REGULAR MEETING
APRIL 23, 2019
The City Council of the City of Downey held a Regular City Council Meeting on April 23, 2019,
at 6:37 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Rodriguez presiding.

The Invocation was delivered by Pastor Alex Vargas. The Pledge of Allegiance was led by
Aaron, Madeline and Isaac Saldana.
COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS;
CONFERENCE/MEETING REPORTS
Council Member Saab welcomed the audience to the meeting. He recognized Michael
Calvert, Commissioner Nolveris Frometa, Scott Collins, and former Mayor Kirk Cartozian in the
audience. He reported attending the Library Volunteer Recognition Breakfast and thanked Director
Dickow and those involved in organizing the event. He reported attending the Mulch and Shredding
event and said it was well attended. He attended the Earth Day Tree Planting event, and the Downey
Police and Fire Foundation Luncheon. He recognized Lenora and Tony Perri of the Downey Lions Club
for their service to the community. He announced upcoming events: Carpenters' Tribute and Crimson
Chicken ribbon cutting event. He requested staff research and recommend Independent Cities Risk
Management courses for the Council to attend. He also requested staff research scheduling additional
Mulch and Shredding events throughout the year.
Council Member Frometa welcomed the audience to the meeting. She recognized the AYSO
Soccer Team, Commissioner Nolveris Frometa, Michael Calvert, former Mayor Kirk Cartozian, Virginia
Rivas, and Linda Saldana in the audience. She reported attending the Library Volunteer Recognition
Breakfast, Earth Day Tree Planting event, Downey First Baptist Easter Car Hopping event, and the
Downey Police and Fire Foundation Luncheon. She wished Chief Gillaspie a Happy Birthday. She
thanked Fire Chief Gillaspie and Police Chief Milligan for their work in the community. She announced
upcoming events: Carpenters' Tribute, Downey Symphony Gala, and Downey One Day of Service. She

invited the audience to attend the One Day of Service and announced there are approximately 400
community members committed to participating.
Council Member Ashton welcomed the audience to the meeting. He thanked the Library
volunteers for their service and announced their volunteer hours have saved the City over $200,000.
He reported attending the Library Volunteer Recognition Breakfast, Mulch and Shredding event, and
Keep Downey Beautiful Clean Up. He announced upcoming events: One Day of Service; Drug Take
Back; and, Coffee with your Council Member on Saturday May 11 at Vazza Cafe. He requested staff
contact Union Pacific Railroad to report excessive trash along the railroad tracks area; and, asked staff
return with an item to Council to increase fines for lighting of illegal fireworks.
Mayor Pro Tem Pacheco welcomed the audience to the meeting. She recognized
Marianna Pacheco in the audience. She reported attending the Brunch with the Bunny; Women's Club
of Los Cerritos Convention where she provided the opening remarks; Downey Council PTA Honorary
Awards; Governor Gavin Newsome's 100th Day in Office Press Conference at Rancho Los Amigos,
Downey Association of Realtors Luncheon, Library Volunteer Recognition Breakfast, Earth Day Tree
Planting event, and the Downey Police and Fire Foundation Luncheon. She reported attending the
Rotary Club of Downey's event and congratulated Council Member Saab for being recognized at the
event for his involvement with TLC. She participated in the Downey Unified School District's MADE
Mock Interview Day program. She thanked the Police Officers in the audience for their service. She
wished Fire Chief Gillaspie a Happy Birthday. She announced upcoming events: Kiwanis Casino
Night, Downey One Day of Service, Ricky Galvez Scholarship Gala at the Rio Hondo Event Center,
Downey Street Fair, Black Bear Diner's ribbon cutting, Soroptimist International Casino Night at the Rio
Hondo Event Center, and the Gangs Out of Downey's Cops and Kids event on May 11 at Golden Park.
Mayor Rodriguez thanked the audience for allowing him to sit in his seat on the Council. He
reported attending all the events mentioned by his colleagues. He reported attending the Educators'
Tour for the United States Army at Fort Sam Houston to review the medical core where they discussed
how the medical core benefits our youth in their pursuit to becoming medical professionals and achieve
a college degree in the medical field. He attended the Kiwins Banquet and was presented a collage of
students dating back to 2015.
PRESENTATIONS
1. Mayor Rodriguez presented the Mayor's Servant Heart Award to Linda Salomon Saldana.
2. Mayor Rodriguez with assistance from Council Member Saab presented Certificates of Recognition
to Downey AYSO GU14 Downey All Stars.
3. Mayor Rodriguez presented a Proclamation to former Mayor Kirk Cartozian and Mark Echmalian in
honor of Day of Remembrance of the Armenian Genocide.
4. Mayor Rodriguez with assistance from Chief Milligan presented Certificates of Recognition to
Downey Police Department Officers and Rano Seang, civilian for their heroic efforts on October 2,
2018.
5. Mayor Rodriguez with assistance from Council Member Ashton presented a Proclamation in honor
of Teacher Appreciation Week.
6. Mayor Rodriguez presented a Proclamation in honor of Volunteer Month.
7. Presentation to the City Council by Executive Director Yolanda Castro of Southeast Los Angeles
County Workforce Development Board.

