RESOLUTION NO. 16- 3005
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY
APPROVING PLN-16-00231 (SPECIAL EVENT), THEREBY ALLOWING THE 65th
ANNUAL CHAMBER OF COMMERICE CHRISTMAS PARADE, A FIVE -
KILOMETER (5K) RUN AND FOOD FESTIVAL, HOSTED BY TH E DOWNEY
CHAMBER OF COMMERCE, ON SUNDAY, DECEMBER 4, 2016, FROM 8:30 A.M.
TO 6:00 P.M., AT 11111 BROOKSHIRE AVENUE, ZONED DDSP (DOWNTOWN
DOWNEY – CIVIC CENTER DISTRICT)
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find,
determine and declare that:
A. The Downey Chamber of Commerce filed an application requesting the approval
of a Special Event Permit to host, their 65th Annual Chamber Christmas Parade, a
five-kilometer (5K) run and a food festival on Sunday, December 4, 2016 from
8:30 a.m. to 6:00 p.m. located at 11111 Brookshire Avenue , zoned DDSP
(Downtown Downey Specific Plan – Civic Center District).
B. On October 19, 2016, notice of the pending public hearing was sent to all Downey
property owners within 500 feet of the subject site (City Hall) and the notice was
published in the Downey Patriot;
C. The Planning Commission held a duly noticed public hearing on November 2,
2016 and after fully considering all oral and written testimony, facts, and opinions
offered at the aforesaid public hearing adopted this resolution.
SECTION 2. The Planning Commission further finds, determines and declares the
environmental impact of the proposed development has been reviewed and has been found to
be in compliance with the California Environmental Quality Act (CEQA) and is categorically
exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 4), Minor Alterations to
Land.
SECTION 3. Having considered all of the oral and written evidence presented to it at
said public hearings, the Planning Commission further finds, determines and declares that:
A. That the proposed activity or use will be consistent with the objectives, policies, and
general land uses and programs specified in the City’s General Plan; in that the special
event proposed by PLN-16-00231 is consistent with Program 1.1.5.3 of the City’s Vision
2025 General Plan, Chapter 1. Land Use, which states that the City shall “Promote
recreation and entertainment use s that serve needs of the public.” This event will be open to
the public and will promote community participation in the event.
B. That the proposed activity or use is consistent with other provisions of this article; in
that the event meets all requirements of Downey Municipal Code Section 9420, which
regulates Special Events. The Applicant has provided sufficient documentation to all
departments and also agrees to the attached Conditions of Approval.
C. That the proposed activity or use will not result in conditions or circumstances
contrary to the public health, safety, and general welfare; in that the Applicant has

communicated directly with the Police, Fire, and Public Works Departments to discuss
concerns relating to the event. Conditions of Approval have been included to mitigate any
significant impacts to less than significant.
SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the
Planning Commission of the City of Downey hereby approves PLN-16-00231, subject to the
Conditions of Approval attached hereto as Exhibit A – Conditions, which are necessary to
preserve the health, safety and general welfare of the community and enable the Planning
Commission to make the findings set forth in the previous sections. The conditions are fair and
reasonable for the accomplishment of these purposes .
SECTION 5. The Secretary shall certify the adoption of this Resolution.

EXHIBIT A
CONDITIONS OF APPROVAL
PLN-16-00231 (SPECIAL EVENT)
PLANNING
1) This approval of PLN-16-00231 (Special Event) is to allow, the 65th Annual Chamber
Christmas Parade, a five-kilometer (5K) run and a food festival on Sunday, December 4,
2016 from 8:30 a.m. to 6:00 p.m. The event will include food booths, live entertainment, and
family games and attractions. The requested street closures are contingent upon the
approval of the City Council and are n ot included in this approval.
2) The Applicant is responsible for notif ying residents, in writing, in the immediate vicinity
regarding the 5K run and parade event and parking restrictions.
3) In the event of street closures, the Applicant is responsible for providing / directing off-site,
off-street parking at Downey High School or public parking lots for the residents affected by
the street closures who wish to relocate their vehicle prior to the event.
4) In the event that the request for street closures is denied, the Applicant is respon sible for
rerouting the 5K run so that all activity occurs on private property, or on City sidewalks. Any
changes made to the approved Site Plan must be first approved by the City Planner.
5) All speakers must be turned away from abutting residential structures.
6) The sale and consumption of alcohol is strictly prohibited.
7) Noise during the 5K and parade must be kept to the minimum volume possible.
8) The City Planner is authorized to make minor modifications to the approved preliminary
plans or any of the conditions if such modifications shall achieve substantially the same
results as would strict compliance with said plans and conditions.
9) The Owner/Applicant agrees, as a condition of approval of this resolution, to indemnify,
defend and hold harmless, at Applicant's expense, City and City's agents, officers and
employees from and against any claim, action or proceeding commenced within the time
period provided in Government Code Section 66499.37 to attack, review, set aside, void or
annul the approval of this resolution, to challenge the determination made by City under the
California Environmental Quality Act or to challenge the reasonableness, legality or validity of
any condition attached hereto. City shall promptly notify Applicant of any such claim, ac tion
or proceeding to which City receives notice, and City will cooperate fully with Applicant in the
defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees
that the City may be required to pay as a result of any such c laim, action or proceeding. City
may, in its sole discretion, participate in the defense of any such claim, action or proceeding,
but such participation shall not relieve Applicant of the obligations of this condition.
PUBLIC WORKS/ENGINEERING
10) The applicant shall coordinate residential vehicle parking and any emergency related
scheduled ingress and egress.
11) The applicant shall obtain all necessary plan approvals and permits.

12) The applicant shall comply with Best Management Practices (BMP’s) in maintaining trash
receptacles and trash and debris generated by the event.
BUILDING
13) The owner/applicant is responsible for obtaining any the necessary permits for temporary
electrical connections.
POLICE
14) The Applicant is responsible for obtaining eight (8) uniformed, City of Downey, police
officers, one (1) sergeant, one (1) lieutenant, and five (5) security guards from RMI.
15) The Chief of Police shall have discretion as to the staffing of Downey Police officers at
this event and can increase or decrease the numbe r of staffed officers at any time.
FIRE
16) A separate event permit shall be obtained through the fire department. Plans shall
include tent locations, food trucks locations, and physical barriers for participant
protection against vehicular traffic.
17) Provide information on the barrier protections for the event participants. Sufficient
barriers shall be provided to protect participants from vehicular traffic.
18) Provide an event medical plan for the 5K race.
19) Cooking under tents shall have prior approval from fire department. Any use of tents or
temporary structures such as grandstands or stages shall have prior approval by the
building official.
20) Temporary tents or membranes shall comply with CFC section 105.6.43 and Chapter 31.
Furthermore, the Applicant shall obtain any necessary permits for the erection of
temporary tents.
