APPROVED BY TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCILCITY ANAGER FROM: OFFICE OF THE CITY MANAGER BY: JOHN OSKOUI, P.E., ASSISTANT CITY MANAGER DATE: JUNE 25, 2019 SUBJECT: AWARD A CONSTRUCTION CONTRACT IN THE AMOUNT OF $4,735,000.00 TO TELACU CONSTRUCTION MANAGEMENT FOR THE LIBRARY MODERNIZATION PROJECT (CIP NO. 19-20) RECOMMENDATION That the City Council 1. Award a construction contract in the amount of $4,735,000.00 to TELACU Construction Management, for the City Library Modernization Project, Capital Improvement Project No. 19-20, and 2. Authorize the Assistant City Manager to execute any change orders or additional scope of work for this project deemed necessary or desirable up to 10% of the construction contract amount. • At its meeting of January 22, 2019, the City Council approved the plans and specifications and authorized solicitation of bids for the subject project. On February 27, 2019 the City Clerk received eleven (11) bids. The City received a bid protest from the second lowest bidder. On March 26, 2019, the City Council rejected all bids received and authorized staff to rebid the project. On April 11, 2019, the City Clerk received and opened nine (9) bids. Again, the City received a bid protest from the second lowest bidder. On May 14, 2019, the City Council rejected all bids received and authorized staff to rebid the project. On May 16, 2019, and May 23, 2019, the Notice Inviting Bids for this project was published in the Downey Patriot. On May 24, 2019, an addendum was issued providing answers to questions by potential bidders. On May 30, 2019, the City Clerk received and publicly opened eight (8) bids which ranged from $4,735,000 to $5,365,000, as shown on the attached bid summary (Attachment A). The apparent lowest bidder was TELACU Construction Management with a bid in the amount of $4,735,000. On June 4, 2019, Golden Phoenix Construction Company, the apparent 3rd lowest bidder, and Saifco Construction Company, the apparent 4th lowest bidder, submitted protest letters. Based on a thorough review of the said bid protests by the City's outside counsel, it has been determined that both bid protests are without merit. Moreover, verbal qualification interviews with randomly selected TELACU Construction Management's references were completed and the responses were all satisfactory. Staff has confirmed that TELACU AWARD A CONSTRUCTION CONTRACT TO TELACU FOR THE LIBRARY MODERNIZATION PROJECT (CIP NO. 19-20) JUNE 25,-2019 PAGE 2 Construction Management possess the specified contractor license and that the license is current and in good standing, therefore; the lowest responsive and responsible bidder is TELACU Construction Management of Orange, California with a bid in the amount of $4,735,000. Below is a summary of the scope of work, implementation schedule and other relevant data related to each project: EXTERIOR: • Seven (7) new accessible ADA parking stalls • Provide code -compliant path of travel from ADA stalls to entry • Accessible pedestrian loading area at the Main Entry • Covered exterior bench seating at the Main Entry • Extend the west entry • New contemporary curtain wall at extended Main Entry • New vibrant wayfinding Canopy at Main Entry INTERIOR: • Remove and replace all interior walls Remove and replace all plumbing fixtures • Provide four (4) additional plumbing fixtures for both Men & Women at the Main Public Restrooms • Remove and replace all casework, shelving and finishes Provide four (4) "Quite Zone" Study Rooms Provide enlarged Literacy Room • Provide three (3) electronic Book Check Out stations Provide descriptive "Way Finding" directional signage, flooring and wall colors Provide The Studio (previously called the Colab) room with numerous data ports and collaborative white boards • Provide The Cave (previously called the Virtual Reality Lab) • Provide vibrant "Child Friendly" reading and activity area, which includes a raised interpretive platform and "Quiet Time" child reading area • Provide "Family" restroom with changing tables in the Children Area • Provide a new Cormack Room with raised telescoping bleacher seating • Provide Teen area reading counters with data ports • Provide two (2) "All Gender" toilet rooms and enhance break area for the staff • Provide new ductwork to existing mechanical units • Provide new concealed heads and lines to existing sprinkler system • New fire alarm system • New electrical system and Cat 6 cabling • New opening and spread footings to be provided in existing shear wall Construction related activities are anticipated to begin in August 2019 and to be complete in June 2020. Staff respectfully requests that the City Council award a construction contract in the amount of $4,735,000 to TELACU Construction Management for the City Library Modernization Project. The Estimated Project Cost Summary is attached to this report (Attachment B). AWARD A CONSTRUCTION CONTRACT TO TELACU FOR THE LIBRARY MODERNIZATION PROJECT (CIP NO. 19-20) JUNE 25, 2019 PAGE 3 Quality of Life, Infrastructure & Parks The total estimated cost of the project, including construction cost design, inspection, construction engineering and management services, material testing, temporary library facility, furniture and equipment, and contingencies is $6,968,272. The City's 2018-20 Capital Improvement Program includes the City Library Modernization Project utilizing Measure S Funds (Account No. 33-1-3303-0520).
