HomeMy WebLinkAboutMinutes 11-14-17 Special MeetingMINUTES OF COUNCILCITY OF OF DOWNEY NOVEMBERSPECIAL MEETING The City Council of the City of Downey held a Special City Council 2017, at 5:37 p.m., in the Council Chamber of the Downey City Hall, Downey, California, Mayor Vasquez presiding. PRESENT: Council Members: Fernando Vasquez Sean Ashton Blanca Pacheco Rick Rodriguez Alex Saab Mayor Mayor Pro Tem Council Member Council Member Council Member ALSO PRESENT: Gilbert Livas City Manager Yvette M.,Abich Garcia, City Attorney Alicia Duarte, CMC, Interim City Clerk Meeting on November 14, 11111 Brookshire Avenue, It was moved by Mayor Pro Tem Ashton and seconded by Council Member Saab, and so ordered by Mayor Vasquez to approve the Closed Session Minutes of March 14, April 11 and 25, July 25 and August 22, 2017. Council member Pacheco abstained from the Closed Session Minutes of April 25, 2017. Mayor Vasquez opened` the meeting for Public Comment. Having no one else come forward, Mayor Vasquez closed public comment. RECESSED TO CLOSED SESSION Mayor Vasquez announced the City Council is "recessing to Closed Session at 5:45 p.m. to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.9(d)(1) — Pending Litigation: Williams v. City of Downey, et.al., Los Angeles Superior Court, Case No. BC617195. 2. Government Code Section "54957.6 Conference with Labor Negotiators John Oskoui/Irma Youssefieh Re: Direction for labor negotiations with Downey Police Management Association, Downey Firemen's Association, Downey Fire Management Association, Downey City_ Employees' Association (DCEA) — Maintenance Unit, and DCEA - Miscellaneous Unit. 3. Conference with Legal Council Anticipated Litigation - (Government Code Section 54956.9 (d)(2) and Government Code Section 54956.9(e)(1)) -,A point has been reached wherein the opinion of the City Council on the advice of its legal counsel, there is a significant exposure to litigation against the City. Facts and circumstances that might result in litigation, but which the City believes are not yet known to _potential plaintiff or plaintiffs which facts need not be disclosed: One (1) Potential Case City Council Minutes Special Meeting — November 14, 2017 1 4. Government Code Section 54957(b)(1) — Public Employee Performance Evaluation Title: City Manager 5. - Government Code Section 54957(b)(1)—Public Employee Performance Evaluation Title. City Attorney 6. Public Employee Appointment pursuant to Government Code Section 54957(b)(1) — Title: City Clerk The Special City Council meeting reconvened in Open Session at 6:47 p.m. with all Council Members present. City Attorney Abich Garcia reported the closed session report as follows: In regards to Item Nos. 1, 2, and 3, the City Council received a status report and no formal action was taken. In regards to Item No. 6, Mayor Vasquez reported the City Council voted unanimously to appoint Maria Alicia Duarte as City Clerk. • r; Mayor Vasquez reconvened Closed Session at 9:37 p.m. to discuss Item Nos. 4 and 5. City Attorney Abich Garcia reported the closed session report as follows: In regards to Item Nos. 4 and 5, the City Council completed the evaluations for the City Manager and City Attorney and no action was taken. . r • Mayor Vasquez adjourned the Special City Council Meeting at 104 - p_m.
