sections 8999.20.4.1 through 8999.20.4.10 shall not require changes in the construction documents, construction or designated occupancy of a structure for which a lawful permit has been heretofore issued or otherwise lawfully authorized, and the construction of which complies with the codes and ordinances adopted by the jurisdiction at the time the permit was issued and has been pursued in good faith within one hundred eighty (180) days after the effective date of this code and has not been abandoned. 8999.32.3.3 Phased Approval. The Building Official is authorized to issue a permit for the construction of foundations or any other part of a building or structure before the construction documents for the whole building or structure have been submitted; provided, that adequate information and detailed statements have been filed complying with pertinent requirements of the Codes listed in Sections 8999.32.4.1 through 8999.32.4.10. The holder of such permit for the foundation or other parts of a building or structure shall proceed at the holder's own risk with the building operation and without assurance that a permit for the entire structure will be granted. All proposed phased projects shall be subject to additional examination, approval and inspection fees. 8999.32.3.4 Design Professional in Responsible Charge. When it is required that documents be prepared by a registered design professional, the Building Official shall be authorized to require the owner or the owner's authorized agent to engage and designate on the building permit application a registered design professional who shall act as the registered design professional in responsible charge. If the circumstances require, the owner or the owner's authorized agent shall designate a substitute registered design professional in charge who shall perform duties required of the original registered design professional in charge. The Building Official shall be notified in writing by the owner or the owner's authorized agent if the registered design professional in responsible charge is changed or is unable to continue to perform the duties. The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building. 8999.32.3.4.1 Deferred Submittals. For the purposes of this section, "deferred submittals" are defined as those portions of the design that are not submitted at the time of the application and that are to be submitted to the Building Official within a specified period. Deferral of any submittal items shall have the prior approval of the Building Official. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the Building Official. Documents for deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them and forward them to the Building Official with a notation indicating that the deferred submittal documents have been reviewed and been found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal documents have been approved by the Building Official. 8999.32.4 Amended Construction Documents. Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents. The amended construction documents shall be submitted, reviewed and approved and fees paid before scheduling inspection of that portion of the amended work. 8999.32.5 Retention of Construction Documents. One (1) set of approved construction documents shall be retained by the Building Official for a period of not less than one hundred eighty (180) days from date of completion of the permitted work, or as required by State or local laws. 8999.34 Temporary Structures and Uses.8108.1 General. The Building Official is authorized to issue a permit for temporary structures and temporary uses. Such permits shall be limited as to time of service, but shall not be permitted for more than one hundred eighty (180) days. The Building Official is authorized to grant extensions for demonstrated cause. 8999.34.2 Conformance. Temporary structures and uses shall conform to the structural strength, fire safety, means of egress, accessibility, light, ventilation and sanitary requirements of the codes as necessary to ensure public health, safety and general welfare, and shall comply with the requirements of California Building Code Section 3103. 8999.34.3 Temporary Power. The Building Official is authorized to give permission to temporarily supply and use power in part of an electric installation before such installation has been fully completed and the final certificate of completion has been issued, The Building Official is authorized to terminate such use of temporary power when found to be noncompliant with codes, ordinances and regulations of the jurisdiction or is found to be unsafe, The Building Official shall issue a notice of noncompliance to the utility provider and when possible to the owner or owner's authorized representative and the building occupant, when termination of temporary power is necessary. The part covered by the temporary certificate shall comply with the requirements specified for temporary lighting, heat or power in California Electric Code. 8999.34.4 Termination of Approval. The Building Official is authorized to terminate such permit for a temporary structure or use and to order the temporary structure or use to be discontinued. 8999.36 Fees. 8999.36.1 Payment of Fees. A permit shall not be valid until the fees prescribed as set forth in the City of Downey Schedule of Fees have been paid, nor shall an amendment to a permit be released until the additional fee, if any, has been paid. 8999.36.2 Schedule of Fees. On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the Schedule of Fees established by resolution of the City Council. 