Minutes - 03-26-19 - Special MeetingMINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY SPECIAL MEETING MARCH 26, 2019 The City Council of the City of Downey held a Special City Council Meeting on March 26, 2019, at 5:32 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Rodriguez presiding. PRESENT: Council Members: Rick Rodriguez Blanca Pacheco Sean Ashton Claudia Frometa Alex Saab Mayor Mayor Pro Tem Council Member Council Member Council Member ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Alicia Duarte, CMC, City Clerk APPROVED CLOSED SESSION MINUTES It was moved by Council Member Ashton, seconded by Mayor Pro Tem Pacheco, and so ordered by Mayor Rodriguez to approve the Closed Session Minutes of March 12, 2019. RECESSED TO CLOSED SESSION Mayor Rodriguez announced the City Council is recessing to Closed Session at 5:33 p.m. to discuss matters under the authority of the following section of the Government Code: Conference with Legal Counsel - Initiation of Litigation -Government Code section 54956.9(d)(4): One (1) Potential Matter. RECONVENED CLOSED SESSION The Special City Council meeting reconvened in Open Session at 6:31 p.m. with all Council Members present. City Attorney Abich Garcia reported the closed session report as follows: In regards to Item No. 1, the initiation of litigation in one case, following discussion by the City Council, legal counsel was authorized to initiate civil action on behalf of the City of Downey against the State of California and the Bureau of Cannabis Control. The details of the civil action once formally commenced shall be disclosed to any person upon inquiry. There was a motion made by Mayor Rodriguez, seconded by Council Member Frometa and passed 5-0, with no one opposed to the initiation of litigation.
