SUBJECT: ENVIRONMENTAL REMEDIATION SERVICES AT 9255 IMPERIAL HIGHWAY,
CAPITAL IMPROVEMENT PROJECT NO. 17-01 — APPROVE ADDITIONAL
FEES FOR ENVIRONMENTAL REMEDIATION
That the City Council approve fees in the amount of $50,119.18 for Ninyo & Moore Geotechnical
and Environmental Sciences Consultants (Ninyo & Moore) for additional Environmental
Remediation Services and Air Quality Management District (AQMD) "Site Specific" permit at
9255 Imperial Highway
In late 2005, the City acquired the property located at 9255 Imperial Highway, formerly known
as the Spartan Lacquer and Paint Facility, for roadway construction purposes in conjunction
with the extension of Ardis Avenue (now Caring Way) from Congressman Steve Horn Way to
Imperial Highway. Upon acquisition of the property, the City demolished and cleared the
buildings and removed six underground storage tanks. Upon completion of site clearance,
various environmental related testing was conducted. Results of the tests indicated
contamination due to elevated concentrations of contaminants in the groundwater. The City
prepared a workplan for the soil remediation work and submitted it to the Los Angeles Regional
Water Quality Control Board (RWQCB) for review and approval. RWQCB conditionally
approved the workplan for soil remediation through the installation and operation of a vapor
extraction system including vapor extraction and ground water monitoring wells. Over the
years, multiple projects have been completed on the site which have proven to be successful in
reducing the level of contaminants.
In December 2015, the City retained the services of Stearns, Conrad and Schmidt Consulting
Engineers (SCS Engineers) to provide professional environmental remediation services related
to the soil remediation efforts and the final site closure with the RWQCB. Staff and SCS
Engineers met with the RWQCB to discuss the final closure of the site soil remediation efforts
and RWQCB stated that the groundwater sampling and soil vapor extraction (SVE) data
continued to detect the presence of low contaminate concentrations of volatile organic
compounds and total petroleum hydrocarbons and requested recommendations for continued
soil remediation efforts. SCS Engineers reviewed the SVE and groundwater technical reports
and sampling data and in March 2016, staff and SCS Engineers once again met with RWQCB
to discuss the requested recommendations for continued remediation efforts and submitted an
Environmental Data Review and Recommendation Report to RWQCB for review and approval.
Consequently the City received a letter from RWQCB with the approval of remediation
recommendations for resuming site assessment and cleanup.

In June 2016, staff issued a Request for Proposal for the environmental remediation services
based on the RWQCB's approved recommendations and continued soil remediation efforts. In
July 2016, four proposals were received from environmental remediation consulting firms. The
proposals were reviewed and evaluated and Ninyo & Moore received the highest ranking based
on their proposal which demonstrated a thorough understanding of the city's soil remediation
needs, effective work program, relevant technical experience, ability to meet the city's schedule
and cost effectiveness.
In September 2016, the City retained the services of Ninyo & Moore for the environmental
remediation services at subject site in the amount of $145,359.68.
In December 2016, Ninyo & Moore commenced the environmental remediation services in
accordance with Environmental Data Review and Recommendation Report approved by
RWQCB. These environmental remediation services included project coordination and
preparation of site-specific Health and Safety and Quality Control/Quality Assurance Plans,
installation of new soil vapor extraction equipment, vapor sampling and analysis at eight vapor
extraction wells, installation of new soil vapor probe wells, groundwater monitoring and
submission of technical reports to the RWQCB among other soil remediation services.
During the remediation efforts in 2017 additional services beyond the original scope of Ninyo &
Moore's work were incurred resulting in additional cost of $43,782.08. The services included but
not limited to; coordination of Los Angeles County Department of Health and City permit fees,
disposal of material generated from drilling of vapor probe wells, replacement of the carbon
material in the carbon absorption tanks, additional reporting requirements requested by the
RWQCB and installation and operation of a Catalytic Oxidation soil vapor extraction equipment
(see Attachments 1 and 2).
On February 27, 2018, Ninyo & Moore, SCS Engineers and staff met with RWQCB to discuss
soil vapor extraction and groundwater monitoring data from the latest technical report submitted
to the RWQCB. RWQCB acknowledged that based on the analysis data the concentration of
contaminants in the soil has been significantly reduced and contaminants concentration in the
groundwater has also decreased. Although the level of contaminants is still on a downward
trend they have not yet reached asymptotic levels as required. Therefore, continued soil
remediation efforts will be required by the RWQCB. Staff is currently working with RWQCB,
Ninyo & Moore and SCS Engineers to summarize the future soil remediation activity
requirements which is anticipated to be presented to the City Council at a future date.
Additionally, in anticipation of the continued soil remediation efforts, a new "Site Specific" permit
will be required by the AQMD. Obtaining a new AQMD "Site Specific" permit is a lengthy
process. Therefore, to avoid any further delays associated with the required continued soil
remediation activities securing an AQMD "Site Specific" permit in a timely manner is necessary.
The permit will be obtained through services of Ninyo and Moore at the cost of $6,337.10 (see
attachment 3).

