DAVIS, CITY PLANNER PLN -16 -00100 (FINAL TRACT MAP NO. 67602) — A REQUEST TO SUBDIVIDE +/- 24,329 SQUARE FEET OF LAND INTO AN EIGHT (8) UNIT CONDOMINIUM DEVELOPMENT 8435 FONTANA STREET R -2, SUD 8 (TWO- FAMILY RESIDENTIAL, SECOND UNIT DEVELOPMENT AREA 8) On September 5, 2007, the Planning Commission adopted Resolution No. 07 -2498 and thereby approved Tentative Tract Map No. 67602 (PLN -16- 00070) to allow subdivision of a 24,329 square foot parcel of land into eight (8) condominiums. Subsequently, the Applicant caused the real property included within Tentative Tract Map No. 67602 to be surveyed and prepared a final map in accordance with the conditionally approved tentative map. The subject property is located at 8435 Fontana Street and is zoned R -2, SLID 8 Two - Family Residential, Second Unit Development Area 8). DISCUSSION After completing all the necessary documentation and research, the final map shows that this subdivision will divide one 24,329 square foot parcel into eight (8) condominiums. The Engineering Division has checked Final Tract Map 67602 for conformance with the tentative map and the applicant provided a cash deposit to guarantee all required off -site improvements. RECOMMENDATIO Section 9925 of the Downey Municipal Code states, "The Planning Commission and the City Council shall approve, conditionally approve, or disapprove a final map in accordance with Chapter 3, Article 4 of the Subdivision Map Act" and Section 66458 of the Subdivision Map Act says the legislative body shall approve a final map if it conforms with the Subdivision Map Act, and any local subdivision ordinance and rulings thereafter. The City of Downey Engineering Division has checked the map and certified its conformance to the tentative map. Therefore, staff recommends that the Planning Commission recommend its approval of Final Map No. 67602 (PLN -16- 00100) to the City Council.