RECESS/RECONVENE
Mayor Rodriguez recessed the City Council meeting at 7:53 p.m. Mayor Rodriguez reconvened
the City Council meeting at 8:02 p.m.
NON -AGENDA PUBLIC COMMENT
Armando Herman, resident, commented regarding political leaders, the treatment of the
homeless, and freedom of speech.
Michelle and Mark Brat commented regarding promoting the Carpenters' Tribute to fans coming
to the City of Downey. Mrs. Brat thanked the Council for their support. Mr. Brat commented that
Michelle Brat is now a U.S. Citizen and entertaining all over the world.
Monisha Brown, resident, commented regarding the County Sanitation Districts and their
management union reaching a labor agreement.
Having no one else come forward, Mayor Rodriguez closed public comment.

Mayor Rodriguez abstained from Item Nos. 4 and 7 due to the close proximity to his property;
and, Item Nos. 8, 11, and 16 due to close proximity to his place of business.
Mayor Rodriguez asked if there was anyone present who would like to comment on Consent
Calendar items.
Armando Herman, resident, commented regarding Item Nos. 3, 8, 16; claims against the City;
and, Americans with Disabilities.
Having no one else come forward, Mayor Rodriguez closed public comment.
It was moved by Council Member Saab, seconded by Council Member Frometa and carried
unanimously to approve the Consent Calendar with Mayor Rodriguez abstaining from Item Nos. 4, 7, 8,
11, and 16.
1. APPROVED MINUTES: Regular Meeting Minutes of April 9, 2019: City Clerk.
2. WARRANTS ISSUED: Warrant Nos. 332667 — 333029; Payroll Wire Nos. 30003862 — 30003862
and 30003868 — 30003870; Manual Wire Nos. 1827 — 1835; and, Cashier's Check Nos. 132 — 133,
in the total amount of $2,835,043.62: Finance.
3. AWARDED A CONSTRUCTION CONTRACT IN THE AMOUNT OF $2,175,910 TO HARDY &
HARPER, INC. FOR THE FY 2018/2019 RESIDENTIAL STREETS PAVEMENT
REHABILITATION; AUTHORIZED THE PUBLIC WORKS DIRECTOR/CITY ENGINEER TO
EXECUTE ANY CHANGE ORDERS OR ADDITIONAL SCOPE OF WORK DEEMED
NECESSARY OR DESIRABLE UP TO THE APPROVED PROJECT BUDGET (CAPITAL
IMPROVEMENT PROJECT NO. 19-13): Public Works.
4. AWARDED A CONSTRUCTION CONTRACT, IN THE AMOUNT OF $91,440 TO HUNTINGTON
BEACH ELECTRIC, FOR THE FIRE STATION MODERNIZATION PROJECT/TEMPORARY FIRE
STATION ELECTRICAL IMPROVEMENTS; AUTHORIZED THE ASSISTANT CITY MANAGER
TO NEGOTIATE A CHANGE ORDER WITH HUNTINGTON BEACH ELECTRIC TO EXPAND

