SPECIAL MEETING
DOWNEY CITY PLANNING COMMISSION
WEDNESDAY, NOVEMBER 6, 2019

6:30 P.M.
Chair Dominguez called the November 6, 2019, Special Meeting of the Planning Commission to order at
6:35 p.m., at Downey City Hall, 11111 Brookshire Avenue, Downey, CA. After the flag salute, Secretary
Cavanagh called roll.

PLANNING COMMISSIONER ANNOUNCEMENTS; REQUEST FOR FUTURE AGENDA ITEMS;
AND CONFERENCE/MEETING REPORTS: None.
PRESENTATIONS: Single Family Residential Design Standards
Director of Community Development Aldo Schindler introduced Housing Development Consultant John
Kaliski with John Kaliski Architects, to give a PowerPoint presentation on Residential Development
Standards. Mr. Kaliski spoke briefly about the City of Downey’s history pertaining to the various
architectural designs within the City that are reflective of the various eras’ in which they were
constructed, such as World Wars I and II. He reviewed the results of the two Community Meetings held
to obtain local residents’ perspective on residential designs. The residents commented positively on
homes that were well maintained and the variety and character of architectural styles that were
reflective of various eras. The residents expressed their discontent with second story homes due to
privacy concerns; houses built up to the minimum side yard setback, subdivisions with private streets
that are incompatible with the public streets; and houses that were too large as compared to others in
the neighborhoods; overdevelopment in their communities causing additional parking issues. He
presented some of the homes that the Community Members voted on and asked for the
Commissioners views. Mr. Kaliski made his recommendations to standardize residential development
to the Commission and discussed their concerns and comments.
Public Comment: Armando Herman stated the millennium mansion issue has messed up the
community.
Unknown female speaker stated she would like to see two more presentations.

Hector Schmidt stated he enjoyed the first Community Meeting held and likes the idea of involving the
audience to get survey results.
Director of Community Development Schindler advised the Commission and members of the audience
that they will hold one more meeting to gather more information from the community. Staff will
consolidate the Commissioners’ and publics’ comments for the next Community Meeting.
The Planning Commission received and filed the presentation and report.
Chair Dominguez called for a recess at 8:35 p.m. and called the meeting to order at 8:51 p.m.
CHANGES TO THE AGENDA: Director of Community Development Aldo Schindler advised the
Commission that item No. 3 of the Agenda (PLN-19-00168) Zone Text Amendment has been
continued to a date uncertain to allow Staff time to include new State Regulations.
It was moved by Dominguez, seconded by Commissioner Owens and passed by a vote of 5-0 to
continue PLN-19-00168 (Zone Text Amendment) to a date uncertain.
REPORT ON CITY COUNCIL ACTION: Director Schindler report the City Council voted to uphold the
recommendation of the Planning Commission regarding the Rives Mansion redevelopment.
PUBLIC HEARINGS:
1. PLN-19-00165 (Special Event Permit): Chair Dominguez opened the public hearing for PLN-19-
00165 and Ms. Cavanagh affirmed proof of publication.
Principal Planner Guillermo Arreola presented the request by Bastard’s American Canteen, located at
11045 Downey Avenue and zoned DDSP (Downtown Downey Specific Plan), to conduct a Veteran’s
Day Event on Sunday, November 10, 2019, from 12:00 p.m. to 10:00 p.m. As in previous years, the
event includes live entertainment from 12:00 p.m. to 10:00 p.m.; a beer garden and trailer selling food
and drinks, with Alcohol consumption restricted to the beer garden only. Crowd control barriers will be
installed around the perimeter of the event, with security stationed at the main entrance checking for
identification and issuing wrist bands for all attendees of the 21 and over event. Vendors selling goods
and services will be located along the east and west sides of the parking lot, along with a Veteran’s
Association Mobile R.V. providing medical consultations for veterans. This application was presented
to the Development Review Committee Meeting, with all departments recommending standard
conditions of approval. However, the Fire Department noted that all required permits were not obtained
prior to last year’s event. Therefore, the applicant was required to meet with the Fire Chief to show
clear understanding of the need for compliance with safety conditions. The meeting was held to the
satisfaction of the Fire Chief. As such, a condition was added to state that approval of the special event
is “null and void” if required permits are not obtained by the dates specified.

Applicant: Larry Lopez stated this is the 7th year of the event and it will be great.

Staff recommended approval of the request for a Special Event Permit (PLN-19-00165).
Chair Dominguez closed the public hearing.
The Commissioners spoke in favor of the event.
It was moved by Commissioner Spathopoulos, seconded by Vice Chair Duarte, and passed by a 5-0
vote, to adopt Resolution No. 19-3010, thereby approving Special Event Permit (PLN-19-00165).
2. PLN-19-00076 (Conditional Use Permit): Chair Dominguez opened the public hearing for PLN-
19-00076 and Ms. Cavanagh affirmed proof of publication.
Principal Planner Guillermo Arreola presented the Conditional Use Permit request to install nine 6 foot
tall panel antennas to an existing Southern California Edison Tower and six 28” tall wireless remote
radios, three 28.9” tall junction boxes on an existing 111 foot tall tower. Planner Arreola review the
surrounding uses and the property site plan. The project also includes three equipment cabinets to be
located below the tower behind a proposed 8’ high block wall enclosure that is 16’ x 16’ that will hold
equipment cabinets, the transformer, and a generator with 54 gallon diesel tank. The Fire Department
did include the requirements for safety measure for battery storage within the enclosure. Standard
conditions were applied by all other departments.

Applicant Chris Colton representing Spectrum Services, 4405 E. Airport Drive #100, Ontario, CA
91761, was present to address questions or concerns related to the project. He stated he reviewed the
draft conditions of approval with Verizon and they accept the terms. There will also be a security cage
installed on top of the block wall.

Staff recommended approval of the request for a Conditional Use Permit (PLN-19-00076).
Chair Dominguez closed the public hearing.
The Commissioners had no issues or comments pertaining to the application.
It was moved by Commissioner Frometa, and seconded by Commissioner Owens, and passed by a 5-0
vote, to adopt Resolution 19-3111, thereby approving the request for a Conditional Use Permit (PLN-
19-00076).
NON-AGENDA PUBLIC COMMENTS: Public Comments: Armando Herman discussed Freedom of
Speech and personal political views using vulgar language.

Public Comments: Armando Herman commented on and read aloud portions of the Minutes.
It was moved by Commissioner Spathopoulos, seconded by Vice Chair Duarte and passed by a vote
of 3-0-2, to approve Consent Calendar, with Chair Dominguez and Commissioner Owens abstaining
from the October 2, 2019 Minutes, and a vote of 4-0-1, with Chair Dominguez abstaining from the
October 16, 2019 Minutes.
OTHER BUSINESS: None.
STAFF MEMBER COMMENTS: None.
ADJOURNMENT: Chair Dominguez adjourned the meeting at 9:37 p.m., to Wednesday, November
20, 2019, at 6:30p.m., at Downey City Hall, 11111 Brookshire Ave.