8999.36.3 Building Permit Valuation. The applicant for a permit shall provide an estimated permit value at time of application. Permit valuations shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems. If, in the opinion of the Building Official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the Building Official. Final building permit valuation shall be set by the Building Official. 8999.36.4 Work Commencing Before Permit Issuance. Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to an investigation fee to be made before any permit may be issued for such work. An investigation fee in addition to the permit fee shall be collected whether or not a permit is then or subsequently issued for the illegal work. The investigation fee shall be equal to the amount of a permit fee required by this chapter for the commenced or completed work as set forth in the City adopted fee schedule. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this title or Downey Municipal Article VIII Chapter 5-33, nor from any penalty prescribed by law. 8999.36.5 Related Fees. The payment of the fee for the construction, alteration, removal or demolition for work done in connection to or concurrently with the work authorized by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that are prescribed by law. 8999.36.6 Refunds. 8999.36.6.1 The Building Official may authorize the refunding of any fee paid hereunder which was erroneously paid or collected. 8999.36.6.2 The Building Official may authorize the refunding of not more than eighty (80%) percent of the permit fee paid when no work has been done under a permit issued in accordance with this title. The Building Official may authorize the refunding of not more than eighty (80%) percent of the plan review fee paid when an application is withdrawn or canceled before any plan reviewing has been started. 8999.36.6.3 The Building Official shall not authorize the refunding of any fee paid except upon written application filed by the original permittee not later than one hundred eighty (180) days after the date of fee payment. 8999.38 Inspections. 8999.38.1 General. Construction or work for which a permit is required shall be subject to inspection by the Building Official and such construction or work shall visible and remain accessed for inspection purposes until approved. Approval as a result of an inspection shall not WD I be construed to be an approval of a violation of the provisions of the Codes listed in Sections 8999.20.4.1 through 8999.20.4. 10 or of other ordinances of the jurisdiction. Inspections presuming to give authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid. It shall be the duty of the owner or the owner's authorized agent to cause the work to remain visible and able to be accessed for inspection purposes. Neither the Building Official nor the City shall be liable for expense entailed in the removal or replacement of any material required to allow inspection. 8999 .38.2 Preliminary Inspection. Before issuing a permit, the Building Official is authorized to examine or cause to be examined buildings, structures and sites for which an application has been filed. 8999.38.3 Required Inspections. The Building Official, upon notification, shall make the inspections set forth in Sections 8999.38.3.1 through 8999.38.3.12. 8999.38.3.1 Footing and Foundation Inspection. Footing and foundation inspections shall be made after excavations for footings are complete and any required reinforcing steel is in place. For concrete foundations, any required forms shall be in place prior to inspection. Materials for the foundation shall be on the job, except where concrete is ready mixed in accordance with ASTM C 94, the concrete need not be on the job. 8999.38.3.2 Concrete Slab and Under -Floor Inspection. Concrete slab and under -floor inspections shall be made after in -slab or under -floor reinforcing steel and building service equipment, conduit, piping accessories and other ancillary equipment items are in place, but before any concrete is placed or floor sheathing installed, including the subfloor. 8999.38.3.3 Lowest Floor Elevation. In flood hazard areas, upon placement of the lowest floor, including the basement, and prior to further vertical construction, the elevation certification required in California Building Code Section 1612.5 or California Residential Code Section R322 shall be submitted to the Building Official. 8999.38.3.4 Frame Inspection. Framing inspections shall be made after the roof deck or sheathing, all framing, fireblocking and bracing are in place and pipes, chimneys and vents to be concealed are complete and the rough electrical, plumbing, heating wires, pipes and ducts are approved. 8999.38.3.5 Plumbing, mechanical, gas and electrical systems inspections. Rough inspections of Plumbing, mechanical, gas and electrical systems shall be made prior to covering or concealment, before fixtures or appliances are set to be installed, and prior to inspection. 8999.38.3.6 Lath, Gypsum Board and Gypsum Panel Product Inspection. Lath, gypsum board and gypsum panel product inspections shall be made after lathing, gypsum board and gypsum panel products, interior and exterior, are in place, but before any plastering is applied or gypsum board and gypsum panel product joints and fasteners are taped and finished. 8999.38.3.7 Weather -exposed balcony and walking surface waterproofing. Where balconies or other elevated walking surfaces are exposed to water from direct or blowing rain or irrigation, and structural framing is protected by an impervious moisture barrier, all elements of the impervious moisture barrier system shall not be concealed until inspected and approved. • i 0 1 0 8999.38.3.8 Fire- and Smoke -Resistant Penetrations. Protection of joints and penetrations in fire -resistance -rated assemblies, smoke barriers and smoke partitions shall not be concealed from view until inspected and approved. 