MORATORIUM ON MASSAGE THERAPY ESTABLISHMENTS: Community Development. 1) Receive and file the report on actions taken to alleviate conditions that led to the adoption of an urgency ordinance; and, 2) Adopt by a 4/5th vote the following titled interim urgency ordinance: ADOPT ORDINANCE NO. 18-______. AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXTENDING INTERIM URGENCY ORDINANCE NO. 18-1399 FOR AN ADDITIONAL 10 MONTHS AND 15 DAYS THEREBY CONTINUING A TEMPORARY MORATORIUM ON NEW AND EXPANDING EXISTING MASSAGE THERAPY ESTABLISHMENTS. NON-AGENDA PUBLIC COMMENT This portion provides an opportunity for the public to address the Council on items within the jurisdiction of the Council and not listed on the agenda. It is requested, but not required, that you state your name, address and subject matter upon which you wish to speak. Please limit your comments to no more than 5 minutes. Pursuant to the Brown Act, no discussion or action, other than a brief response, referral to the City Manager/staff or schedule for a subsequent agenda, shall be taken by the Council on any issue brought forth under this section. CONSENT CALENDAR All matters listed on the Consent Calendar are to be approved with one motion unless a Council Member request an item be removed. Removed items will be considered following approval of the Consent Calendar. 2. APPROVE MINUTES: Special Meeting of October 23, 2018; and, Regular Meeting of October 9, 2018: City Clerk. 3. WARRANTS ISSUED: Warrant Nos. 328296 – 328920; Payroll Wire Nos. 30003811, and 30003813 – 30003816; and, Manual Wire Nos. 1756 – 1767; in the total amount of $5,892,285.14: Finance. 3 4. ACCEPT THE RESIDENTIAL STREET PAVEMENT REHABILITATION PROJECT AS COMPLETE; APPROVE THE FINAL CONSTRUCTION CONTRACT AMOUNT OF $1,747,405.66; APPROVE THE CARRY-FORWARD APPROPRIATION AMOUNT OF $502,765 IN VEHICLE IMPACT FEE FUNDS BUDGETED IN THE FY 2017/18 CAPITAL IMPROVEMENT PROGRAM (CIP); AUTHORIZE TRANSFER OF $24,110 OF VEHICLE IMPACT FEE FUNDS BUDGETED IN THE FY 2018/19 CIP FROM ACCOUNT NO. 38-1-6764 TO ACCOUNT NO. 38-1-6717 TO COVER THE TOTAL PROJECT COST SHORTFALL; AND, AUTHORIZE THE PUBLIC WORKS DIRECTOR TO FILE THE NOTICE OF COMPLETION (CAPITAL IMPROVEMENT PROJECT NO. 18-02): Public Works. 5. APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH WECK ANALYTICAL ENVIRONMENTAL SERVICES, INC., DBA WECK LABORATORIES, INC., IN THE AMOUNT OF $86,130 FOR ANALYTICAL LABORATORY TESTING SERVICES FOR A PERIOD OF TWO YEARS WITH AN OPTION TO RENEW FOR AN ADDITIONAL TWO YEARS; AUTHORIZE THE MAYOR TO EXECUTE THE AGREEMENT; AND, AUTHORIZE THE CITY MANAGER TO EXECUTE ANY AND ALL AMENDMENTS TO THE AGREEMENT AS DEEMED NECESSARY UP TO 15% OF THE PROGRAM BUDGET: Public Works. 6. AUTHORIZE THE FIRE CHIEF TO EXECUTE AN AGREEMENT WITH THE COUNTY OF LOS ANGELES FOR THE DISBURSEMENT OF THE 2017 STATE HOMELAND SECURITY (SHSGP) GRANT FUNDS; AND, ACCEPT AND APPROPRIATE $323,584 OF 2017 SHSGP FUNDS: Fire. 7. APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH DUDEK IN THE AMOUNT OF $101,655 FOR PREPARATION OF THE URBAN FOREST MANAGEMENT PLAN (UFMP); APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH BLAIS AND ASSOCIATES IN THE AMOUNT OF $10,900 FOR THE CALFIRE GRANT ADMINISTRATION SERVICES; AUTHORIZE THE MAYOR TO EXECUTE PROFESSIONAL SERVICES AGREEMENT WITH DUDEK; AUTHORIZE THE MAYOR TO EXECUTE PROFESSIONAL SERVICES AGREEMENT WITH BLAIS AND ASSOCIATES; AND, AUTHORIZE THE CITY MANAGER TO EXECUTE ANY AND ALL AMENDMENTS TO BOTH AGREEMENTS: Public Works. 8. ADOPT RESOLUTION NO. 18-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING MEMBERSHIP WITHIN THE LOS ANGELES AREA REGIONAL TRAINING GROUP (RTG) JOINT POWERS AUTHORITY; APPROVE THE LOS ANGELES AREA REGIONAL TRAINING GROUP (RTG) JOINT POWERS AGREEMENT (JPA); AND, AUTHORIZE THE CITY MANAGER TO EXECUTE THE JPA AGREEMENT AND TO TAKE SUCH REASONABLE ACTIONS AS MAY BE REQUIRED TO IMPLEMENT THE INTENT OF THE AGREEMENT: Fire. 9. ADOPT RESOLUTION NO. 18-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS OF THE HUMAN RESOURCES DEPARTMENT: Human Resources. 10. ADOPT RESOLUTION NO. 18-______, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING THE CITY MANAGER, OR HIS OR HER DESIGNEE, TO ACT AS THE CITY’S REPRESENTATIVE ON THE DOWNTOWN DOWNEY IMPROVEMENT ASSOCIATION BOARD; APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A MAN AGEMENT AND DISBURSEMENT AGREEMENT WITH THE DOWNTOWN DOWNEY IMPROVEMENT ASSOCIATION, AND DESIGNATE A CITY REPRESENTATIVE: Community Development. 4 11. Turner, killed in the line of duty; Fire Chief Tom Henrich, of Earling Fire and Rescue Department, killed in the line of duty; William “Bill” Menighan, City of Downey Department of Public Works employee; City of Bellflower Council Member Ron Schnableggar; Eduardo Zarate, father of City of Downey employee, Melissa Villaseñor-Galvan; Fire Capt. Mike Kreza of the Costa Mesa Fire Department; Major Brent R. Taylor, 39, from Ogden, Utah who was supporting Operation Freedom’s Sentinel; California Highway Patrol Sgt. Ron Helus, killed in the line of duty; victims of the shooting at the Tree of Life Congregation in Pittsburgh, PA; and, victims of the mass shooting in Thousand Oaks.
