SUBJECT: GENERAL PLAN CONSISTENCY FINDING – A REQUEST TO FIND
THAT THE SALE OF CITY-OWNED PROPERTY IS CONSISTENT WITH
THE GENERAL PLAN
LOCATION: 9340 STEWART & GRAY ROAD
ZONING: M-2 (GENERAL MANUFACTURING) and P-B (PARKING BUFFER)
REPORT SUMMARY
The City of Downey previously acquired the property located at 9340 Stewart & Gray Road with
the intent of purchasing additional property in the area to consolidate the Public Works yard
onto Stewart & Gray Road. Due to the economy and a change in the City’s priorities, the City is
no longer pursuing the consolidation project. As such, the City of Downey no longer has use for
the parcel and will pursue the sale of the property. Prior to the City selling the land, California
Government Code Section 65402(a) requires the Planning Commission adopt a finding that the
disposal of said property is consistent with the General Plan. Based on the analysis contained
within this report, staff is recommending the Planning Commission adopt the following titled
resolution:

9340 STEWART & GRAY ROAD (AIN 6284-024-905) IS CONSISTENT WITH
THE CITY’S ADOPTED GENERAL PLAN.
BACKGROUND
The subject site is an approximately 30,111 square foot parcel located on the south side of
Stewart & Gray Road adjacent to the Public Works Yard. The City of Downey purchased the
property with the intent of purchasing additional adjacent properties surrounding the existing
Public Works Yard in an effort to consolidate the properties and expand the yard.

DISCUSSION/ANALYSIS
The City of Downey previously sought to acquire multiple properties surrounding the existing Public
Works Yard on Stewart & Gray Road with the intent of joining the parcels to expand the yard and
close the secondary Public Works Yard located on Bellflower Boulevard. The purchase of the
subject site was part of the prior plan to consolidate the Public Works Yards within the City. As
previously noted, the City no longer seeks to pursue the consolidation plan as the existing yards
meet their necessary functions. The City will now pursue the sale of the property to remove the
unnecessary encumbrance of property management for a parcel not utilized for City facilities.
Pursuant to Government Code 65402(a), prior to the City being able to sell the property, the
Planning Commission must find that the sale of the property is consistent with the General Plan.
The sale of the subject site would be consistent with Goal 9.3 of the General Plan, which states the
City should “Ensure the continued fiscal balance of the community.” The disposition of an excess
property will generate revenue for the City and relieve the City from liabilities and burdens that
accompany property management. Additionally, the site will continue to be available for private
business activity and retain the mixture of uses within the City by preserving a M-2 (General
Manufacturing) zoned property.
DEVELOPMENT REVIEW COMMITTEE
The proposed project did not require a review from the Development Review Committee (DRC).
ENVIRONMENTAL ANALYSIS
Staff has reviewed the proposed use in compliance with the California Environmental Quality Act
(CEQA) Guidelines and determined that it is categorically exempt from CEQA, pursuant to

Guideline Section No. 15312 (Class 12, Surplus Government Property Sales). Categorical
Exemptions are projects which have been exempted from the requirements of CEQA because they
do not have a significant effect on the environment. Class 12 exemptions allow the disposal of
surplus property, such as the subject site.
CONCLUSION
Based on the analysis contained within this report, staff is concluding the sale of the parcel located
at 9340 Stewart & Gray Road is consistent with the General Plan.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
DOWNEY FINDING THE DISPOSAL OF REAL PROPERTY LOCATED AT
9340 STEWART & GRAY ROAD (AIN 6284-024-905) IS CONSISTENT WITH
THE CITY’S ADOPTED GENERAL PLAN
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find,
determine and declare that:
A.The property located at 9340 Stewart & Gray Road (AIN 6284-024-905) was
acquired by the City of Downey to prepare for an expansion and consolidation
project for the Public Works Yard; and,
B.The City of Downey no longer seeks to pursue the Public Works expansion
project; and,
D.The City of Downey desires to enter into a Purchase and Sale agreement to
dispose of the surplus property; and,
C.Prior to the City selling the land, California Government Code Section 65402(a)
requires the Planning Commission adopt a finding that the disposal of said
property is consistent with the General Plan; and,
SECTION 2. The Planning Commission further finds, determines and declares the
environmental impact of the proposed development has been reviewed and has been found to
comply with the California Environmental Quality Act (CEQA) and is categorically exempt from
CEQA, pursuant to Guideline Section No. 15312 (Class 12, Surplus Government Property Sales).
SECTION 3. The Planning Commission further finds, determines and declares that the
sale of the parcel located at 9340 Stewart & Gray Road is consistent with the City of Downey’s
adopted General Plan (Vision 2025). The subject site has a General Plan Land Use
Designation of General Manufacturing. According to the General Plan, the intent of the General
Manufacturing designation is intended for manufacturing, wholesaling, and other industrial land
uses. The General Plan further notes that it is appropriate for the General Manufacturing
designation to be located in areas separated from other land uses by a major natural or physical
barrier and screen. Through the disposition of the property, the site will continue to be available
for private business activity and retain the mixture of land uses throughout the City by
preserving a General Manufacturing designated property. Additionally, the sale of the subject
site would be consistent with Goal 9.3 of the General Plan, which states the City should “Ensure
the continued fiscal balance of the community.” The disposition of an excess property will
generate revenue for the City and relieve the City from liabilities and burdens that accompany
property management. For this reason, the sale of the parcel on the southwest corner of
Lakewood Blvd and Imperial Hwy is consistent with the General Plan.
