That the City Council introduce:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING PART 11 OF CHAPTER I OF ARTICLE III OF THE DOWNEY
MUNICIPAL CODE RELATED TO ESTABLISHING APP -BASED RIDESHARE
PARKING ZONES
Within the past few years, there has been a steady increase in the use of transportation network
companies that provide peer-to-peer ridesharing services which rely on internet and mobile
application (app) technology, such as Uber and Lyft, by patrons of businesses in the downtown area
primarily during late night hours on weekends. Currently, there are no designated passenger
loading/unloading zones within the downtown area to facilitate app -based rideshare services.
Therefore, the City desires to establish designated parking zones specifically for the loading and
unloading of passengers utilizing app -based rideshare services.
In order for these special parking zones to not adversely impact parking demand during daytime
hours when the demand for app -based rideshare services is low compared to its peak demand during
weekend night time hours, the parking restrictions associated with these special parking zones will
only be in effect during the peak demand for said rideshare services. Based on discussions with the
Police Department, the proposed hours and days when the special parking zones will initially be in
effect will be from 6 PM to 2 AM beginning Thursday evenings through the following Sunday
mornings. Since there currently is no provision in the Downey Municipal Code allowing the
establishment of these special parking zones, the adoption of the ordinance (Attachment A)
establishing said zones will be necessary. Thirty days following the adoption of the ordinance, the
special parking zones for app -based rideshare services will become effective upon the posting of
signs giving notice thereof.
Potential locations of these special parking zones will be on the south side of 2nd Street immediately
east of Downey Avenue. The proposed length of these special parking zones is 20 feet each (40 feet
total) and will be identified with signage stating, "APP BASED RIDESHARE PARKING ONLY — 5
MIN. PASSENGER LOADING/UNLOADING 6:00 P.M. TO 2:00 A.M. — ALL OTHERS SUBJECT TO
CITATION DMC 3197.1."

Initially, the City is proposing to install two (2) app -based rideshare parking zones in e ownown
area. The estimated cost of installing the special parking zones is $500. Sufficient funds are
budgeted in the Public Works Street Maintenance fund (account no. 10-4-3145) to support this
activity.

PARKING ZONES
WHEREAS, there has been a recent steady increase in the demand for app -based
rideshare services (i.e., Uber, Lyft, etc.) in the downtown area to provide transportation for
patrons of multiple businesses which operate during late night and early morning hours primarily
during weekends; and
WHEREAS, currently, there are no designated passenger loading/un loadingzones
within the downtown area nor other parking zones to facilitate app -based rideshare services;
and
WHEREAS, the city desires to establish` parking zones dedicated specifically for the use
of app -based ride -share services for the loading and unloading of passengers during times of
peak demand for such services while avoiding an impact upon the downtown parking supply
during other downtown businesses' off-peak demand hours; and
WHEREAS, currently there is no provision in the Downey Municipal Code which:
establishes said parking zones.
NOW, •RE, THE CITY COUNCIL OF OF DOWNEY DOES
ORDAIN AS FOLLOWS:
SECTION 1. Chapter 1 of Article III of the Downey Municipal Code is hereby amended
by adding a new subsection to read as follows:
The City Traffic Engineer is hereby authorized to establish designated parking
zones for the loading and unloading of passengers exclusively for app -based
rideshare services.
1. The term "app -based rideshare service", as used in this section, shall mean a
transportation network company providing peer-to-peer ridesharing services
which rely on internet and mobile application technology.
2. App -based rideshare parking zones shall be established by posting signs
designating the parking space(s) as an app -based rideshare parking zone
and specifying the days and hours during which the special parking zone is in
effect.
3. No person, except the driver of a vehicle clearly identified as a vehicle
providing an app -based rideshare service, shall stop, stand or park any
vehicle within an app -based rideshare parking zone while in effect.
SECTION 2. If any section, subsection, paragraph, sentence, clause or phrase of this
Ordinance is declared by a court of competent jurisdiction to be unconstitutional or otherwise
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance.
The City Council declares that it would have adopted this Ordinance, and each section,
subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or
more sections, subsections, phrases, or portions be declared invalid or unconstitutional

SECTION 3. The City Clerk shall certify the adoption of this Ordinance and cause the
same to be published in the manner prescribed by law.