8999.38.3.9 Energy Efficiency Inspections. Inspections shall be made to determine compliance with California Energy Code and shall include, but not be limited to, inspections for: envelope insulation R- and U -values, fenestration U -value, duct system R -value, and HVAC and water -heating equipment efficiency. 8999.38.3.10 Other Inspections. In addition to the inspections specified above, the Building Official is authorized to make or require other inspections of any construction work to ascertain compliance with the provisions of the Codes listed in Sections 8999.20.4.1 through 899.20.4.12 and other laws that are enforced by the Department of Building Safety. 8999.38.3.11 Special Inspections. For special inspections, see California Building Code Chapter 17. 8999.38.3.12 Final Inspection. The final inspection shall be made after all work required by the building permit is completed. 8999.38.3.12.1 Flood hazard documentation. If located in a flood hazard area, documentation of the elevation of the lowest floor as required in California Building Code section 1612.4 or California Residential Code Section R322 shall be submitted to the building official prior to final inspection. 8999.38.4 Reinspection. A reinspection fee prescribed as below may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not complete or when corrections called for are not made. 8999.38.4.1 This section is not to be interpreted as requiring reinspection fees the first time a job is rejected for failure to comply with the requirements of this title but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. 8999.38.4.2 Reinspection fees may be assessed when the inspection record card is not otherwise available on the work site; the approved plans are not readily available to the inspector, for failure to provide access on the date for which inspection is requested, or for deviating from plans requiring the approval of the Building Official. 8999.38.4.3 To obtain a reinspection, the applicant shall pay the reinspection fee in accordance with the City of Downey Schedule of Fees. 8999.38.4.4 In instances where reinspection fees have been assessed, additional inspection of the work will not be performed until the required fees have been paid. 8999.38.5 Inspection Agencies. The Building Official is authorized to accept reports of approved inspection agencies, provided such agencies satisfy the requirements as to qualifications and reliability. 8999.38.6 Inspection Requests. It shall be the duty of the holder of the building permit or their duly authorized agent to notify the Building Official at least one (1) working day before such inspection is desired and work is ready for inspection. It shall be the duty of the permit holder or i10 . their duly authorized agent to provide access to and means for inspections of such work that are required by this code. The Building Official may require that every request for inspection be filed in writing, by telephone or by building division web site at the option of the Building Official. 8999.38.7 Approval Required. Work shall not be done beyond the point indicated in each successive inspection without first obtaining the approval of the Building Official. The Building Official, upon notification, shall make the requested inspections and shall either indicate the portion of the construction that is satisfactory as completed, or notify the permit holder or his or her agent wherein the same fails to comply with this code. Any portions that do not comply shall be corrected and such portion shall not be covered or concealed until authorized by the Building Official. 8999.40 Certificate of Occupancy. 8999.40.1 Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing use or occupancy classification of a building or structure or portion thereof shall be made, until the Building Official has issued a certificate of occupancy therefor as provided herein. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Exception: (1) Certificates of occupancy are not required for work exempt from permits under Section 8105.2. (2) Accessory buildings and structures classified as U occupancy. (3) All R-3 occupancies. 8999.40.2 Certificate Issued. After the Building Official inspects the building or structure and finds no violations of the provisions of this code or other laws that are enforced by the Department of Building Safety, the Building Official shall issue a certificate of occupancy that contains the following: 8999.40.2.1 The building permit number. 8999.40.2.2 The address of the structure. 8999.40.2.3 The name and address of the owner. 8999.40.2.4 A description of that portion of the structure for which the certificate is issued. 8999.40.2.5 A statement that the described portion of the structure has been inspected for compliance with the requirements of this code for the occupancy and division of occupancy and the use for which the proposed occupancy is classified. 8999.40.2.6 The name of the Building Official. 8999.40.2.7 The edition of the code under which the permit was issued. 8999.40.2.8 The use and occupancy, in accordance with the provisions of California Building Code Chapter 3. 8999.40.2.9 The type of construction as defined in California Building Code Chapter 6. 8999.40.2.10 The design occupant load. 8999.40.2.11 If an automatic sprinkler system is provided, whether the sprinkler system is required. 