REGULAR MEETING
SEPTEMBER 13, 2016
The City Council of the City of Downey held a Regular City Council Meeting on September 13
2016, at 6:32 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue,
Downey, California, Mayor Saab presiding.

The Invocation was delivered by Teresa Corral The Flag Salute was led by Members of the
Downey Ponytail 14u Allstars Softball Team.

f',ONFERENCE/MEETING REPORTS
Council Member Ashton reported attending the California Contract Cities Conference and
reported on the session regarding water conservation. He requested staff research options for using
greywater. He attended the Independent Cities Association Board Meeting and reported on the
discussion regarding Proposition 57. He asked Chief Charles where the department stands on this
proposition. Chief Charles stated Proposition 57 seeks the early release of convicted felons for good
behavior credit; The Downey Police Department is against the proposition. Council Member Ashton
asked staff to draft a resolution for Council adoption opposing Proposition 57. He commented on the
Rio San Gabriel Clean Up and thanked those who volunteered at the event. He announced upcoming
events: Free Paper Shredding at Stonewood Mall and the International Food and Music festival.
Council Member Marquez welcomed the audience to the meeting
Council Member Brossmer acknowledged Todd Corrin, Downey Unified School District (DUSD)
Board Member in the audience. He thanked the Police Department for their collaboration with DUSD
during the tributes in honor of fallen Officer Galvez. He requested staff review the agreement with Stay
Gallery for lease and options moving forward; and, asked staff to review programming at parks and
facilities fora Parks Specific Master Plan.

Mayor Pro Ter Vasquez reported attending the Stay Healthy Downey Collaborative meeting
and invited the audience to participate in future meetings. He requested staff address the water
condition at Wilderness Park Lake. City Manager Livas stated staff has submitted a grant application to
the Rivers and Mountains Conservancy for funding to renovate the lake. Staff will know during the next
month if the grant application is successful. He voiced his concerns regarding homeless sleeping at the
playground area at Furman Park. He acknowledged Cesar Sanchez, long -time resident, in the
audience.
Mayor Saab acknowledged members of the audience: Mrs. Saab; Lieutenant McDaniels Laurie
Tyler; Joanna Peterson; and, Michael Calvert. He announced the upcoming Gangs Out of Downey Golf
Tournament. He acknowledged City staff for the City's Accomplishment brochure. He reported
attending the grand re- opening of Acapulco Restaurant; and, Coffee with a Cop. He thanked the Police
Department for hosting the event. He thanked Emergency Preparedness Manager Stevens for
organizing the staff cook -off event to encourage emergency preparedness in case of a disaster. He
thanked Our Lady of Perpetual Help for holding the Blue Mass in honor of public safety officers. He
reported attending the California Contract Cities Conference and reported on the session regarding
water conservation. He asked staff to research the option of bringing recycled water to Furman Park.
He announced upcoming events: Planet Fitness ribbon cutting; Chamber of Commerce Women in
Business Luncheon; Downtown Parking Study Subcommittee meeting for stakeholders; Centro Medico
Su Salud ribbon cutting; Comicon at Long Beach Convention Center; U.S. Service Academy Workshop;
International Food and Music Festival; Greek Night Rooftop Concert Series; Downey Symphonic
Society Paris _Gala; Down Payment Assistance Program _ Information meeting; Multi- Chamber Mixer;
Mary Chapin Carpenter Concert; Coffee with the Mayor; City held Blood Drive; and Glenn Fest Film
Festival.
1. Mayor Saab presented the Mayor's Distinguished Citizen Award to Raul Lopez.
2. Mayor Saab presented certificates of recognition to the Downey Ponytail 14u Allstars.
3. Mayor Saab presented a Proclamation for Emergency National Preparedness Month to Andrew
Stevens, Emergency Preparedness Manager.
4. Levy Sun; Public Information - Officer, Greater L.A. County Vector Control District provided a
presentation to the City Council regarding the Invasive Aedes Mosquitos and the Zika virus.

homeless issues.
PUBLIC HEARING

Mayor Saab opened the Public Hearing at 7:49 p.m. City Clerk Jimenez affirmed receipt of the
Proof of Publication. It was moved by Mayor Pro Tern Vasquez, seconded by Council Member Ashton
and so ordered by the Mayor to receive and file. City Clerk Jimenez noted there was no
correspondence received.
The staff report was provided by Director Mostahkami. Staff is requesting the granting of an oil
pipeline franchise agreement to Torrance Pipeline Company, LLC for a period of 10 years. The pipeline
was previously owned by Exxonmobile Pipeline Company and the asset was transferred to Torrance
Pipeline Company, LLC on July 1, 2016. State Fire Marshall issued a letter stating the pipeline was
inspected and meets the requirements of the state.
Council Member Brossmer asked Fire Chief Gillaspie if the Fire Department was aware of the
location and prepared to deal with any issues should they arise. Fire Chief Gillaspie said the documents
have been approved and reviewed by the State Fire Marshall's Office and the Hazardous Material
Inspector.
Mayor Saab asked how often the emergency plan related to this pipeline is reviewed. Fire Chief
Gillaspie stated the Fire Department receives updates on a monthly basis from the various petroleum
organizations that have product running through the City. Fire Department staff is familiar and trains on
an annual basis, and reviews the documents and maps. Mayor Saab asked how often the pipelines are
tested. Fire Chief Gillaspie said he does have a letter from the State Marshall indicating the standard
inspection was conducted in November 2015; pressure inspection in October 2013; and, an internal
inspection was performed February 2015. It is complaint with code and federal regulations and state
regulations and laws.
Mayor Saab opened this item for public comment at 7:53 p.m.
Armando Herman, resident, commented regarding pipeline safety.
Having no one else come forward, Mayor Saab closed public comment at 7:59 p.m.
It was moved by Council Member Brossmer, seconded by Mayor Pro Tern Vasquez and carried
unanimously to introduce an Ordinance of the City Council of the City of Downey Granting an Oil
Pipeline Franchise Agreement to Torrance Pipeline Company LLC.
Council Marquez abstained from Item No. 5 due to the proximity to his residence; Mayor Saab
abstained from Item No. 7 due to financial conflict and pulled Item No. 6; Mayor Pro Tern Vasquez
abstained from Item Nos. 14 and 15 due to the proximity to his place of business; Council Member
Ashton pulled Item No. 5. City Clerk Jimenez announced a revision to the MOU number in Item No. 10;
and a correction to the contract dollar amount in Item No. 4 ($802,257).
Mayor Saab asked if there was anyone who would like to comment on Consent Calendar items.
Having no one come forward, Mayor Saab closed public comment.
It was moved by Council Member Brossmer, seconded by Mayor Pro Tern Vasquez and carried
unanimously, with Council Member Marquez abstaining from Item No. 5; Mayor Saab abstaining from
Item No. 7; and Mayor Pro Tern Vasquez abstaining from Item Nos. 14 and 15, to approve the
remainder of the Consent Calendar.

