PRESENT: Council Members: Rick Rodriguez Blanca Pacheco Sean Ashton Claudia Frometa Alex Saab Mayor Mayor Pro Tem Council Member Council Member Council Member ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Alicia Duarte, CMC, City Clerk It was moved by Council Member Saab, seconded by Council Member Ashton, and so ordered by Mayor Rodriguez to approve the Closed Session Minutes of January 22, 2019. i • • Mayor Rodriguez announced the City Council is recessing to Closed Session at 5:32 p.m. to discuss matters under the authority of the following section of the Government Code: City Attorney Abich Garcia announced Item Nos. 2 & 3 would be removed from the Closed Session Agenda. 1. Government Code Section 54957.6 - Conference with Labor Negotiators John Oskoui, Assistant City Manager and Mike Harary, Director of Human Resources regarding Labor Negotiations with the Downey Police Management Association. 2. Conference with Legal Counsel - Initiation of Litigation — Government Code Section 54956.9(4)(4): One (1) Potential Matter. 3.. Conference with Legal Counsel: Anticipated Litigation- (Gov. Code § 54956.9 (d)(2) and Gov. Code § 54956.9(e)(1)): A point has been reached where in the opinion of the City Council on the advice of its legal counsel, there is a significant exposure to litigation against the City. Facts and circumstances that might result in litigation, but which the City believes are not yet known to potential plaintiff or plaintiffs which facts need not be disclosed: Three (3) Potential Cases.
