In May of 2017, the City of Downey allowed the Downey Unified School District to test a pilot program wherein students at Downey High School could use their school ID as a limited -use library card, called the Downey One Card, at the Downey City Library. Students registered for the One Card at their school. Library staff processed 209 applications, which granted students access to Library resources; an additional 100 students applied only to discover that they already had an account with the Downey City Library. Some of these students, newly aware of their Library card, began to use the library more than they had. The Downey One Card pilot program was successful in its goal to improve access to Library resources for Downey High School students. Following the success of the pilot in school year 2017/2018, Library staff recommended expanding the program to include students at Warren High School. Garcia, Jr., Ph.D. their student ID card to access the Downey City Library materials. Tom Houts, Principal, Downey High School Martha Ortiz, Librarian, Downey High School MEMORANDUM OF r D BETWEEN THE CITY OF DOWNEY AND THE DOWNEY UNIFIED SCHOOL DISTRICT This Memorandum of Understanding ("MOU") is made and entered into on this 31 day of May, 2018 by and between the City of Downey, acting by and through the Downey City Library ("Library") located at 11121 Brookshire Avenue, Downey, CA 90241 and Downey Unified' School District, located at 11627 Brookshire Avenue; Downey, CA 90241. Both Library and DUSD may be referred to herein as the "Party" and collectively as the "Parties". WHEREAS, the mission of the Library is to provide free and easy access to information, ideas, books and technology that can help enrich, educate and empower the lives of every individual within the various and diverse communities of the City of Downey; WHEREAS, the vision of DUSD are that every student receive an education in a safe, caring environment and that every student be college -prepared and career ready; and WHEREAS, President Obama's 2013 ConnectED initiative strives to enrich the education and opportunities of every K-12 student through partnerships and cooperation; and WHEREAS, in April 2015, the White House launched the ConnectED Library Challenge, in which libraries and schools are encouraged to build partnerships to ensure that every _child receives a library card; and WHEREAS, Library and DUSD wishes to collaborate on the Downey One Card Pilot Program ("Pilot Program") wherein Downey High School and Warren High School students will be able to access Library materials using their DUSD identification card (the "Downey One Card"), and to provide parents or legal guardians an opportunity to opt -out their child from the Library's services through the DUSD registration process. NOW, THEREFORE, in consideration of the terms, covenants and conditions hereinafter contained to be kept and performed by the respective Parties, the Parties agree to the following: 1 1. Term, Termination. The term of this MOU shall begin August 1, 2018 and continue until or Unless either party terminates this MOU pursuant to this paragraph 1. The term of this Agreement may be extended in writing signed by both parties. Either party may terminate this MOU with or without cause at any time during the term of this MOU with 30" days' prior written notice to the other party. This MOU, is to memorialize the Program between the Library and DUSD for the purpose of improving access to Library resources for Downey High School and Warren High School students and the sharing of services and resources available through the Library's integrated library system (ILS). The parties may extend the Library privileges described in this MOU to additional schools in DUSD upon written amendment to this MOU signed by both parties 3. DUSD Identification Card as Libra Card: a. Library will accept a student's Downey High School or Warren High School identification card (ID) as a Downey City Library card (also known as the "Downey One Card"). b. Students will bring their ID and register at the Library located at 11121 Brookshire Avenue, Downey, CA 90241 to activate Library privileges. C. The ID will provide students access to books and audio books. The ID will also allow students to access all online databases of the Library. This includes E -book, E -audio and E -magazine access and use of the Library's computer lab. CDs, DVDs, Blu-Ray discs and laptops may not be checked out using the ID. Students will also be able access all online databases at the Library from an off-site location via the internet. d. Students will be allowed to check out up to 3 items at one time. e. Opt -out forms will be included with the DUSD registration packet before the start of the school year for Downey High School and Warren High School. Parents and legal guardians who do not want their children to access library materials shall sign and return the opt -out form to DUSD with their registration forms DUSD are solely responsible for transmitting the opt -out forms to the Library in a timely manner. Library will not be responsible for non - receipt of opt -out forms and for extending library privileges to a student whose parent or legal guardian signed an opt -out form. f. Students using their ID will be responsible for overdue fines and other fees as set forth in Library's Borrowing Policies. 