Adopt Reso in Support for Ballot Measure to Protect Local Transportation FundsAPPROVED Y TO HONORABLE MEMBERS OF THE CITY COUNCIL CITY MANAGER FROM: MAYOR SEAN ASHTON SUBJECT: SUPPORT FOR BALLOT MEASURE TO PROTECT LOCAL TRANSPORTATION FUNDS RECOMMENDATION That the City Council adopt` • 1 111610MG12• i i i ai k In 2017, Senate Bill 1 was signed into law, which provided specified funding for local transportation maintenance projects that have been under -funded for decades. The legislation includes strict accountability measures such as the establishment of an Independent Inspector General who is appointed by the Governor to oversee projects and programs to ensure all SB 1 funds are spent as promised and to reduce bureaucracy, waste, and red tape. The Inspector General is also required to report annually to the state Legislature. Cities and counties must publicly adopt and submit to the state a planned list of projects and year-end reporting that accounts for every single dollar of SB 1 revenue they receive; Downey did this through the adoption of the FY 2017-18 budget and Capital Improvement Plan. Although Article XIX of the California Constitution already protects the gasoline excise tax and vehicle registration fees, and a portion of the sales tax on diesel, these sources account for about 60% of the revenues generated by SB 1. To protect the remaining 40% of the transportation funds, Proposition 69 was introduced as a ballot measure for the June 2018 election. All gas tax moneys that were loaned in prior decades to the General Fund will have been repaid under SB 1. The California Department of Finance estimates that the annual average cost per driver is $117.09 per year, or $9.76 per month (due to an average Vehicle Registration fee increase of $47.85 and an annual average increase in fuel tax of $69.24). Because SB 1's $5 billion annual investment will create or support 682,029 jobs over 10 years in California (according to a February 2018 analysis of SB 1 by the American Road and Transportation Builders Association), Prop 69 is supported by a cross-section of government, labor and business groups, such as: California Alliance for Jobs California Association of Councils of Governments California State Council of Laborers California Trucking Association Chamber of Commerce of the Santa Barbara Region Los Angeles Area Chamber of Commerce PROTECT LOCAL Ti-f4ISPORTATIOR FIADS; MARCH 13,2018 PAGE 2 Orange County Business Council San Gabriel Valley Economic Partnership Silicon Valley Leadership Group Southern California Partnership for Jobs For the current fiscal year, the City has nearly $1,000,000 in SB 1 funds budgeted for streets and traffic safety improvement projects. FISCAL IMPACT Loss of funds from SB 1 would reduce the City's available Capital Improvement Project funds by approximately $1,000,000 per year. ATTACHMENTS <Exhibit A— Resolution Exhibit B — City of Downey transportation projects funded by SB 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING THE JUNE 2018 CALIFORNIA STATE BALLOT PROPOSITION 69, THE MOTOR VEHICLE FEES AND :AXES: RESTRICTIONS ON EXPENDITURES- •' • WHEREAS, California's cities, counties and transportation agencies face a statewide backlog of over $130 billion in needed funds to make transportation infrastructure improvements; and WHEREAS, "The Road Repair and Accountability Act" (SB 1 — Beall) passed by the Legislature and signed by the Governor last year will raise $5 billion annually in long-term, dedicated transportation funding to make road safety improvements, fill potholes and repair local streets, highways, bridges and overpasses, with the revenues split equally between state and local government projects; and WHEREAS, SB 1 provides critically -needed funding in Downey that will be used for: • FY 17-18 Annual Miscellaneous Construction & Repair of Concrete Improvements • FY 17-18 Annual Slurry Seal Program • Paramount Blvd. Raised Median Island Project (Imperial Hwy . — Firestone Blvd.) • Paramount Blvd. Raised Median Island Project (Firestone Blvd. — Florence Ave.) • Lakewood Blvd./Rosemead Blvd. Corridor Study • Downey Safe Routes to School Project WHEREAS, SB 1 contains strong accountability provisions to streamline projects by cutting bureaucratic redundancies and red tape to ensure transportation funds are spent efficiently and effectively, while also establishing the independent office of Transportation Inspector General to perform audits, improve efficiency and increase transparency; and WHEREAS, Proposition 69 on the June 2018 ballot would add additional accountability for taxpayers by preventing the State Legislature from diverting or raiding any new transportation revenues for non -transportation improvement purposes; and WHEREAS, there is also a proposed ballot measure aimed for the November 2018 ballot (Attorney General #17-0033) that would repeal the new transportation revenues provided by SB 1 and make it more difficult to increase funding for state and local transportation improvements in the future; and WHEREAS, this proposed November proposition would raid more than $1,000,000 annually dedicated to Downey, and halt critical investments in future transportation improvement projects in our community; NOW, •RE, THE CITY COUNCIL OF OF DOWNEY DOES RESOLVEHEREBY •,' • SECTION 1. The City of Downey hereby supports Proposition 69, the June 2018 constitutional amendment to prevent new transportation funds from being diverted for non - transportation purposes; and. SECTION2. The City of Downey hereby opposes the proposed November ballot proposition (Attorney General #17-0033) that would repeal the new transportation funds and make it more difficult to raise state and local transportation funds in the future; and Z 0 0 0 WAY04-1 SECTION 3. The City of Downey supports and can be listed as a member of the Coalition to Protect Local Transportation Improvements, a diverse coalition of local government, business, labor, transportation and other organizations throughout the state, in support of Proposition 69 and opposing the repeal of SB 1. SECTION 4. Staff is hereby direct to transmit a copy of this adopted resolution to the Coalition to Protect Local Transportation Improvements campaign. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