8999.40.2.12 Any special stipulations and conditions of the building permit. 8999.40.3 Temporary Occupancy. The Building Official is authorized to issue a temporary certificate of occupancy before the completion of the entire work covered by the permit; provided, that such portion or portions shall be occupied safely. The Building Official shall set a time period during which the temporary certificate of occupancy is valid. A fee for processing and tracking the temporary certificate of occupancy shall be paid by the building owner or the owner's authorized agent before the temporary certificate of occupancy is issued. 8999.40.4 Revocation. The Building Official is authorized to, in writing, suspend or revoke a certificate of occupancy or completion issued under the provisions of this code wherever the certificate is issued in error, or on the basis of incorrect information supplied, or where it is determined that the building or structure or portion thereof is in violation of any ordinance or regulation or any of the provisions of the codes. 8999.42 Service Utilities. 8999.42.1 Connection of Service Utilities. No person shall make connections from a utility, source of energy, fuel or power to any building or system that is regulated by this code for which a permit is required, until released by the Building Official. 8999.42.2 Temporary Connection. The Building Official shall have the authority to authorize the temporary connection of the building or system to the utility source of energy, fuel or power. 8999.42.3 Authority to Disconnect Service Utilities. The Building Official shall have the authority to authorize disconnection of utility service to the building, structure or system regulated by this code and the referenced codes and standards set forth in Section 8999.20.4 in case of emergency, where necessary to eliminate an immediate hazard to life or property or when such utility connection has been made without the approval required by Section 8999.42.1 or 8999.42.2. The Building Official shall notify the serving utility, and wherever possible the owner and occupant of the building, structure or service system, of the decision to disconnect prior to taking such action. If not notified prior to disconnecting, the owner or occupant of the building, structure or service system shall be notified in writing, as soon as practical thereafter. 8999.44 Violations. 8999.44.1 Unlawful Acts. It shall be unlawful for any person, firm or corporation to erect, construct, alter, extend, repair, move, remove, demolish or occupy any building, structure or equipment regulated by Codes listed in Sections 8999.20.4.1 through 8999.20.4.10, or cause same to be done, in conflict with or in violation of any of the provisions of this title. 899.44.2 Notice of Violation. The Building Official is authorized to serve a notice of violation or order on the person responsible for the erection, construction, alteration, extension, repair, moving, removal, demolition or occupancy of a building or structure in violation of the provisions of this code, or in violation of a permit or certificate issued under the provisions of the codes. Such order shall direct the discontinuance of the illegal action or condition and the abatement of the violation. 8999.44.3 Prosecution of Violation. If the notice of violation is not complied with promptly, the Building Official is authorized to request the City Attorney to institute the appropriate proceeding at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the building or structure in violation of the provisions of this code or of the order or direction made pursuant thereto. 8999.44.4 Violation—Penalties. Any person who violates any provision of this code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as prescribed by law. The payment of citations or penalties shall not be exempt from compliance with this title. 8999.46 Stop Work Order. 8999.46.1 Authority. Whenever the Building Official finds any work regulated by provisions of this title being performed in a manner either contrary to the provisions of this title or dangerous or unsafe, the Building Official is authorized to issue a stop work order. 8999.46.2 Issuance. The stop work order shall be in writing and shall be given to the owner of the property involved, or to the owner's authorized agent, or to the person doing the work. Upon issuance of a stop work order, the cited work shall immediately cease. The stop work order shall state the reason for the order, and the conditions under which the cited work will be permitted to resume. 8999.46.3 Unlawful Continuance. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by law. 8999.48 Unsafe Structures and Equipment. 8999.48.1 Conditions. Structures or existing equipment that are or hereafter become unsafe, insanitary or deficient because of inadequate means of egress, facilities, inadequate light and ventilation, or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or that involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition. Unsafe structures shall be taken down and removed or made safe, as the Building Official deems necessary and as provided for in this section. A vacant structure that is not secured against entry shall be deemed unsafe. 8999.48.2 Record. The Building Official shall cause a report to be filed on an unsafe condition. The report shall state the occupancy of the structure and the nature of the unsafe condition. 