Government Code Section 54956.9(d)(1) – Pending Litigation - City of Downey v. General Reinsurance Corporation, et al., LASC Case No. 19NWCV00625. 2. Conference with Legal Counsel: Anticipated Litigation – (Gov. Code Section 54956.9(d)(2) and Gov. Code section 54956.9(e)(1)): A point has been reached where in the opinion of the City Council on the advice of its legal counsel, there is a significant exposure to litigation against the City. Facts and circumstances that might result in litigation, but which the City believes are not yet known to potential plaintiff or plaintiffs which facts need not be disclosed: One (1) Potential Case. 3. Government Code Section 54956.95 - Liability Claim: Jerry Price v. City of Downey, Worker’s Compensation Claim No. 16-124724; WCAB NO.: ADJ10243247 4. Government Code Section 54957.6 - Conference with labor negotiators John Oskoui/James McQueen re: direction for labor negotiations with Downey Firemen’s Association. A CALL FOR REVIEW OF A PLANNING COMMISSION DECISION TO ADOPT A MITIGATED NEGATIVE DECLARATION AND APPROVE A SITE PLAN REVIEW APPLICATION THAT INCLUDES AN ADAPTIVE REUSE OF A HISTORIC RESIDENCE, WATER TOWER, AND CARRIAGE HOUSE (DRYING SHED) TO OFFICE USE, AND CONSTRUCTION OF A NEW ONE- STORY COMMERCIAL BUILDING: Community Development. ADOPT RESOLUTION 19-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AFFIRMING PLANNING COMMISSION DECISION TO ADOPT A MITIGATED NEGATIVE DECLARATION AND APPROVE A SITE PLAN REVIEW APPLICATION THAT INCLUDES AN ADAPTIVE REUSE OF A HISTORIC RESIDENCE, WATER TOWER, AND CARRIAGE HOUSE (DRYING SHED) TO OFFICE USE, AND CONSTRUCTION OF A NEW ONE-STORY COMMERCIAL BUILDING LOCATED AT 10921 PARAMOUNT BOULEVARD. NON-AGENDA PUBLIC COMMENT This portion provides an opportunity for the public to address the Council on items within the jurisdiction of the Council and not listed on the agenda. It is requested, but not required, that you state your name, address and subject matter upon which you wish to speak. Please limit your comments to no more than 5 minutes. Pursuant to the Brown Act, no discussion or action, other than a brief response, referral to the City Manager/staff or schedule for a subsequent agenda, shall be taken by the Council/Agency on any issue brought forth under this section. CONSENT CALENDAR All matters listed on the Consent Calendar are to be approved with one motion unless a Council Member request an item be removed. Removed items will be considered following approval of the Consent Calendar. 2. APPROVE MINUTES: Special Meeting of October 8, 2019: City Clerk. 3. WARRANTS ISSUED: Warrant Nos. are 337652 – 337995; Payroll Wire Nos. 30003924 – 30003926 & 30003928; Manual Wire Nos. 1916 – 1920; and, Cashier’s Check number 136, in the total amount of $7,357,791.78: Finance. 4. ACCEPT THE COMPLETION OF THE WILDERNESS PARK PONDS – WATER & SLUDGE REMOVAL PROJECT; APPROVE THE FINAL CONSTRUCTION CONTRACT AMOUNT OF $845,000; AND, AUTHORIZE THE NOTICE OF COMPLETION TO BE FILED (CIP NO. 15-21A): Administration. 5. ACCEPT THE COMPLETION OF THE WILDERNESS PARK PONDS – WILDLIFE RELOCATION PROJECT; APPROVE THE FINAL CONSTRUCTION CONTRACT AMOUNT OF $70,500; AND, AUTHORIZE THE NOTICE OF COMPLETION TO BE FILED (CIP NO. 15-21B): Administration. 6. APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH COAST TO COAST FOUNDATION IN THE AMOUNT OF $60,000 TO PROVIDE HOMELESS OUTREACH SERVICES; AND, AUTHORIZE THE CITY MANAGER TO EXECUTE ANY AND ALL AMENDMENTS TO THE AGREEMENT: Administration. 7. AWARD A CONTRACT TO THE LOS ANGELES CONSERVATION CORPS IN THE AMOUNT OF $192,796.96 FOR THE PLANTING OF 540 TREES AS PART OF THE CALFIRE GRANT; AUTHORIZE THE MAYOR TO EXECUTE THE CONTRACT; AND, AUTHORIZE PUBLIC WORKS DIRECTOR/CITY ENGINEER TO EXECUTE ANY CHANGE ORDERS OR ADDITIONAL SCOPE OF WORK DEEMED NECESSARY OR DESIRABLE UP TO THE APPROVED BUDGET: Public Works. 8. ADOPT RESOLUTION NO. 19-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS OF THE POLICE DEPARTMENT: Police. 3 9. APPROVAL OF FINAL PARCEL MAP NO. 82450 AND SUBDIVISION AGREEMENT FOR PUBLIC IMPROVENMENTS LOCATED AT 8818 IMPERIAL HWY.: Public Works. ADOPT RESOLUTION NO. 19-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING FINAL PARCEL MAP NO. 82450 AND AGREEMENT WITH THE SUBDIVIDER FOR CONSTRUCTION OF SUBDIVISION PUBLIC IMPROVEMENTS. 10. ADOPT RESOLUTION NO. 19-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING APPLICATION FOR, AND RECEIPT OF, SB 2 PLANNING GRANTS PROGRAM FUNDS: Community Development. 11. ACCEPT THE 2019 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM LOCAL SOLICITATION IN THE AMOUNT OF $25,351: Police. 12. APPROVE A FEE WAIVER FOR USE OF THE SHOWMOBILE FOR COURAGE FORWARD & ROTARY CLUB OF DOWNEY’S “FIESTA DE LA CALAVERAS” EVENT ON OCTOBER 26, 2019 AT STONEWOOD MALL: Mayor Pro Tem Pacheco.
