HomeMy WebLinkAboutResolution No. 16-7665-Granting Oil Pipeline Franchise-Torrance Pipeline Co.RESOLUTION NO. 16 -7665 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION OF GRANTING AN OIL PIPELINE FRANCHISE TO TORRANCE PIPELINE COMPANY LLC AND SETTING A PUBLIC HEARING FOR SEPTEMBER 23, 2016 WHEREAS, on September 12, 2006, through Ordinance No. 06 -1195, the Downey City Council granted a 10 year franchise to ExxonMobil Oil Corporation to construct and operate a pipeline system for the transportation of gas, petroleum oil and other hydrocarbon substances and general operations incidental to the oil industry within certain streets of the City of Downey; and, WHEREAS, said franchise was for a term of 10 years, and expires on October 12, 2016; and, WHEREAS, on September 16, 2015, Exxon Mobil Oil Corporation requested another 10 year franchise for their pipeline system within the City; and, WHEREAS, on June 1, 2016, ExxonMobil Oil Corporation assigned and transferred, granted and conveyed all of its right, title and interest in and to the leases, easements, rights of way, franchises, permits, licenses and other rights within the City to Torrance Pipeline Company LLC; and, WHEREAS, on July 26, 2016, the City Council approved and consented to the transfer of the franchise to Torrance Pipeline Company LLC; and, WHEREAS, On July 19, 2016, ExxonMobil requested the City's consent for said transfer to Torrance Pipeline Company LLC; and WHEREAS, Torrance Pipeline Company LLC desires a new franchise for a minimum term of five (5) years; and, WHEREAS, pursuant to Public Utilities Code Section 6232, the City Council is required to adopt a resolution of intention to grant such franchise, and direct the City Clerk to publish within fifteen (15) days after adoption of said resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Consistent with the provisions of Public Utilities Code Section 6232, it is the intention of the City Council of the City of Downey to grant a franchise to Torrance Pipeline Company LLC, for a pipeline system for the transportation of gas, petroleum oil and liquid hydrocarbon for production, transportation and storage of petroleum oil, gas and other hydrocarbon substances, and general operations incident to the oil industry. SECTION 2. Notice is hereby given that on September 23, 2016, at 6:30 p.m., in the City Council Chambers of Downey City Hall located at 11111 Brookshire Avenue, Downey, California, all interested persons may appear before the City Council and be heard concerning the pipeline franchise agreement as proposed and all other matters relating thereto. In accordance with Public Utilities Code Section 6234, protests must be in writing and must be filed with the City Clerk prior to the conclusion of the public hearing. Any such protest shall state all grounds of the objection. RESOLUTION NO. 16 -7665 PAGE 2 SECTION 3. The City Clerk shall cause the notice of the public hearing to be given by causing the Resolution of Intention to be published and posted in the manner required by Public Utilities Code Sections 6232 and 6233.