8999.48.3 Notice. If an unsafe condition is found, the Building Official shall serve on the owner, agent or person in control of the structure a written notice that describes the condition deemed unsafe and specifies the required repairs or improvements to be made to abate the unsafe condition, or that requires the unsafe structure to be demolished within a stipulated time. Such notice shall require the person thus notified to declare immediately to the Building Official acceptance or rejection of the terms of the order. 8999.48.4 Method of Service. Such notice shall be deemed properly served if a copy thereof is (1) delivered to the owner personally; (2) sent by certified or registered mail addressed to the owner at the last known address with the return receipt requested; or (3) delivered in any other manner as prescribed by law. If the certified or registered letter is returned showing that the letter was not delivered, a copy thereof shall be posted in a conspicuous place in or about the structure affected by such notice. Service of such notice in the foregoing manner upon the owner's agent or upon the person responsible for the structure shall constitute service of notice upon the owner. 8999.48.5 Restoration. The structure or equipment determined to be unsafe by the Building Official is permitted to be restored to a safe condition. To the extent that repairs, alterations or additions are made or a change of occupancy occurs during the restoration of the structure, such repairs, alterations, additions or change of occupancy shall comply with the requirements of the California Existing Building Code." SECTION 2. CEQA. The City Council finds that this Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. A high percentage of the population in Downey has a swimming pool. The fencing section has been amended considering the additional safety aspects to be considered; and, WHEREAS, the City of Downey has a low rainfall average which contributes to dust and debris being scattered by winds. This has been addressed by way of amendments to this code. NOW, THEREFORE, THE CITY COUNCIL OF THE'CITY OF DOWNEY DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Findings. The City Council hereby finds that the proposed amendments to the 2019 California Residential Code are reasonably necessary because of local climatic, geologic of topographic conditions, and adopts the findings provided below to support the modifications to the 2019 California Residential Code. The City Council further finds that some changes and modifications are of an administrative or procedural nature, or concern themselves Attachment "" with subjects not covered by the code, or are reasonably necessary to safeguard life and property within the City. The City Council hereby adopts the following (Climatic, geological, and topographical, where applicable) findings to support the proposed amendments to the 2019 California Residential Code made in this Ordinance: Climatic Conditions A. The jurisdiction of the City of Downey (or, "City") is located in a semi -arid Mediterranean type climate. It annually experiences extended periods of high temperatures with little or no precipitation. For example, during July, August and September, temperatures often exceed 100 degrees Fahrenheit. During the same months humidity is usually less than 40%, and humidity measurements less than 10% are not uncommon. These conditions contribute to an increased likelihood of fire. Moreover, minor fires have a greater tendency of spreading rapidly due to such conditions. The City, being in the Southern California area, is also subject to "Sundowner" or "Santa Ana" winds that, should a fire occur, cause the fire to spread rapidly over wood shake roofs which are common in the residential areas. These hot, dry (Santa Ana) winds may reach speeds of 70 M.P.H. or greater. These climatic conditions cause extreme drying of vegetation and common building materials. Frequent periods of drought and low humidity add to the fire danger. This predisposes the area to large destructive fires (conflagration). In addition to directly damaging or destroying buildings, these fires are also prone to disrupt utility services throughout the City. Obstacles generated by a strong wind, such as fallen trees, street lights and utility poles, and the requirement to climb 75 feet vertically up flights of stairs will greatly impact the response time to reach an incident scene. Additionally, there is a significant increase in the amount of wind force at 60 feet above the ground. Use of aerial type fire -fighting apparatus above this height would place rescue personnel at increased risk of injury. B. Water demand in this densely populated area far exceeds the quantity supplied by natural precipitation; and although the population continues to grow, the already -taxed water supply does not. California is projected to increase in population by nearly 10 million over the next quarter of a century with 50 percent of that growth centered in Southern California. Due to storage capacities and consumption, and a limited amount of rainfall, future water allocation is not fully dependable. This necessitates the need for additional and on-site fire protection features. It would also leave tall buildings vulnerable to uncontrolled fires due to a lack of available water and an inability to pump sufficient quantities of available water to floors in a fire. C. These dry climatic conditions and winds contribute to the rapid spread of even small fires originating in high-density housing or vegetation. These fires spread very quickly and create a need for increased levels of fire protection. The added protection of fire sprinkler systems and other fire protection features will supplement, normal