That the City Council:
1. Approve Measure M Local Return Assurances and Understanding Agreement and
related documents pertaining to the receipt and use of Measure M Local Return funds
in a form acceptable by the City Attorney; and

On June 23, 2016, the Metro Board of Directors voted to place a new sales tax measure on the
November 8, 2016 ballot. The measure, titled the Los Angeles County Traffic Improvement Plan
or Measure M, proposed to levy a '/2 cent sales tax to fund various transportation projects to
meet the long-term challenges of population growth and resultant increased traffic congestion
and decreased levels of air quality throughout Los Angeles County.
On November 8, 2016, Los Angeles County voters approved Measure M. It is expected that the
funds from the sales tax increase will generate an estimated $860 million per year over a period
of 40 years. Measure M is anticipated to fund various projects and initiatives over the next 40
years. The Gateway Cities Traffic improvement plans, highway/ street and transit projects to be
funded by Measure M are listed in the attached Metro Fact Sheet.
In addition to the projects and initiatives across the County to be funded using the Measure M
dollars, a portion of those funds will be made available via a local return program to cities per
capita within the Gateway Cities sub region to implement street improvement projects. The City
is expected to receive $1,618,100 annually, with funding expected to increase annually, over the
next 40 years. In order to pursue the City's share of the local return revenue funds the attached

Measure M Local Return Assurances and Understanding Agreement, Amendments and related
documents pertaining to the receipt and use of Measure M local return funds needs to be
R.Y,ecute�� and returned to Metro.
The attached resolution will authorize the City Manager to execute the referenced Measure M
Assurances and Understanding Agreement. Staff recommends adoption of the attached
Resolution.

AUTHORIZING i EXECUTE MEASURE M LOCAL
RETURN ASSURANCES AND UNDERSTANDING AGREEMENT AND
RELATED DOCUMENTS PERTAININGRECEIPT AND USE OF
LOCALMEASURE M r
WHEREAS, on June 23, 2016 the Los Angeles County Metropolitan Transportation
Agency Board of Directors proposed a 1/2 cent sales tax ballot measure, titled the Los Angeles
County Traffic Improvement Plan, to develop projects to mitigate traffic congestion and poor air
quality as a result of expected long-term population growth;
WHEREAS, On November 8, 2016 voters approved the Measure M '/z cent sales tax
ballot measure which is expected to generate annual local return funds for a period of 40 years
to various Cities within the Gateway Cities sub region;
WHEREAS, it is in interest of the City to pursue their share of the Measure M local
return revenue funds;
WHEREAS, the City is required to authorize the City Manager to execute the Measure M
Local Return Assurances and Understanding Agreement attached hereto as Exhibit "A" in order
to receive and use Measure M local return funds;
NOW, THEREFORE; THE CITY COUNCIL DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Downey authorizes the City Manager to
execute on behalf of the City the Measure M Local Return Assurances and Understanding
Agreement, Amendments and related documents.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution.

The undersigned, in conjunction with the receipt of funds derived from the one-half cent sales tax approved
pursuant to SB767,
Measure M Ordinance of Angeles 1unty Metropolitan TransportationAuthority
("LACNITA"), and as required by LACMTA's Measure M Local Return ("LR") Guidelines, hereby provides
the following assurances and understandings.
A. The Undersiened hereby assures LACMTA;
1. That the Measure M LR funds are to be used to augment, not supplant, existing local revenues
being used for transportation purposes;
2. That Measure M LR funds will be used for public transportation purposes as defined in
LACTA's Measure M LR Guidelines;

funds, comply with all applicable federal, state, and local laws and regulations, including without

returned3. That the undersigned will utilize the State Controller's Uniform System of Accounts and Recor s
to accommodate uses and disbursements of Measure M LR funds which will allow financial and
compliance audits of Measure M LR funds transactions and expenditures to be conducted;
4. That any Measure M LR funds not expended within five (5) years, under the Timely Use of
Funds time period, or held in a Capital Reserve account approved by LACMTA, thereafter will

5. In addition to implementing new Measure M eligible projects and programs, Jurisdictions may
use Measure M LR funds to supplement existing Measure M eligible projects and programs
should there be a current or projected funding shortfall. LACMTA reserves the right to request
appropriate documentation from a Jurisdiction to support the existence of a funding •'
6. The undersigned acknowledges Metro's support of Disadvantaged Business
Enterprises/Small Business Enterprises (DBEs/SBEs) and agrees to utilize a Procurement
process on its Measure M LR projects that, whenever practical, encourages the participati
of DBE/SBEs. I
