SPECIAL MEETING
AUGUST 14, 2018
The City Council of the City of Downey held a Special City Council Meeting on August 14, 2018,
at 5:32 p.m., in the CouncilChamberof the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Ashton presiding.

PUBLIC COMMENT
Mayor Ashton opened the meeting for Public Comment. Having no one come forward, Mayor
Ashton closed Public Comment.
RECESSED TO CLOSED SESSION
Mayor Ashton announced the City Council is recessing to Closed Session at 5:34 p.m. to
discuss matters under the authority of the following sections of the Government Code:
1. Government Code Section 54956.9(4)(1) Pending Litigation: Williams v. City of Downey, et.al.,
Los Angeles Superior Court, Case No. BC617195.
2. Government Code Section 54956.9(d)(1) — Pending Litigation: Department of Finance v.
Commission on State Mandates, Los Angeles Superior Court Case No. BS 130730.
The Special City Council meeting reconvened in Open Session at 6:38 p.m. with all Council
Members present.
City Attorney Abich Garcia reported the closed session report as follows: In regards to Item No.
1, the City Council gave direction to its legal counsel but no formal action was taken. In regard to Item
No. 2 the City Council in Closed Session authorized its legal counsel to file an appeal in the pending
litigation matter of Department of Finance v. Commission on State Mandates, Los Angeles Superior
Court Case No. BS130730, the appeal will be filed against State of California Department of Finance on
behalf of the City of Downey. It was moved by Mayor Pro Tem Rodriguez, seconded by Council
Member Pacheco and passed unanimously with Council Member Saab excused to authorize the City's
legal counsel to file the appeal.
