TO 3:00 P.M. LOCATION: 7850 QUILL DRIVE ZONING: R -1 5,000 (SINGLE- FAMILY RESIDENTIAL) REPORT SUMMARY Southern California Rehabilitation Services, Inc. (hereinafter referred to as "the Applicant') is requesting the approval of a Special Event Permit to host the First Annual Disability Pride Parade and Festival on Sunday, October 9, 2016, from 11:00 A.M. to 3:00 P.M. The Applicant is also requesting street closures along a portion of Rives Avenue, north of Imperial Highway; and along Quill Drive, west of Rives Avenue and east of Old River School Road. Pursuant to Code Section 9420, special events involving over five hundred (500) people shall require Commission approval. As such, and based on the analysis contained in this report, staff recommends that the Planning Commission adopt the following resolution: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -16 -00177 (SPECIAL EVENT), THEREBY ALLOWING THE FIRST ANNUAL DISABILITY PRIDE PARADE AND FESTIVAL TO OCCUR ON SUNDAY, OCTOBER 9, 2016, FROM 11:00 A.M. TO 3:00 P.M., AT 7850 QUILL DRIVE, ZONED R -1 5,000 (SINGLE- FAMILY RESIDENTIAL) BACKGROUND The Southern California Resource Services for Independent Living is a nonprofit Independent Living Center providing resources and services enabling people with disabilities to live independently in the community. Southern California Resource Services for Independent Living opened in Downey in 1979, with a goal of improving the quality of life for people with disabilities. Through the years, this organization has expanded independent living services to include most Agenda Page 1 of East Los Angeles County and added employment services throughout Southern California. The office is located at 7850 Quill Drive, directly adjacent to the Barbara J. Riley Center and Apollo Park. To the west of the site lies Rancho Los Amigos Rehabilitation Center. The remainder of the surrounding land uses are single - family residential. On July 1, 2016, the Applicant submitted a Land Use Permit Application (PLN -16- 00177) to request approval to hold the First Annual Disability Pride Parade on Sunday, October 9, 2016. The application was deemed complete on Monday, August 15, 2016. The notice of the pending public hearing was published in the Downey Patriot and mailed to all property owners within 500 feet of the subject site on August 25, 2016. DISCUSSION According to the Applicant, the goal of hosting the First Annual Disability Pride Parade and Festival is to promote awareness of both visible and invisible disabilities and to establish a sense of community among those with disabilities and those who are not disabled. The parking lot to the south of the Barbara J. Riley Center will be used to host a festival, inclusive of an In -N -Out food truck; one (1) show mobile; an amplified sound system for speeches, music and entertainment; a confetti machine; a cooling station; and 100 folding chairs for seating during opening speeches. During the above - described festival, a parade /march is set to begin in the south parking lot of the Barbara J. Riley Center. The parade /march route will continue north on Rives Avenue, head west on Quill Drive, make a U- turn to head east on Quill Drive once participants have reached Old River School Road, and end in the same location where the parade began. According to the Applicant, bull- horns, a PA system, loud drumming and chanting are to be expected during the march. Parade organizers estimate a minimum of 300 guests are anticipated to be in attendance and will consist of celebrities/VIPs, as well as City, State, and Federal dignitaries. The schedule of events is proposed as follows 11:00 A.M. to 11:30 A.M. — Opening speeches 11:30 A.M. to 12:30 P.M. — March 12:30 P.M. to 3:00 P.M. — Food and Vendor Fair (Vendor Fair to be held within the main auditorium of the Senior Center) Parkins According to the Applicant, parking for the event will be made available in the parking lots to the south of Imperial Highway, adjacent to the Bank of America and Credit Union. Participants will be able to safely cross Imperial Highway at the crosswalk located at Smallwood Avenue. Street Closures Street closures, requested for this event, include Rives Avenue, north of Imperial Highway to Quill Drive, and Quill Drive, between Old River School Road and Rives Avenue between the hours of 9:00 a.m. and 2:00 p.m. This request will be heard and decided upon by the City Council on Tuesday, September 13, 2016. The Applicant has notified the residents along Quill Drive of the requested street closures and has gathered signatures from the residents who support the event. This is included as `Exhibit C' in this report. The Applicant is also providing off - street parking at the parking structure at Los Amigos Rehabilitation Center for residents Agen.da..P.age 2 along Quill Drive; they will be providing transportation to and from the parking structure for those who need access to their vehicles during the event. Development Review Committee This proposal was reviewed by the Development Review Committee on July 14, 2016. The Police, Fire, and Public Works Departments raised issues regarding public safety from vehicular traffic, emergency access, vehicle relocation for the residents on Quill Drive, and street closures, respectively. The Conditions of Approval associated with this project sufficiently address all concerns. CEQA Staff has reviewed the proposed use for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, staff determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15304(e), Class 4 (Minor Alterations to Land). Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and are exempt from the requirements of CEQA. FINDINGS Pursuant with Section 9814.08 of the Municipal Code, approval of the application, as described in the report above, shall require the following findings. Based on the evidence submitted in the application, PLN -16 -00177 meets the following findings: 1. That the proposed activity or use will be consistent with the objectives, policies, and general land uses and programs specified in the City's General Plan; in that the special event proposed by PLN -16 -00177 is consistent with Program 1.1.5.3 of the City's Vision 2025 General Plan, Chapter 1. Land Use, which states that the City shall "Promote recreation and entertainment uses that serve needs of the public." This event will be open to the public and will promote community participation in the event. 