2 4. DUSD Onstatin Pes onsitailities a. DUSD will distribute information about the Pilot Program and include a form which will allow a parent or legal guardian to opt -out their child from accessing Library materials. b. DUSDs' Teacher Librarians will work with the Library to facilitate the delivery of student opt -out forms to the Library on a regular schedule. DUSD will deliver opt -out forms to the Library's Youth Services Supervising Librarian as they are submitted by parents and guardians to DUSD. C. Work jointly with Library to provide training and information to DUSD teachers and administrators regarding the Pilot Program. d. Provide evaluation and feedback to the Library and assist with obtaining feedback from DUSD teachers, administrators, students and their families or legal guardians regarding the Pilot Program. e. Work jointly with the Library's public information representative to promote the Downey One Card and other Library services, promotions and events. The Parties will ensure that promotional materials include language that states: "Downey Unified School District in collaboration with the Downey City Library". f. Upon request from Library, DUSD will deliver Library notices to students. 5. Libra s O statin Res onsibilities: a.- Library will allow Downey High School and Warren High School students who present their current year school ID to checkout library materials pursuant to the terms and conditions set forth in this MOU. b. Library will assign staff to work with DUSD staff to facilitate the delivery of opt -out forms. Library will ensure that information about students without permission to access Library collections will be used exclusively to ensure compliance with the opt -out instructions submitted by parents and legal guardians. C. All Library rules and policies (i.e., Rules of Conduct, Borrowing Policies) will apply to students using an ID card. d. The Library agrees that all registration and circulationrecords of Library will remain confidential in accordance with the California Public Records Act and any other applicable statutes and will not be disclosed, except to comply with a court order, subpoena or in accordance with the California Government Code Sections 6254 and 6267. The Library will not use the student data, -except for regular library business associated with this Program and to 3 comply with this MOU. 6. Notices. Public Bntity hlolg lr€less` Pursuant to the provisions of Section 894.4, et seq.,-of the California Government Code, each Party agrees to indemnify and hold the other harmless from all loss or liability for injury or damage, actual or alleged, to person or property arising out of or resulting from the indemnifying Party's acts or omissions in the performance of this MOU. The provisions of California Civil Code Section 2778 regarding interpretation of indemnify agreements are hereby incorporated by reference into this section. 8. Assignment and Celeanon. Neither party may assign any of its rights or duties under this MOU or delegate, subcontract, or otherwise transfer any of its duties under this MOU, unless evidenced by a written amendment to this MOU executed by both Parties. 9. Com liance with Law : The Parties shall comply with all applicable laws in performing its obligations under this MOU. 10. Entire Agreement. This shared agreement between Downey High School and Downey City library will allow your child to access electronic resources and public library materials at the Downey City Library. Only DHS students will register at the Downey City Library with their school's student Identification number as a library card to access online resources including, but not limited to, ebooks, audiobooks, magazines and printed materials. Students who already have a standard Downey City Library Card must continue to use that card and will not be permitted to check out items using their student ID at Downey City Library. Students and parents/guardians must abide to the following: Supervision of a minor child's access to all books and media is the parent/legal guardian's responsibility. The library does not restrict access to any materials of an adult nature. - Student can check out 3 items at a'time Student will not be able to checkout DVD's or CD's with the school Identification card - Per California Public Records Act (Government Code Section 6267), Library staff is unable to give any information regarding a library account to anyone other than the cardholder on the library account regardless of age or relationship to the patron. Each student is responsible for returning library materials on time. Fines for overdue, damaged, or lost materials are the responsibility of the registered card holder. Library cards/ student identification cards are not transferable and lost or stolen cards should be reported to the library and the school librarian immediately. Your child can register at Downey City Library at the beginning of the school year unless notified before August 14,2018 with this opt out form.