THE SCOPE OF WORK RELATED TO THE TEMPORARY LIBRARY FACILITY; AND,
AUTHORIZED THE CITY MANAGER TO EXECUTE ANY CHANGE ORDERS OR ADDITIONAL
SCOPE OF WORK DEEMED NECESSARY OR DESIRABLE UP TO $9,1440 (CAPITAL
IMPROVEMENT PROJECT NO. 19-37A): Administration.
5. APPROVED PLANS AND SPECIFICATIONS AND AUTHORIZED SOLICITATION FOR
CONSTRUCTION BIDS FOR FIRESTONE BLVD. MEDIAN ISLAND IMPROVEMENTS PROJECT
FROM OLD RIVER SCHOOL RD. TO THE WEST CITY LIMIT (CAPITAL IMPROVEMENT
PROJECT NO. 15-14): Public Works.
6. APPROVED PLANS AND SPECIFICATIONS AND AUTHORIZED SOLICITATION FOR BIDS
FOR WOODRUFF AVE. FIBER-OPTIC TRAFFIC SIGNAL COMMUNICATION SYSTEM AND
UPGRADES; AND, AUTHORIZED PROCUREMENT OF CITY -FURNISHED MATERIALS FOR
THE PROJECT (CAPITAL IMPROVEMENT PROJECT NO. 17-06): Public Works.
7. ACCEPTED THE COMPLETION OF THE FIRE STATIONS MODERNIZATION PROJECT/
TEMPORARY FIRE STATION; APPROVED THE FINAL CONSTRUCTION CONTRACT
AMOUNT OF $249,694.49; AND, AUTHORIZED THE NOTICE OF COMPLETION TO BE FILED
WITH THE COUNTY OF LOS ANGELES RECORDER'S OFFICE (CAPITAL IMPROVEMENT
PROJECT NO. 19-37): Administration.
8. APPROVED THE FUNDING AGREEMENT WITH THE LOS ANGELES COUNTY
METROPOLITAN TRANSPORTATION AUTHORITY (METRO) PROVIDING $2,277,933 IN
PROPOSITION C 25% GRANT FUNDING FOR THE IMPLEMENTATION OF THE DOWNEY
BIKE MASTER PLAN PHASE 1 - DOWNTOWN/TRANSIT CLASS II PROJECT; AND,
AUTHORIZED THE CITY MANAGER TO EXECUTE THE AGREEMENT AND ANY FUTURE
AMENDMENTS (CAPITAL IMPROVEMENT PROJECT NO. 19-14): Public Works.
9. AWARDED A CONTRACT IN THE AMOUNT OF $282,425 TO QUALITY ENVIRONMENTAL
INC., FOR THE ASBESTOS CONTAINING MATERIALS (ACM) ABATEMENT FROM CERTAIN
CITY FACILITIES; AND, AUTHORIZED THE CITY MANAGER TO EXECUTE ANY CHANGE
ORDERS OR ADDITIONAL SCOPE OF WORK DEEMED NECESSARY OR DESIRABLE UP TO
10% OF THE CONTRACT AMOUNT: Administration.
10. APPROPRIATED $3,000 FROM THE GENERAL FUND TO PURCHASE SUPPLIES FOR THE
GIRLS ON FIRE SUMMER PROGRAM SCHEDULED FOR JULY 29 — JULY 31, 2019:
Administration.
11. APPROVED THE SUBLEASE AGREEMENT BETWEEN THE CITY OF DOWNEY AND PPCP
IRG DOWNEY, LLC. AND IRG DOWNEY, LLC.; AND, AUTHORIZED THE CITY MANAGER TO
EXECUTE THE SUBLEASE AGREEMENT: Administration.
12. APPROVED A PROFESSIONAL SERVICES AGREEMENT WITH CONSERVATION CORPS OF
LONG BEACH FOR LITTER ABATEMENT SERVICES; AUTHORIZED THE MAYOR TO
EXECUTE THE AGREEMENT; AND, AUTHORIZED THE CITY MANAGER TO EXECUTE ANY
AMENDMENTS DEEMED NECESSARY: Public Works.
13. APPROVED A PROFESSIONAL SERVICES AGREEMENT TO DESIGN, FABRICATE AND
INSTALL PUBLIC ART IN THE FUTURE RENOVATED DOWNEY THEATER PLAZA WITH J.K.
DESIGNS, INC. (DBA: THE NATIONAL SCULPTOR'S GUILD); AND, AUTHORIZED THE CITY
MANAGER TO EXECUTE ANY AND ALL AMENDMENTS: Community Development.
14. APPROVED PROFESSIONAL SERVICES AGREEMENTS WITH TRANSTECH ENGINEERS,
INC., AND JAS PACIFIC, INC. FOR PROFESSIONAL PLAN REVIEW AND AS NEEDED