The total cost for incurred additional environmental remediation services and obtaining the
required AQMD "Site Specific" permit is $50,119.18. Sufficient funds have been budgeted in the
Fiscal Year 2017-18 Capital Improvement Program under Account No. 51-1-6583 to cover these
services.

Ninyo & Moore is pleased to submit this request for budget amendment to the City of Downey,
Department of Public Works (City) for Environmental Remediation Services at the former
Spartan Lacquer Facility, 9255 Imperial Highway in Downey, California. These services are
being provided under the City's existing Purchase Order Number 33-11039 that includes
continuation of groundwater monitoring at the site, installation of additional vapor monitoring
wells, installation of a remediation system consisting of soil vapor extraction (SVE) and carbon
adsorption, and operation of the SVE system in accordance with our proposal dated July 28,
2016.
The following additional scope of work items have already been performed or are anticipated to
be performed by the end of the contract period.

Task 5 — Mobilize and Operate SVE and Treatment System
Based on the first five months of operation of the SVE system, the volatile organic compound
(VOC) concentrations in the influent stream have been much higher than anticipated thus
resulting in frequent carbon change -outs of the primary vessel, at the rate of approximately two
change -outs every month as indicated in our quarterly Groundwater Monitoring and SVE
System Progress Reports. A total of four carbon change -outs (one per quarter) were included in
our original proposal.
• Additional cost for carbon change outs at the current rate of changing out two, 1,000 pound
vessels for 5 months for a total of 10 change outs are included (4 of these additional
change outs have already been completed through May 17, 2017).
• Additional labor to coordinate with subcontractor, and oversee carbon change outs,
including post -change out operations and maintenance of the SVE system are included.
• Additional labor and analytical testing costs to collect a sample of the undiluted influent as
requested by the Regional Water Quality Control Board (RWQCB) in their e-mail
correspondence dated March 10, 2017 are included. A total of 10 samples starting March,
2017 through December 2017, plus one quality control sample are included.
• Additional labor to include additional data, data interpretation and analysis, graphs, etc. in
the second quarter, 2017 groundwater monitoring report, as requested by the RWQC13 are
included.
Task 6 — Conduct Rebound Testing

• Additional reporting requirements requested by the RWQCB in their email correspondence
dated March 30, 2017 are included. These included including additional calculations and
graphs in the Quarterly Groundwater Monitoring and SVE Status report.
ASSUMPTIONS
Listed below are our assumptions for estimating the costs to complete the scope of work.
• All assumptions in our original proposal apply for this additional scope of work as well.
RECOMMENDATION
Based on the sustained elevated influent VOC concentrations measured at the SVE system,
Ninyo & Moore recommends initiating the process to obtain a site-specific SCAQMD permit for
the site. The existing SVE system at the site is being operated under a various -locations permit
that is valid for operation for a maximum of 12 months at a site. It is our understanding that
obtaining a site-specific permit may take anywhere from three to six months.
SCHEDULE
The cost breakdown for the additional scope items listed above are provided on the attached
Table 1, Breakdown of Estimated Fee. Our proposed schedule for this project remains the same
as in our original proposal.

Based on the first approximately nine months of operation of the SVE system, the volatile
organic compound (VOC) concentrations in the influent stream have been much higher than
anticipated thus resulting in frequent carbon change -outs, Therefore it was decided during at
meeting with the City and SCS Engineers on September 26, 2017 that the SVE and carbon
units will be replaced with a Catalytic Oxidation (CatOx) unit. Additional costs for professional
labor, mobilization, electrical and process piping hookup, startup and rental of the CatOx unit
are included in this task. A breakdown of these costs is included in the attached Table 1.
Additional labor for project coordination and to monitor the CatOx system during the first
week of operation per the permit requirements = $2,426.00

obtain a site-specific SCAQMD permit for the site. The existing system at the site is being
operated under a various -locations permit that is valid for operation for a maximum of 12
months at a site which expires December 14".

Quality Management District (SCAQMD) Permit on behalf of the City of Downey, Department of
Public Works (City) to operate a soil vapor extraction (SVE) system at the former Spartan
Lacquer Facility, 9255 Imperial Highway in Downey, California. This service is being provided
under the City's existing Purchase Order Number 33-11039 that includes continuation of
groundwater monitoring and the operation of a remediation system consisting of SVE and
carbon adsorption under a various locations permit, in accordance with our proposal, dated July
28, 2016.
The following additional scope of work item is anticipated to be performed before the end of the
contract period.
SCOPE OF WORK
Ninyo & Moore will perform the following environmental services for the remediation of volatile
organic compounds (VOCs) -contaminated soil vapor at the site.

• The site-specific permit application will be submitted to the SCAQMD without the need for
expediting. It is our understanding that obtaining a site-specific permit may take anywhere
from two to four months. Expediting the permit with the SCAQMD would require additional
fees (an additional 50 percent of the normal fee).
• The permit will not require the notification of the public. This is typically required if there is a
school within 1,000 feet of the property line, or if cancer risk to nearby receptors is
considered too great. Based on our preliminary research, it is our understanding that this
will not be necessary.
