BY C17Y MANAGER TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ,i OFFICE OF BY: JAMES MCQUEEN, DIRECTOR •RESOURCE Staff recommends that the City Council adopt the attached Resolution: • • •' -• • • Historically the differential between the Fire Chief and the highest paid Downey Fire Management Association (DFMA) subordinate classification has been approximately 9%. City Council Resolution No. 5290 establishes the Management Performance Compensation Plan, which states that cost -of -living (COLA) increases granted to management employees will be no less than that granted to the rank and file employees in their respective departments. In recent years the Fire Chief position has received the same COLA increases approved for the DFMA classifications. However, in recent years the DFMA positions have also received a number of non -COLA compensation adjustments which have diminished the pay differential between these two positions. As approved in the 2015-2016 DFMA MOU, on January 1, 2015, the Education Incentive Pay for eligible classifications increased by 1 %. Additionally on July 4, 2016, DFMA classifications became eligible for longevity pay up to the 20 year amount of 8.402%. The addition of these two compensation increases further decreased the differential between these two positions. As a result, on June 26, 2018, City Council adopted salary range adjustments for the Fire Chief position establishing a 5% differential between the highest paid subordinate. On November 27, 2018, a side letter agreement was approved with the DFMA to grant its members with overtime pay in the amount of time and one-half (1.5) their salary for overtime when serving as a "first responder" or in an "emergency response" capacity. The addition of this overtime pay has further decreased the compensation differential between these two positions. To address this impact, staff recommends an additional salary increase to the Fire Chief position in the amount of 5% to establish a 10% differential between the Chief and the highest paid subordinate. SALARY RANGE ADJUSTMENTS FOR FIRE CHIEF NOVEMBER 12, 2019 PAGE 2 As part of the City Council's approval, Senate Bill (SB) 1436, signed by Governor Brown on August 22, 2016, mandates that effective January 1, 2017, local agencies report out certain information before changing the compensation or benefits of their "executives". Under this law, legislative bodies for agencies must orally report a summary of a recommendation for changes in salaries or benefits before voting for the changes. The votes must be taken in the open session portion of the meeting. The current monthly salary range for the positon of Fire Chief is $15,297.25 to $18,662.65. The new proposed monthly salary range for the Fire Chief position is $16,062.11 to $19,595.78 effective the pay period that includes November 12, 2019. All other benefits payable to the positon of Fire Chief remain in accordance with Resolution No. 18-7799. 0 1-111- PRIORITIES Fiscal Responsibility The salary range adjustment increases personnel costs by approximately $12,954.57 in Fiscal Year 2019-20. Sufficient funding is included in the Fiscal Year 2019-20 budget. Attachment A: Resolution K A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING COMPENSATION FOR THE CLASSIFICATIONOF FIRE WHEREAS, the Fiscal Year 2019-2020 budget includes funding for salary range adjustments for the executive classification of Fire Chief due to salary compaction with the Fire Battalion Chief classification assigned as Assistant Fire Chief, WHEREAS, a 5% salary range to appropriately address salary compaction, WHEREAS, there are no changes to benefits payable to the classification of Fire Chief which are currently represented in Resolution No. 18-7799, which from time to time will be updated by formal City Council action, NOW, •-E, THE CITY COUNCIL OF OF DOWNEY DOES RESOLVE• • SECTION 1. The following pay range for the classification of Fire Chief shall take effect as follows: Effective the pay period that includes November 12, 2019 - $16,062.11 to $19,595.78 SECTION 2. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 12th day of November, 2019.