INSPECTION SERVICES; AND, AUTHORIZED THE CITY MANAGER TO EXECUTE ANY AND
ALL AMENDMENTS: Community Development.
15. APPROVED A PROFESSIONAL SERVICES AGREEMENT TO PROVIDE FINANCIAL, REAL
ESTATE AND ECONOMIC CONSULTING SERVICES FOR AN AMOUNT NOT TO EXCEED
$50,000 WITH TIERRA WEST ADVISORS, INC.; AND AUTHORIZED THE CITY MANAGER TO
EXECUTE ANY AND ALL AMENDMENTS TO THE AGREEMENTS: Community Development.
16. AUTHORIZED THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE FUNDING
AGREEMENT WITH THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION
AUTHORITY (METRO) FOR THE PARAMOUNT BLVD. AT FIRESTONE BLVD. INTERSECTION
IMPROVEMENT PROJECT (CAPITAL IMPROVEMENT PROJECT NO. S.S. 60513): Public Works.
17. AUTHORIZED THE MAYOR TO ENTER INTO A MASTER SERVICE AGREEMENT WITH
TUTOR.COM IN ORDER TO PROVIDE LIVE, ONE-ON-ONE, ONLINE TUTORING SERVICES TO
DOWNEY LIBRARY CARD HOLDERS, EXPANDING THE CITY'S DIGITAL RESOURCES FOR
THE PUBLIC: Library.
18. APPROVED AN AGREEMENT WITH BRODIN STUDIOS IN THE AMOUNT OF $45,000 TO
DESIGN AND FABRICATE A FIRE MEMORIAL STATUE WORK OF PUBLIC ART; AND,
AUTHORIZED THE MAYOR TO EXECUTE THE AGREEMENT: Fire.
19. AUTHORIZED PRE -QUALIFICATION OF BIDDERS FOR THE WILDERNESS PARK PONDS
RESTORATION PROJECT: Administration.
ADOPTED RESOLUTION NO. 19-7879, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY TO ESTABLISH PRE -QUALIFICATION OF BIDDERS PROCEDURES
FOR THE WILDERNESS PARK PONDS RESTORATION PROJECT INCLUDING THE FORM
OF A PRE -QUALIFICATION QUESTIONNAIRE; A UNIFORM SYSTEM OF RATING
BIDDERS; AN APPEAL PROCEDURE AND IMPANELING THE ASSISTANT CITY
MANAGER TO THE APPEALS PANEL; AND, SUCH OTHER DOCUMENTS AS

20. ADOPTED RESOLUTION NO. 19-7880, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY EXPRESSING SUPPORT FOR THE 2020 U.S. CENSUS: Administration.
21. ADOPTED RESOLUTION NO. 19-7881, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY APPROVING THE LIST OF PROJECTS IN THE PROPOSED FY 2019/2020
CAPITAL IMPROVEMENT PROGRAM TO BE FUNDED BY SENATE BILL 1 (SB1), THE ROAD
REPAIR AND ACCOUNTABILITY ACT: Public Works.
22. ADOPTED ORDINANCE NO. 19-1409, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE, ARTICLE VII ("STREETS AND
PUBLIC WORKS"), CHAPTER 1 ("STREETS"), TO ADD PART 6, "WIRELESS FACILITIES IN
RIGHT-OF-WAY": Public Works.
23. APPROVED THE DOWNEY CHAMBER OF COMMERCE STREET CLOSURE PERMIT
APPLICATION FOR BROOKSHIRE AVE. FROM FIRESTONE BLVD. TO 5T" ST. FOR THE
CHAMBER'S ANNUAL STREET FAIRE TO BE HELD ON MAY 4, 2019: Administration.
24. APPROVED THE FEE WAIVER FOR USE OF THE SNOWMOBILE AT THE 2019 ANNUAL
RELAY FOR LIFE COMMUNITY EVENT SPONSORED BY THE DOWNEY ADULT SCHOOL:

25. APPROVED THE FEE WAIVER FOR USE OF THE SHOWMOBILE AT THE KIDS AND COPS
DAY ORGANIZED BY GANGS OUT OF DOWNEY ON MAY 11, 2019 AT GOLDEN PARK: Mayor
Pro Tem Pacheco.
26. APPROVED THE DONATION OF ONE FOURSOME OF GOLF AT THE RIO HONDO GOLF
COURSE IN SUPPORT OF THE 10-20 CLUB INC: Council Member Saab.