2. That the proposed activity or use is consistent with other provisions of this article; in that the event meets all requirements of Downey Municipal Code Section 9420, which regulates Special Events. The Applicant has provided sufficient documentation to all departments and also agrees to the attached Conditions of Approval. 3. That the proposed activity or use will not result in conditions or circumstances contrary to the public health, safety, and general welfare; in that the Applicant has communicated directly with the Police, Fire, and Public Works Departments to discuss concerns relating to the event. Conditions of Approval have been included to mitigate any significant impacts to less than significant. CORRESPONDENCE Staff had not received any correspondence as of the date this report was prepared. Agenda Page 3 CONCLUSION Staff supports the proposal and recommends that the Planning Commission adopt a resolution approving PLN -16- 00177, subject to the conditions of approval as stated in Exhibit "A" of the Planning Commission Resolution. TO 3:00 P.M., AT 7850 QUILL DRIVE, ZONED R -1 5,000 (SINGLE - FAMILY RESIDENTIAL) THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. Southern California Resource Services for Independent Living filed an application requesting approval of a Special Event Permit (PLN -16- 00177) to allow the First Annual Disability Pride Parade and Festival to occur on Sunday, October 9, 2016, from 11:00 A.M. to 3:00 P.M. located at 7850 Quill Drive, zoned R -1 5,000 (Single - Family Residential). B. On August 25, 2016, notice of the pending public hearing was sent to all Downey property owners within 500 feet of the subject site and the notice was published in the Downey Patriot; C. The Planning Commission held a duly noticed public hearing on September 7, 2016 and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing adopted this resolution. SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to be in compliance with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 4), Minor Alterations to Land. SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: A. That the proposed activity or use will be consistent with the objectives, policies, and general land uses and programs specified in the City's General Plan; in that the special event proposed by PLN -16 -00177 is consistent with Program 1.1.5.3 of the City's Vision 2025 General Plan, Chapter 1. Land Use, which states that the City shall "Promote recreation and entertainment uses that serve needs of the public." This event will be open to the public and will promote community participation in the event. B. That the proposed activity or use is consistent with other provisions of this article; in that the event meets all requirements of Downey Municipal Code Section 9420, which regulates Special Events. The event will include a food truck, sale of refreshments, a vendor fair within the Senior Center, and an amplified sound system for music and speeches. The requested street closures are contingent upon the approval of the City Council and are not included in this approval. 2) The Applicant is responsible for notifying residents along Quill Drive of the potential for street closures during the event. 3) In the event of street closures, the Applicant is responsible for providing off -site, off - street parking for the residents along Quill Drive who wish to relocate their vehicle prior to the event. Furthermore, the Applicant is responsible for providing transportation to and from the off -site, off - street parking facility. 4) In the event that the request for street closures is denied, the Applicant is responsible for rerouting the parade /march so that all activity occurs on private property. Any changes made to the approved Site Plan must be first approved by the City Planner. 5) All speakers must be turned away from abutting residential structures. 6) The sale and consumption of alcohol is strictly prohibited. 7) Noise during the parade must be kept to the minimum volume possible. 8) The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 9) The Owner /Applicant agrees, as a condition of approval of this resolution, to indemnify, defend and hold harmless, at Applicant's expense, City and City's agents, officers and employees from and against any claim, action or proceeding commenced within the time period provided in Government Code Section 66499.37 to attack, review, set aside, void or annul the approval of this resolution, to challenge the determination made by City under the California Environmental Quality Act or to challenge the reasonableness, legality or validity of any condition attached hereto. City shall promptly notify Applicant of any such claim, action or proceeding to which City receives notice, and City will cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees that the City may be required to pay as a result of any such claim, action or proceeding. A "no through traffic" sign will be placed on Quill Dr. just west of Paramount Blvd, for westbound traffic. f. A "no through traffic" sign will be placed on Rives Ave. just north of Imperial Hwy. for northbound traffic. g. "A" frames will be put in each driveway along Quill Dr. between Old River School Rd. and Rives Ave. 11) The applicant shall notify all residents in writing in the immediate vicinity regarding parade event and parking restrictions. 12) The applicant shall coordinate residential vehicle parking and any emergency related scheduled ingress and egress. 13) The applicant shall contact Mr. Don Baumgartner of Metropolitan Transportation Authority (MTA) for upcoming event and any inconveniences with bus pick up / drop off schedule. 14) The applicant shall obtain all necessary plan approvals and permits. 15) The applicant shall comply with Best Management Practices (BMP's) in maintaining trash receptacles and trash and debris generated by the event. BUILDING 16) The owner /applicant is responsible for obtaining any the necessary permits for temporary electrical connections and the stage. POLICE 17) In the event of street closures, the Applicant is responsible for obtaining three (3) uniformed, City of Downey, police officers and one (1) sergeant. The Applicant must ensure the officers are stationed at the following locations: a) Rives Avenue, north of Imperial Highway. b) Quill Drive at Rives Avenue c) Quill Drive at Old River School Road FIRE 1 S) In the event of street closures, the Applicant must submit a Patron Protection Plan inclusive of information on how Applicant will restrict vehicular access along Quill Drive during the parade /march. (CFC Chapter 3).
