ON BOTH SIDES OF SHELLYFIELD ROAD BETWEEN CECILIA STREET
AND MULLER STREET
WHEREAS, the Public Works Committee considered and recommended to the City
Council the adoption of Resolution No. 15-7592 establishing a new residential preferential
parking district on both sides of Shellyfield Road between Cecilia Street and Muller Street and
the north side of Cecilia Street between a point located approximately 183 feet west of the
Shellyfield Road centerline and Chaney Avenue on September 17, 2015, and
WHEREAS, the City Council subsequently adopted Resolution No. 15-7592 establishing
said residential preferential parking district through a noticed public hearing held on October 13,
2015, and
WHEREAS, the city reviewed the continued need for the existence of the district one
year following its implementation and discovered that a total of 49 permits had been sold to
residents on Shellyfield Road and none had been sold to residents on Cecilia Street, and
WHEREAS, per Section 3178(c)(5) of the city's Preferential Parking Ordinance (No. 11-
1284), a residential preferential parking district may be terminated by resolution of the City
Council at a noticed public hearing if the minimum number of permits (at least 50% of the
residential properties) is not obtained within 60 days following the establishment of the district or
the number of permit holders falls below 50% following annual permit renewals, and
WHEREAS, the city's Preferential Parking Ordinance currently does not allow for the
removal of portions of a residential preferential parking district without repealing the district in its
entirety and re-establishing the portion(s) of the district to remain as a new district, and
WHEREAS, the city has verified that the owners of 75% of the properties on both sides
of Shellyfield Road between Cecilia Street and Muller Street remain in favor of the residential
preferential parking district on this portion of Shellyfield Road, and
WHEREAS, this item was presented to the Public Works Committee on August 17,
2017, followed by the City Council on September 12, 2017 through a noticed public hearing
after which, upon concluding the hearing, the City Council continued the item, and
WHEREAS, the required public hearing notice was published in the Downey Patriot on
October 12, 2017 and the owners and occupants of all properties located within 400 feet of the
boundaries of the residential preferential parking district on both sides of Shellyfield Road
between Cecilia Street and Muller Street were notified as required.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
ORDAIN • •
SECTION 1. Upon the conclusion of the public hearing, the City Council hereby
approves the removal of the residential preferential parking district on both sides of Shellyfield
Road between Cecilia Street and Muller Street and the north side of Cecilia Street between a
point located approximately 183 feet west of the Shellyfield Road centerline and Chaney
Avenue and approves the establishment of the proposed residential preferential parking district
on both sides of Shellyfield Road between Cecilia Street and Muller Street as illustrated in
Exhibit "A".
SECTION 2. The Public Works Department is hereby authorized to remove the
existing overnight parking prohibition/permit parking exemption signage posted along the north
side of Cecilia Street between a point located approximately 183 feet west of the Shellyfield
Road centerline and Chaney Avenue.
SECTION 3. The City Council hereby finds that the proposed preferential parking
district on both sides of Shellyfield Road between Cecilia Street and Muller Street is
categorically exempt per the provisions of the California Environmental Quality Act (CEQA)
under section 15301(C), Existing Facilities.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution which shall
be effective upon its adoption.
