That the City Council authorize the City Manager to execute the extension of the
Memorandum of Understanding and related documents for the ASPIRE after school
program.
The ASPIRE (After School Program for Information Recreation Education) is an Aftel
School Education and Safety (ASES) grant funded program. It currently operates
twelve school sites and serves over 1,200 students per school day during the regul
schoolyear.
In collaboration with the City of Downey, the following 12 school sites have an ASPIRE
program on their site:
a. Carpenter, Sussman, Ward and Stauffer opened January 2001
b. Alameda and Gauldin opened January 2005
c. Griffiths, Lewis, Old River, Price, Unsworth, and Williams opened April 2001
The ASPIRE program operates Monday through Friday; from school dismissal until 6:00
pm. Components of the program include: homework assistance, snack, clubs, STEAM
(Science, Technology, Engineering, Art, Math), LitART elementary literacy program,
SPARK active recreation, character counts education, performing arts, and service
learning.

Per the Memorandum of Understanding between the City of Downey and the Downey
Unified School District, the District will reimburse the City for program costs. For the
2018-2019 fiscal year, the amount awarded was $1,762,062.94 and Tor the 20119-2020
school year, the estimated award amount will be $1,754,062.94. Funds will be assigned
to account number 104338 and no general funds will be utilized.

a California municipal corporation and charter city ("City"), entered into a Memorandum of
Understanding for the After School Program and Information Recreation and Education
Program (ASPIRE) ("MOU") on January 16, 2018 for a term commencing August 17, 2017
through May 31 2019. The parties wish to extend the MOU for an additional period to allow t
parties to review and negotiate modifications for a new Memorandum of Understanding for the
upcoming term of the ASPIRE Program.
By signing below, the parties hereby agree to extend the MOU for an additional six (6) months
or until November 30, 2019. All terms and conditions of the MOU dated January 16, 2018 shall
remain in full force and effect during the term of the extension.
Each of the undersigned represents that he/she is authorized and entitled to make, enter into
and execute this agreement on behalf of the party so executing it and that the terms described
herein are binding against the party on whose behalf he/she is executing this extension.
IN WITNESS WHEREOF, the parties have executed this extension effective on May 31, 2019.

Program ("ASPIRE"). The Parties to this MOU do hereby mutually agree to the
following:
The DUSD .. to:
1 . Assist with trainings of CITY staff as requested and share with the CITY,

2. Be the financial agent for the grant funds. Submit quarterly reports and budget to
the state ASSIST system.
3. Assign staff to serve as liaison between the District and the CITY's ASPIRE staff.
4. DUSD liaison to meet with CITY liaison on a quarterly basis and as needed.

Education's Quality Improvement Process for Expanded Learning.
12. Reimburse the CITY on a quarterly basis, with the funds received from the grant.

Annually review with the CITY the grant funds to see if supplemental funds are
necessary,

14. Schools that host the ASPIRE program will include the ASPIRE program in the
Emergency Operation Plan (EOP) and communicate emergencies while school is
still In operation and ASPIRE is on campus.
15. Share and communicate with the CITY the receipt of the grant award letter,
typically in September and also scheduled Federal Program Monitoring (FPM) for
Before and After School Programs (BASP).
The CITY agrees to:

3. Assign ASPIRE staff to serve as a liaison between the CITY and the ASPIRE
Program. CITY liaison to meet with DUSD liaison on a quarterly basis and as
needed. Liaison to provide input on the required ASPIRE Program Plan due
every two years, typically in January and collect after school program approval
signatures from the principals and superintendent,
4. Participate in Assess, Plan, and Improvement stages of the Department of
Education's Quality Improvement Process for Expanded Learning.
5. Establish and implement the recruitment and hiring procedure for all ASPIRE
staff. Provide supervision for ASPIRE staff. Manage the student enrollment
process through re -enrollment, open enrollment, and waitlist,
& Site Directors and Program Coordinators to meet with each principal of the
school site hosting ASPIRE, formally at the beginning and end of the school year,
as well as informally on a monthly basis with the principals or principal's
designated administration.
7. CITY staff to communicate to the principal it incidents with students and
parents, as well as 911 calls.
8. Track student attendance in ASPIRE and report and submit bi-annually to the
State's ASSIST system.

TERM -
This Memorandum of Understanding applies to all twelve ASPIRE sites and shall be
effective from August 17, 2017 – May 31, 2019. Should this MOU require modification,
such changes shall be made by mutual agreement by both parties below. This MOU
may be terminated by either party upon thirty (30) days wrltten notice.
1ADEMAIFICATION:
DUSD shall defend, indemnify, hold free and harmless CITY, its officers, officials,
employees, agents and volunteers from and against any and all damages to
property or injuries to or death of any person or persons, and shall defend, indemnify,
save and hold harmless CITY, its officers, officials, employees, agents and volunteers
from any and all claims, demands, suits, actions or proceedings of any kind or nature,
including, but not by way of limitation, all civil claims, workers' compensation claims,
and all other claims resulting from or arising out of the acts, errors or omissions of
DUSD, its officials, employees and/or authorized subcontractors and volunteers,
whether intentional or negligent, in the perfon-nance of this MOU.

claims resulting from or arising out of the acts, errors or omissions of CITY, its officials,
employees and/or authorized subcontractors and volunteers, whether intentional or
negligent, in the performance of this MOU.
The CITY will be responsible to fully comply with the provisions of the Education Code
Section 45125.1 for their employees who have contact with DISTRICT students in the
performance of the work of the Agreement,
IRSURANCE:
Additionally, both parties belong to a risk pool which provides liability coverage at leas
as broad as the following: I
1. Insurance Serviced Office Commercial General Liability coverage (occurrence
Form CG 00 01)
2. Insurance Services Officer Form Number CA 00 01 covering Automobile Liability,
Symbol 1 (any auto). Workers' Compensation insurance as required by the State
of California and Employees Liability Insurance,
