SUBJECT: PLN-17-00138 (GENERAL PLAN CONSISTENCY) – A REQUEST TO

PLAN

REPORT SUMMARY
Section 64502 of the California Government Code requires the Planning Agency make a finding
of General Plan conformance whenever a government entity proposes to acquire, use or
dispose of property. The County of Los Angeles, Department of Probation is proposing to renew
a lease at 9525 Imperial Highway and as such is requesting that the City find the lease renewal
consistent with the General Plan.
Based on the analysis contained in this report, staff is recommending the Planning Commission
adopt the following titled resolution:

DEPARTMENT OF PROBATION LEASE RENEWAL ON PROPERTY
LOCATED AT 9525 IMPERIAL HGHWAY IS CONSISTENT WITH THE CITY’S
GENERAL PLAN
BACKGROUND
The offices have been leased by the County of Los Angeles, Department of Probation since
May 13, 2014 and the proposal is to renew the existing lease. The rental space consists of
approximately 6,660 square feet in Suite 100 of the building located at 9525 Imperial Highway.
The use of the property is general office use, Department of Probation’s administrative offices
with no public intake. Normal working hours are 6:00 a.m. to 11:00 p.m. Monday through Friday
except holidays generally observed by the County of Los Angeles.

The subject property has a General Plan land use designation of Commercial Manufacturing
and has a corresponding zoning designation as C-M (Commercial Manufacturing).
DISCUSSION
A finding of consistency shall be made when the proposed use of the property conforms to the
maps and policies of the General Plan. Determinations of General Plan consistency are made
by the Planning Commission.
The CM land use designation is “intended to provide greater flexibility for providing land uses
that generate employment such as shopping centers, major offices, and light industrial.” The
proposed lease of 6,660 square feet of office space by the Probation Department is consistent
with the City’s General Plan land use designation. Goal 9.2 of the General Plan states the City
should “Promote Downey as an employment center.” It is staff’s opinion that the lease of 6,660
square feet of office space helps achieve this goal as the property will be maintained as office
space with a large employment base.
Inasmuch as the lease of the property helps achieves a goal of the General Plan, staff feels that
the Planning Commission can find that this action conforms to the requirements of the General
Plan.
ENVIRONMENTAL ANALYSIS
Staff has reviewed the proposed project for compliance with the California Environmental
Quality Act (CEQA). Upon completion of this review, it has been determined that this request is
categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing
Facilities). Categorical Exemptions are projects, which have been determined not to have a
significant effect on the environment and have been exempted from the requirements of the
California Environmental Quality Act. Class 1 exemptions are intended for the operation, repair,
leasing or minor alterations of existing facilities.

RESOLUTION NO. 17-______
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
DOWNEY ADOPTING A FINDING THAT COUNTY OF LOS ANGELES
DEPARTMENT OF PROBATION LEASE RENEWAL ON PROPERTY
LOCATED AT 9525 IMPERIAL HGHWAY IS CONSISTENT WITH THE CITY’S
GENERAL PLAN
WHEREAS , the City of Downey General Plan (Vision 2025) was adopted on June 3,
2005; and,
WHEREAS , the State of California Government Code Section 65402, requires the
County of Los Angeles shall not acquire, use, or dispose of any real property until the use of the
property has been found in conformance with the City’s General Plan by the City’s Planning
Commission; and,
WHEREAS , the County of Los Angeles, Department of Probation Education wishes to
renew a lease on property located 9525 Imperial Highway (AIN 6283-003-025).
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF DOWNEY
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission does hereby find and determine the proposed
lease of real property located at 9525 Imperial Highway by the Probation Department is in
conformance to the City’s adopted General Plan. In compliance with General Plan Goal 9.2,
which states, “promote Downey as an employment center” in that the lease of 6,660 square feet
of office space will maintain the office space for a large employer, and continue employment
that increases the City daytime and evening population creating customer demand for other
businesses.
SECTION 2. The Secretary shall certify the adoption of this Resolution.
