DISABILITIES ACT (ADA) IMPROVEMENTS (CITYWIDE), CAPITAL IMPROVEMENT PROJECT NO. 19-11 1 . Award construction contract in the amount of $379,673.50 to CJ Concrete Construction, Incorporated for the Annual Miscellaneous Concrete Construction and Repairs (Council District 4) and ADA Improvements (Citywide), Capital Improvement Project No. 19-11; 2. Authorize transfer of $226,050 of budgeted Gas Tax funds from Account No. 30-1-6788 to Account No. 30-1-6761 to cover shortfall in funding; 3. Approve agreement with the Downey Unified School District (DUSD) for parkway improvements adjacent to various school campuses; 4. Authorize City Manager to execute the agreement and any amendments to the agreement deemed necessary in a form acceptable by the City Attorney; 5. Appropriate additional $30,000 in DUSD reimbursable funds in Account No. 26-1-6761 to cover shortfall in funding; and 6. Authorize Public Works Director to execute any change orders or additional scope of work for this project deemed necessary or desirable up to the approved project budget. The City receives requests on an on-going basis for the repair of concrete improvements within the public right-of-way. These requests are primarily related to damaged and/or uplifted sidewalks; and curb and gutter; damaged driveway approaches; and uplifted pavement. Priority of repairs is given areas which have higher than usual pedestrian traffic (i.e. near hospitals, health clinics, schools, parks, bus stops, and senior care facilities) or locations with severe damage. Periodically, the City also receives requests for the construction of sidewalks and ADA -compliant curb access ramps where they currently do not exist. CAPITAL IMPROVEMENT PROJECT NO. 19-11 ANNUAL MISCELLANEOUS CONCRETE REPAIRS AND ADA IMPROVEMENTS PROJECT NOVEMBER 12, 2019 PAGE 2 In order to complete the necessary concrete repairs and ADA improvements in a systematic manner, the City adopted an Annual Concrete Repair Program in which the City was divided into four areas representing the Council Districts as shown on Attachment A. Each fiscal year, the program is implemented in a specific Council District and ADA improvements are made Citywide. Staff has reviewed and evaluated requests received from the residents for concrete repairs and locations identified in the City of Downey's Self -Evaluation and Transition Plan for ADA related upgrades. Consequently, locations requiring concrete repairs and/or ADA -related upgrades have been selected which are in need of immediate attention. In order to take advantage of economies of scale, the Downey Unified School District (DUSD) has approached the City requesting parkway improvements adjacent to five DUSD school campuses that will be funded by DUSD. The parkway improvements will remove continuous landscaped areas within the parkways located adjacent to the schools which typically consist of turf in poor condition with dead patches and replaced with new sidewalks for use by students, faculty and visitors walking to and from the school campuses. On July 23, 2019, the City Council approved the plans and specifications (Attachment B) and granted authority to advertise for bids for the Annual Miscellaneous Concrete Construction and Repairs and ADA Improvements. The project was advertised in the Downey Patriot on August 8 and August 15, 2019, posted on Planet Bids on August 15, 2019, and published in various trade publications. The work to be completed consists of miscellaneous concrete construction and repairs in Council District 4 and ADA improvements Citywide including reconstruction of sidewalks, driveway approaches, curb access ramps, and curb and gutter at approximately 130 locations. In addition, this project will install parkway improvements adjacent to five DUSD school campuses, namely: Doty Middle School, Stauffer Middle School, Gauldin Elementary, E.W. Ward Elementary and Lewis Elementary School. On August 29, 2019, the City Clerk received and publicly opened nine bids with the base bids ranging from $190,650 to $298,860 (Attachment C). Consequently, the lowest responsible bidder was CJ Concrete Construction, Incorporated of Santa Fe Springs, California with a total base bid of $190,650. CJ Concrete Construction's bid included a total amount of $189,023.50 for the additive bid items for the DUSD parkway improvements adjacent to five campuses. Thus, CJ Concrete Construction's total bid amount (total base bid plus additive bid items) was $379,673.50 (Attachment C). Staff reviewed the bid proposal and references provided by CJ Concrete Construction and found that said contractor has satisfactorily completed similar projects for the Cities of Cerritos, Downey, La Habra, Long Beach, Lakewood, Orange and West Covina. CJ Concrete Construction's State of California Contractor's License is "current and active". In addition, CJ Concrete Construction is registered with the California Department of Industrial Relations under the Public Works Contractor Registration Program for Labor Compliance. Staff recommends that the City Council award a construction contract in the amount of $379,673.50 to CJ Concrete Construction, Incorporated for the construction of the Annual Miscellaneous Concrete Construction and Repairs and ADA Improvements. The execution of the agreement with DUSD (Attachment D) will be necessary in order for the City to construct the parkway improvements adjacent to the five school campuses. In accordance with the terms of the agreement, DUSD's estimated share of costs for the design, engineering, construction and contingencies is $230,000. In addition, the City shall complete said improvements between November 25, 2019 and January 3, 2020. The City shall be reimbursed by DUSD for actual costs incurred in constructing the parkway improvements following completion of improvements and filing of Notice of Completion. Construction is anticipated to begin in November 2019 and be completed in March 2020. This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c), Existing Facilities.
