MINUTES OF THE
CITY COUNCIL OF THE CITY OF DOWNEY
SPECIAL MEETING
JUNE 12, 2018
The City Council of the City of Downey held a Special City Council Meeting on June 12, 2018, at
5:33 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Ashton presiding.
PRESENT: Council Members:

ALSO PRESENT: Gilbert Livas, City Manager

APPROVED CLOSED SESSION MINUTES
It was moved by Council Member Saab, seconded by Mayor Pro Tem Rodriguez, and so
ordered by Mayor Ashton to approve the Closed Session Minutes of April 10 and 24, and May 8, 2018.
PUBLIC COMMENT
Mayor Ashton opened the meeting for Public Comment. Having no one come forward, Mayor
Ashton closed Public Comment.
RECESSED TO CLOSED SESSION
Mayor Ashton announced the City Council is recessing to Closed Session at 5:34 p.m. to
discuss matters under the authority of the following sections of the Government Code:
1. Government Code Section 54956.9(d)(1) – Pending Litigation: Williams v. City of Downey, et.al., Los
Angeles Superior Court, Case No. BC617195.
2. Government Code Section 54957(b)(1); Public Employee Appointment – Director of Public Works.
3. Government Code Section 54957(b)(1); Public Employee Appointment – Director of Human
Resources.
RECONVENED
The Special City Council meeting reconvened in Open Session at 6:33 p.m. with all Council
Members present.
City Attorney Abich Garcia reported the closed session report as follows: In regards to Item No.
1, the City Council authorized the City Manager to execute the settlement agreement in the matter of
Williams v. City of Downey, Caltrans, Los Angeles Superior Court, Case No.BC617195. The material
terms of the settlement are as follows, the City agrees to repair 18 locations in the City as set forth in its
ADA Transition Plan between the period of 2019 to 2034. Disputes will be resolved informally between
the parties through mediation before lawsuits are filed in Los Angeles Superior Court and once fully
executed the settlement agreement will be on file with the City Clerk’s Office. It was moved by Council

Member Saab, seconded by Mayor Ashton and approved unanimously to authorize the City Manager to
execute the settlement agreement. In regards to Item No. 2, the City Council ratified the
recommendation of the City Manager to appoint Delfino Consunji to the position of Director of Public
Works. It was moved by Council Member Saab, seconded by Mayor Ashton and approved unanimously
to appoint Delfino Consunji to the position of Director of Public Works. In regards to Item No. 3, the City
Council ratified the recommendation of the City Manager to appoint Michael D. Harary to the position of
Director of Human Resources. It was moved by Council Member Saab, seconded by Mayor Ashton and
approved unanimously to appoint Michael D. Harary to the position of Director of Human Resources.
ADJOURNMENT
Mayor Ashton adjourned the Special City Council Meeting at 6:34 p.m.
