RECOMMENDATION
That the City Council:
1. Award a construction contract in the amount of $5,694,775.00 to C.S. Legacy
Construction, Inc. for the Apollo Park Improvements Project and Dennis the
Menace Park Improvements Project, CIP No. 19-28 and CIP No. 19-29, and
2. Authorize the City Manager to execute any change orders or additional scope of
work for this project deemed necessary or desirable up to 10% of the
construction contract amount.
At its meeting of January 22, 2019, the City Council approved the plans and
specifications and authorized solicitation of bids for the subject project. On January 31,
2019, and February 7, 2019, the Notice Inviting Bids for this project was published in the
Downey Patriot.
On February 20, 2019 an addendum was issued changing the bid opening date to
March 13, 2019 at 11:00 am. On March 13, 2019, the City Clerk received and publicly
opened six (6) bids which ranged from $5,694,775 to $8,295,692, as shown on the
attached bid summary (Attachment 1). Upon opening the bid received from Fast -Track
Construction Corporation, the City Clerk noted that the numeric and written total bid
amount did not match and verbally asked for clarification. The Fast -Track Construction
Corporation representative confirmed the use the written amount for the bid recordation.
The lowest responsive and responsible bidder is C.S. Legacy Construction, Inc. of
Ontario, California with a bid in the amount of $5,694,775. Staff has confirmed that C.S.
Legacy Construction, Inc. possess the specified contractor license and that the license
is current and in good standing. Additionally, verbal qualification interviews with

randomly selected C.S. Legacy Construction, Inc.'s references were completed and the
responses were all satisfactory.
Below is a summary of the scope of work, implementation schedule and other relevant
data related to each project:
•Existing restroom improvements
•Parking lot ADA improvements
+Synthetic turf at athletic Fields 1 and 2
*ADA accessible path of travel to new amenities

*Irrigation system upgrades
•Six (6) new picnic shelters
*Rubberized surfacing at play area
•Removal of shuffleboard court and replace with synthetic turf
*Two (2) 12x20 storage sheds
•Parking lot lighting at west lot
*Ballfield lighting at practice Field 1 and Field 2
*Construction of trash enclosure
*New backstops at practice Fields 2 and 3 new back stop fencing fabric at Field 1
*Site furnishings, picnic tables, BBQs, benches, trash receptacles, and drinking
fountain
DENNIS THE MENACE PARK IMPROVEMENTS
*New community restroom building
*Rubberized surfacing at play area
*New all challenge fitness course
•Irrigation system adjustment
*Site built trash enclosure
*Parking lot ADA improvements
*Site furnishings, benches, and drinking fountain
Staff respectfully requests that the City Council award a construction contract in the
amount of $5,694,775 to C.S. Legacy Construction, Inc. for the Apollo Park
Improvements Project and Dennis the Menace Park Improvements Project.
Construction will start on May 1, 2019 and be completed on November 15, 2019. The
Estimated Project Cost Summary is attached to this report (Attachment 3).

Quality of Life, Neighborhood & Infrastructure
The total estimated cost of the project, including construction costs (based on the
construction bid amount and contingencies, design, inspection, construction engineering
and management services and material testing) is $7,296,825.00. The City's 2018-20
Capital Improvement Program includes the Apollo Park Improvements Project and
Dennis the Menace Park Improvements Project utilizing Measure S Funds (Account
Numbers 33-1-3320-0520 and 33-1-3330-0520).