SCOPE OF WORK (CAPITAL IMPROVEMENT PROJECT 17-05): Public Works.
Council Member Ashton asked why the Slurry Seal Project Areas were identified with letters, A,
B, and C instead of Districts. Assistant City Manager Oskoui explained at the commencement of the
Slurry Seal Project, streets were divided into project areas by letters but there is no specific reason and
it can be referenced as districts if it is preferred.
Mayor Saab stated a correction in the staff report. City Manager Livas stated the Project Area
should be listed as Project Area B instead of Project Area A.
Mayor Pro Ter Vasquez asked if additional streets are being slurry sealed as a result of the
impact fee from the new trash contract. Assistant City Manager Oskoui stated the impact fee is slowly
being generated and as previously discussed by Council the funding will be used towards the repair of
first priority streets in need of overlay and treatment.
Mayor Saab asked if there was anyone who would like to comment on this item.

It was moved by Council Member Ashton, seconded by Mayor Saab and approved unanimously
with Council Member Marquez abstaining, to award a construction contract to Doug Martin Contracting
Co. Inc. in the amount of $172,879.80 for the Slurry Seal Project Area "B "; and, authorized the Public
Works Director to execute any change orders or additional scope of work (Capital Improvement Project
17 -05).
6. AUTHORIZED PROCUREMENT AND INSTALLATION OF

HONDO GOLF COURSE FACILITY (CAPITAL IMPROVEMENT PROJECT NO. 16-12)- Parks &
Mayor Saab asked if the WiFi feature at the golf course will have a time limit and what areas in
the golf course will have WiFi access. City Manager Livas said the WiFi can be accessed at the driving
range, clubhouse, restaurant area, and, pro -shop. Interim Director Meacham said time limits can be set
and staff will work with IT to set up a password system for patrons to access service.
It was moved by Mayor Saab, seconded by "Mayor Pro Tern Vasquez and approved
unanimously to authorize procurement and installation of the necessary equipment in the amount of
$19,163, for the purpose of providing WiFi Service at the Rio Hondo Golf Course Facility (Capital
Improvement Project No. 16 -12).

Mayor Saab announced Council Member Brossmer cannot continue serving on the Board of
Trustees for the L.A. County Vector Control due to a scheduling conflict. The City Council discussed
potential options on who could serve on the Board and represent the City. City Manager Livas
recommended staff return to Council with recommendations at the next meeting.

APPROVED THE CREATION OF • UNCIL SUBCOMITTEE FOR THE RANCHO L I-
COUNCIL
AMIGOS SOUTH CAMPUS RENOVATION AND APPOINTED TWO MEMBERS OF THE C
Mayor Saab announced this item was brought forward per Council Member Brossmer's request.
He asked his Council colleagues for their suggestions. Council Member Marquez nominated Council
Member Ashton to serve on the subcommittee. Mayor Pro Tern Vasquez suggested the Mayor should
serve on the subcommittee at all times. Council Member Brossmer said the focus of the subcommittee
should be to oversee the park portion of the project throughout the completion of the development.
Mayor Pro Tern Vasquez suggested the Mayor and himself serve on the subcommittee for the
remainder of the year. Council Member Ashton stated his interest in serving on the subcommittee
because it the development is located within District 2. Mayor Saab believes the communication
between the City and County should come through the Mayor's Office. Council Member Brossmer
suggested having the Mayor and Council Member Ashton serve for the remainder of this year.
Mayor Saab asked if there was anyone who would like to comment on this item.
Armando Herman, resident, commented in favor of Council Member Ashton serving on the
subcommittee.
It was moved by Council Member Brossmer, seconded by Council Member Marquez and
approved unanimously to appoint Mayor Saab and Council Member Ashton to serve on the Rancho Los
Amigos South Campus Renovation Subcommittee for the remainder of this year.
City Manager Livas thanked City staff for the City's Annual Accomplishments document. He
thanked the Executive Management Team for their leadership and ensuring Council's accomplishments
are met.

Mayor Saab announced the opportunity to participate in a Time Capsule event at the Downey
Promenade.

Mayor Saab adjourned the Regular City Council Meeting at 8:32 p.m. in memory of U.S. Army
Staff Sgt. Matthew V. Thompson, 28, of Irvine, California who was supporting Operation Freedom's
Sentinel; Downey Fire Department retiree Floyd Martin Jr.; earthquake victims in Amatrice, Italy; victims
of the plane crash that occurred 30 years ago this August in our neighbor City of Cerritos; and, Duane
Graveline, 85, NASA astronaut who was selected to participate in the Apollo program
