That the City Council:
2. Allocate $500,000 from the General Fund to the City Hall Complex Improvement
Project (CIP 19-21) for the construction of the Firefighters Memorial and
relocation of existing memorial structure from the Civic Theatre Plaza to the Civic
Center area and to complete the required work at the Police Station, and
3. Authorize transfer of $1,000,000 from the ADA Improvement Projects (CIP No.
19-27) to the Civic Theatre Improvement Project (CIP No. 19-22) to complete
installation of an elevator, ramp and other related work, and $500,000 from the
Other City Facilities Improvement Project (CIP No. 19-26) to the Civic Theatre
Improvement Project for improvements in the Theater's, courtyard, and $
500,000 from the Other City Facilities Improvement Project (CIP No. 19-26) to
the Police Station Improvement Project (CIP No. 19-38).
4. Authorize the Assistant City Manager to execute any change orders or additional
scope of work for this project deemed necessary or desirable up to 10% of the
construction contract amount.

At its meeting of June 11, 2019, the City Council approved the plans and specifications
and authorized solicitation of bids for the subject project. On June 13, 2019, and June
20, 2019, the Notice Inviting Bids for this project was published in the Downey Patriot.
On July 1, 2019, Addendum Number 1 was issued removing the Library Water Fountain
from the scope. On July 5, 2019, Addendum Number 2 was issued further defining the
demolition plan and planting plan for the Theatre Plaza and Courtyard. On July 5, 2019,
Addendum number 3 was issued providing additional information about the planting
plan.
On July 10, 2019, the City Clerk received and publicly opened three (3) bids which
ranged from $4,124,839.74 to $4,865,700, as shown on the attached bid summary
(Attachment A). On July 11, 2019 Monet Construction, Inc., the apparent second lowest
bidder, submitted a bid protest letter. It has been determined that the protestor's
objections were without merit.
The lowest responsive and responsible bidder is Hoffman Management & Construction
Corporation of Los Angeles, California with a bid in the amount of $4,124,839.74. Staff
has confirmed that Hoffman Management & Construction Corporation possess the
specified contractor license and that the license is current and in good standing.
Additionally, verbal qualification interviews with randomly selected Hoffman
Management & Construction Corporation's references have been completed and the
responses were all satisfactory.
Below is a summary of the scope of work, implementation schedule and other relevant
data related to each project:
CIVIC THEATRE IMPROVEMENTS PROJECT (CIP No. 19-22):
• Theatre Plaza: ADA curbside drop off and ramp access
• Theatre Plaza: Exterior elevator for 2nd floor programming access
• Theatre Plaza: Plaza fountain with sculpture (sculpture not in contract)
• Theatre Plaza: Public sculpture garden
• Theatre Plaza: Interactive information and ticket kiosk
• Theatre Courtyard: Modernized entrance and level courtyard for private
gatherings
CITY HALL COMPLEX IMPROVEMENTS PROJECT (CIP No. 19-21):
• Library Cafe Shade Structure: Colorful sail cover open canopy for all weather
enjoyment (CIP No. 19-21-A)

• Firefighters' Memorial: Placement of a commissioned sculpture honoring
Downey's firefighters (CIP No. 19-21-13)
• Firefighters' Memorial: Relocation of Theatre Plaza memorials to the Civic
Center (CIP No. 19-21-B)
• Men's and women's locker rooms renovation
• Men's and women's shower rooms renovation
• Public restrooms renovation
Staff respectfully requests that the City Council award a construction contract in the
amount of $4,124,839.74 to Hoffman Management & Construction Corporation for the
Civic Theatre Improvements Projects, City Hall Complex Improvement Project and
Police Station Modernization Project. Construction will start on August 7, 2019 and be
completed on December 13, 2019. The Estimated Project Cost Summary is attached to
this report (Attachment C).
As related to the Police Station Improvement Project, the Measure S funded original
scope of work did not include reconfiguration of the Civic Center North parking lot to
turn it into a dedicated secured parking lot for the Police Department. This project was
completed a few months ago utilizing Measure S funds however, the funds spent for this
project is needed to complete the work at the station. Moreover; the Firefighters
Memorial Project was not included in the list of Measure S funded projects, but
combining this work with the Measure S funded projects in the Civic Center would
provide the opportunity to complete it in a cost-effective manner. Therefore; it is
requested that the City Council authorize transfer of $300,000 from the General Fund to
the Police Department Improvement Project (CIP No. 19-38) and $200,000 from the
General Fund to the Civic Center Improvement Project (CIP No. 19-21).
Additionally, staff requests that the City Council authorize transfer of $1,000,000 from
the ADA Improvement Projects (CIP No. 19-27) to the Civic Theatre Improvement
Project (CIP No. 19-22), $500,000 from the Other City Facilities Improvement Project
(CIP 19-26) to the Civic Theatre Improvements Project (CIP No. 19-22) and $500,000
from the Other City Facilities Improvement Project to the Police Station Improvement
Project (CIP No. 19-38)

The total estimated cost of the project, including construction costs (based on the
construction bid amount and contingencies, design, inspection, construction engineering
and management services and material testing) is $5,367,605.74, which will be paid
through available Measure S funded projects and transfer of $500,000 from the General
Fund to the designated Measure S projects.
