Restoration of the Wilderness Park ponds involves several phases of construction activities. The first phase, which includes water and sludge removal, is underway. After completion of this phase, the actual restoration effort which includes replacing the existing damaged liner and mechanical equipment, installing a naturalized hardened shoreline, restoring wetland habitat for native species, and construction of new walking trails and a pedestrian bridge will begin. This phase of work involves specialty work, particularly as related to the ponds' liner replacement. In an effort to ascertain that the pond restoration would be completed by a qualified construction firm and avoid complications and delays; the City opted to employ a prequalification process of eligible contractors. On April 23, 2019, the City Council authorized the prequalification of bidders for the subject project. Subsequently, by following the required guidelines and procedures staff completed the prequalification process and ultimately two firms, Environmental Construction, Inc. and Ford E.C., Inc. were prequalified. On July 23, 2019, the City issued the subject project bid packages to the two aforementioned prequalified contractors. On August 14, 2019, the City received two bids from Environmental Construction, Inc. and Ford E.C., Inc. in the amounts of $3,942,788.00 and $4,379,315.00 respectively. Both bid amounts well exceed the engineer's estimate of $2,350,000.00 and the project's overall budget. Further analysis THE WILDERNESS PONDS RESTORATION PROJECT - CIP NO. 15-21 REJECTION OF BIDS RECEIVED AND AUTHORIZATION OF SOLICITATION FOR CONSTRUCTION BIDS AUGUST 27, 2019 PAGE 2 of current construction market conditions, indicates that a considerable pool of contractors capable of completing this project has become available. As such, staff recommends revising the specific provisions of the contract documents, particularly in reference to the liner replacement task, to increase the number of General Engineering ("A" License) contractors bid on this project. The Wilderness Park Ponds Restoration Project bid documents states that "The City reserves the right to after opening of bids, reject any or all bids received and to be the sole judge of the merits of the respective bids received". Based on the aforementioned information and analysis it is recommended that the City Council reject the two bids from Environmental Construction, Inc. and Ford E.C., Inc. and authorize staff to solicit for construction bids for the Wilderness Park Ponds Restoration Project. In order to achieve the anticipated completion date for this project the following bid process schedule will be followed: Bid Advertisement Mandatory Pre -Bid Meeting Bid Opening Award Contract Commence Construction August 29, 2019 and September 5, 2019 September 12, 2019 September 26, 2019 October 8, 2019 October 21, 2019 Quality of Life, Neighborhood & Infrastructure The cost of solicitation of bids is estimated to be approximately $5,000 which would be paid by utilizing the Wilderness Park Ponds Restoration Project — Account No 26-1- 7706.
