That the City Council:
1. That the City Council reject all bids received for the Wilderness Park Ponds
Restoration Project (Capital Improvement Project No. 15-21) and authorize
solicitation of bids from multiple prime contractors.
2. Authorize staff to purchase a pre -fabricated pedestrian bridge system through a
sole source informal bid process.
In an effort to ascertain that the pond restoration would be completed by a qualified
construction firm and avoid complications and delays; the City opted to employ a
prequalification process of eligible contractors. The subsequent bids received well
exceeded the engineer's estimate. At its meeting of August 27, 2019, the City Council
rejected the two prequalified contractors' bids. At the same meeting, the City Council
authorized staff to re -solicit for construction bids.
On August 28, 2019, and September 5, 2019, the Notice Inviting Bids for this project
was published in the Downey Patriot. On October 10, 2019, the City Clerk received and
publicly opened five (5) bids as shown on the attached bid summary (Attachment A).

On October 14, 2019, the City received a bid protest from the representative of the
second lowest bidder, MMC, Inc. On October 16, 2019, NR Development, the lowest
bidder provided a response to the bid protest.

all proposals and to waive any or all information or technical defects, as the interest of
the City may require. Award of Contract or rejection of Bid proposals will be made by
the City within 45 calendar days following the Bid opening." Upon reviewing the bid
protest and the corresponding response, staff recommends that the City Council reject
all bids received as related to the Wilderness Park Pond Restoration Project and
authorize re -solicitation of bids.
Restoration of the Wilderness Park ponds involves several phases of construction
activities. The first phase, which includes water and sludge removal, is now complete,
The project's additional phases include extensive concrete improvements; as well as
the actual pond restoration effort which includes replacing the existing damaged liner
and mechanical equipment, installing a naturalized hardened shoreline, restoring
wetland habitat for native species, and a new pedestrian bridge; and finally the
construction of new walking trails and landscape improvements.
After reviewing the bids received and analyzing the current construction market

Moreover, because of budgetary constraints and in trying to manage the costs to the
maximum extent possible, staff intends to procure the specified pre -fabricated
pedestrian bridge system through a sole -source informal bid process and include
installation of the bridge as an additive alternate item in the bid documents.
Quality of Life, Neighborhood & Infrastructure
The cost of re -solicitation of bids is estimated to be approximately $5,000 and which
would be paid by the City's 2018-20 Capital Improvement Program which includes the
Wilderness Park Pond Restoration Project, as well as utilizing grant funds from RMC
and Habitat Conservation Fund, and the $200,000 matching fund from its General Fund
(Account Nos. 26-1-7706 and 40-1-7706).
