PAVEMENT REHABILITATION PROJECT — AWARD CONSTRUCTION
That the City Council:
1. Award construction contract, in the amount of $1,808,000.00, to Hardy & Harper,
Incorporated for the Residential Street Pavement Rehabilitation Project, Capital
Improvement Project No. 18-02, and
2 Authorize Transfer of $70,000 from Measure R Local Return funds and $17,000 of
Vehicle Impact Fee funds budgeted in the FY 2017/18 Capital Improvement
Program and $263,000 of Vehicle Impact Fee funds budgeted in the FY 2018/19
Capital Improvement Program to cover the project cost shortfall; and
3. Authorize the Public Works Director to execute any change orders or additional
scope of work for this project deemed necessary or desirable up to the approved
project budget.
At its meeting of March 27, 2018, the City Council approved the plans and specifications and
granted authority to advertise for bids for the subject Residential Street Pavement Rehabilitation
Project. On May 24 and May 31, 2018, respectively, this project was advertised in the Downey
Patriot and published in various trade publications. On June 14, 2018, the City Clerk received
and publicly opened seven (7) bids ranging from $1,808,000 to $2,295,632 as shown on the
attached bid summary. The lowest responsive and responsible bidder is Hardy & Harper,
Incorporated of Santa Ana, California with a bid of $1,808,000. Staff reviewed the bid proposal
and references provided by Hardy & Harper and found that said contractor has satisfactorily
completed similar projects for the City of Downey and numerous other Cities such as Pasadena
Westminster and Colton. Hardy & Harper's State of California Contractor's License is "current
and active". In addition, Hardy & Harper and their subcontractors are registered with the
California Department of Industrial Relations under the Public Works Contractor Registration
Program for Labor Compliance.
This project consists of the rehabilitation of twenty-seven (27) residential street segments with a
total length of approximately 27,779 feet (5.26 miles). The work to be completed under this
project generally consists of the reconstruction of failed pavement areas, removal and
reconstruction of asphalt concrete base course adjacent to concrete gutters, cold milling of

-asphalt pavement, and the placement of an asphalt concrete leveling course and an asphalt -
concrete overlay. In addition, uplifted, damaged or substandard curb, gutter, cross gutters,
sidewalk, driveway approaches and curb ramps will be repaired or replaced. Furthermore, the
existing speed humps on Ardis Avenue between Angell Street and Foster Road will be
reconstructed through this project.
Staff recommends that the City Council award a construction contract, in the amount of
$2,200,000, to Hardy & Harper, Inc. for the construction of the Residential Street Pavement
Rehabilitation Project. Construction is anticipated to begin in July 2018, and be completed in
October 2018.
This project is categorically exempt from the provisions of CEQA under Section 15301(c),
Existing Facilities.
The total estimated cost of the project, including construction costs and contingencies, design,
contract administration, inspection, construction engineering and management services,
material testing and tree work is $2,200,000.
Approximately $389,235 in Gas Tax funds in Account No. 30-1-6717, $400,000 in Measure R
funds in Account No. 56-1-6717 and $1,060,765 in Vehicle Impact Fee funds in Account No. 38-
1-6717 are available for this project in the FY 2017/18 Capital Improvement Program.
Additional funds in the amount of $350,000 are required to cover the total project cost.
Therefore, staff recommends the transfer of $70,000 of Measure R Local Return funds in
Account No. 56-1-7828 to Account No. 56-1-6717 and $17,000 of Vehicle Impact Fee funds in
Account No. 38-1-7823 to Account No. 38-1-6717 from FY 2017/18 Capital Improvement
Program and the transfer of $263,000 of Vehicle Impact Fee funds from the FY 18/19
Residential Street Pavement Rehabilitation Project budgeted in the FY 2018/19 Capital
Improvement Program (to be appropriated through the FY 2018/19 budget) to cover the total
project cost shortfall. The Estimated Project Cost Summary is attached.
