HomeMy WebLinkAboutResolution No. 16-7628-Granting Authority to City Manager for Execution of Contracts Bid Informally• •, • • • • r• WHEREAS, Article Xll, Section 1211 CONTRACTS ON PUBLIC WORKS of the City Charter as amended through Resolution No. 12 -7315 on January 10,_2012, requires public works construction projects and the procurement of materials and supplies in excess of $23,000 and $46,000, respectively, be bid through the formal process and require a contract or agreement subject to the approval of the City Council and execution by the Mayor or other officer as designated by the City Council. WHEREAS, Section 1211 of the City Charter as amended through said Resolution No 12 -7315 also allows public works construction projects and the procurement of materials and supplies below $23,000 and $46,000, respectively, to be bid informally; and, WHEREAS, Section 519 CONTRACTS. EXECUTION of the City Charter specifies that the City Council may, by ordinance or resolution, authorize the City Manager or authorized representative to bind the city, with or without a contract, for the acquisition of equipment, materials, supplies, labor, services or other items included within the budget approved by the City Council and may impose a monetary limit upon such authority; and, WHEREAS, currently, there is no designated officer other than the Mayor who is authorized to sign contracts on behalf of the city; and, WHEREAS, in the interest of establishing the approval process for contracts for public works construction projects and the procurement of materials and supplies which are bid informally, the City Manager or designee shall be delegated the authority to execute said - contracts up to currently allowable monetary limits of $23,000 and $46,000, respectively. WHEREAS, the currently allowable $23,000 and $46,000 limits may be increased in the future by the City Council through the adoption of a resolution in accordance with the construction cost index published by Engineering News Record. If said informal bidding limits are increased in the future, the City Manager's approval authority would increase accordingly. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Manager or City Manager's designee is hereby authorized to execute contracts for the acquisition of equipment, materials, supplies, labor, services or other items for up to $23,000 for public works construction projects and $46,000 for the procurement of materials and supplies subject to the informal bidding process, respectively; SECTION 2. Said approval authority to City Manager or City Manager's designee shall be adjusted perpetuity should aforementioned monetary limits be adjusted by City Council resolution from time to time in accordance with the construction cost index published in Engineering News Record; RESOLUTION • PAGE 2 SECTION 3. The City Clerk shall certify to the adoption of this Resolution, APPROVED AND ADOPTED this 26th day of April, 2016.