fire department response by providing immediate protection for the building occupants and by containing and controlling the fire spread to the area of origin. Fire sprinkler systems will also reduce the use of water for firefighting by as much as 50 to 75 percent. : II. Topographical conditions A. Development has occurred in the City and continues to occur in the City and such development has resulted in severe traffic congestion during peak business hours, weekends and holidays, thus decreasing the response time of fire and emergency service vehicles, particularly on the following streets and highways: Florence Avenue, Firestone Boulevard, Imperial Highway, Paramount Boulevard, Lakewood Boulevard, Brookshire Avenue, Bellflower Boulevard. B. These topographical conditions combine to create a situation which places fire department response time to fire occurrences at risk, and makes it necessary to provide automatic on-site fire -extinguishing systems and other protection measures to protect occupants and property. Due to these topographical conditions and the expected infrastructure damage inherent in seismic zones described below, it is prudent to rely on automatic fire sprinkler systems to mitigate extended fire department response time and keep fires manageable with reduced fire flow (water) requirements for a given structure. Numerous fires have occurred within the City in residential structures (houses, apartments, hotels, motels, and dormitories) over the past several years that have automatic fire protection systems, and in all of these fires, the automatic fire protection systems have successfully controlled and/or suppressed the fire before the emergency response personnel have been able to arrive at the structure. Additional fire protection is also justified to match the current resources of firefighting equipment and personnel within the fire department. III. Geological Conditions A. The City of Downey is located in Southern California, in an extremely active seismic region, with high levels of historic earthquake shaking in the recent past (earthquakes measuring larger than a magnitude 5 on the Richter Scale) and can be expected to experience significant strong ground shaking within the foreseeable future. The City is a densely populated area that has buildings constructed over and near a vast and complex network of faults that increase the likelihood of catastrophic damage when a seismic event occurs and which are believed to be capable of producing future earthquakes similar or greater in size to the 1994 Northridge, the 1987 Whittier Narrows Earthquake, the 1971 Sylmar earthquakes and 1933 Long Beach Earthquake. The seismotectonic setting of the City is dominated by the Norwalk fault, which traverses the northern portion of the City. The City is also in close proximity to the San Andreas Fault, which is located 40 miles to the northeast, the Whittier fault, located 10 miles to the northeast and the Newport -Inglewood fault, located 10 miles to the southwest. In the event of a severe earthquake, these faults present the potential for catastrophic damage, including fire, damage to roadways and other impairments of emergency apparatus. Existing and planned developments are at risk from structural damage from earthquake faults. Improved standards are necessary to ensure that maximum safety is provided to persons and property. B. Previous earthquakes have been accompanied by disruption of traffic flow and fires. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create obstacles similar to those indicated under the high wind section above. This situation creates the need for both additional fire protection and automatic on-site fire protection for building occupants. IV. Mechanical, electrical, or plumbing components and equipment shall be anchored to the structure. Anchorage of the components and equipment shall be designed to resist loads in accordance with the California Building Code and ASCE 7, except where the component is positively attached to the structure and flexible connections are provided between the component and associated ductwork, piping, and conduit; and either 1. The component weighs 400 Ib (1,780 N) or less and has a center of mass located 4 ft (1.22 m) or less above the supporting structure; or 2. The component weighs 20 Ib (89N) or less or, in the case of a distributed system, 5 Ib/ft (73 N/m) or less. SECTION 8998 - Section R401.1 of the 2019 Edition of the California Residential Code is amended to read as follows: R401.1 Application. The provisions of this chapter shall control the design and construction of the foundation and foundation spaces for buildings. In addition to the provisions of this chapter, the design and construction of foundations in flood hazard areas as established by Table R301.2(1) shall meet the provisions of Section R322. Wood foundations shall be designed and installed in accordance with AWC PWF. Exception: The provisions of this chapter shall be permitted to be used for wood foundations only in the following situations: 1. In buildings that have no more than two floors and a roof. 2. When interior basement and foundation walls are constructed at intervals not exceeding 50 feet (15 240 mm). Wood foundations in Seismic Design Category Do, D,, or D2 shall not be permitted. Exception: In non -occupied, single -story, detached storage sheds and similar uses other than carport or garage, provided the gross floor area does not exceed 200 square feet, the plate height does not exceed 12 feet in height above the grade plane at any point, and the maximum roof projection does not exceed 24 inches.
