PRESENT: Council Members: held a Regular City Council Meeting on February 9, of the Downey City Hall, 11111 Brookshire Avenue, Alex Saab Mayor Fernando Vasquez Mayor Pro Tern Sean Ashton Council Member Roger C. Brossmer Council Member Luis Marquez Council Member ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Adria M. Jimenez, CMC, City Clerk John Oskoui, Assistant City Manager Shannon DeLong, Assistant to the City Manager Carl Charles, Chief of Police Mark Gillaspie, Fire Chief Mohammad Mostahkami, Public Works Director Arlene Salazar, Parks &Recreation Director Aldo Schindler, Community Development Director -Anil Gandhy, Finance Director Alicia Duarte, Deputy City Clerk The Invocation was delivered by Deacon Nolveris Frometa, First Baptist Church of Downey. The Flag Salute was led by Roy Beard, Former Downey Emergency Preparedness Committee Member, Downey CERT, Farmers Insurance Group. COUNCIL • FOR r CONFERENCE/MEETING REPORTS Council- Member Ashton reported attending the Independent Cities Association Seminar and reported on the session regarding the impact of Assembly Bill 109 and Proposition 47. He announced upcoming events: Ride and Stride Information meeting; Keep Downey Beautiful; and, his Town Hall Meeting at the Barbara J. Riley Center. He asked for an update on the current street projects. Director Mostahkami reported the street construction projects on Firestone /Paramount, Gardendale, and Firestone East will be completed in March. The street project on Rosemead/Telegraph will be completed in May due to Edison light poles being relocated. Residential street paving in some areas will begin this week and be completed by the end of February. Council Member Ashton also reported attending the Vallarta Market Grand Opening. Council Member Marquez welcomed the audience to the meeting. Council Member Brossmer reported attending the Independent Cities Association Seminar and reported on the session regarding Homelessness and the different strategies cities are using to address this issue. He stated direction has been provided to the City Manager and City Attorney to coordinate with the Police Department and ensure the current Ordinances in place are compliant. Mayor Pro Tern Vasquez welcomed the audience to the Council Meeting. He reported attending the Vallarta Supermarket Grand Opening and the Independent Cities Association Seminar. He reported City Council Minutes Regular Meeting — February 9, 2016 1 on the session regarding Assembly Bill 109 and crime statistics in California. He requested the Police Department monitor the City parks during closing hours and ensure the gates are closed. He reported participating in the City Council Workshop last week and said the City Council discussed Public Safety, the state of the roads, and homelessness issues. He reported attending the Stay Healthy Downey meeting and acknowledged Director Salazar and her staff for an amazing job in coordinating the meetings. Mayor Saab reported attending the Independent Cities Association Seminar and provided an overview of the Association. He provided information on the session he attended regarding homelessness and mental health issues. He commented on the City's mental health evaluation team which consists of a mental health professional who rides with Police Officers on certain days during the month and provides assistance when a member of the homeless community is contacted. He requested staff review the City's pan - handling & trash theft ordinances. He provided information about Proposition 47, Assembly Bill 109 and crime statistics nationwide. He reported attending the Downey Police and Fire Foundation Board of Director's meeting and announced the upcoming Police Officer and Fire Fighter of the Year event in April. He reported attending the commemoration of the Challenger event and acknowledged Director Dickow for a great event. He announced upcoming events: MOD Pizza Ribbon Cutting; Cafe Quill Senior Prom; Ride and Stride Information meeting; President's Day City Hall closure; CareMore Health and Wellness meeting; Keep Downey Beautiful event; Oil Filter Exchange event; and, the Downey Rose Float Association Midnight Masquerade event. He congratulated members of staff for winning the Government Finance Officers Association Distinguished Budget Presentation Award. City Manager Livas elaborated on the requirements to qualify for the award and congratulated Director Gandhy, Assistant to the City Manager DeLong, Administrative Aide Rivas; and, the Budget Subcommittee for their work on the budget document. Mayor Saab welcomed Michael Calvert as the new Executive Director of the Downey Chamber of Commerce. He announced the State of the City Address and Stroke Awareness Screening events. He asked staff to review the Fire Code and asked for an update on why the number of Code Enforcement cases in the last five years has decreased. He requested staff also review neon light regulations, and said he would like to have the addresses of yard sale permits published on the City's website. He asked staff to address the Wi -Fi access at the Rio Hondo Event Center. PRESENTATIONS Mayor Saab with the assistance of Emergency Manager Stevens presented Certificates of Recognition to Members of the Emergency Preparedness Committee for their dedicated service to the community. 2. Mayor's Distinguished Citizen /Business Award presented to Steve Roberson - Century 21 My Real Estate. This award was not presented at the meeting. PUBLIC HEARINGS 1. INTRODUCED ORDINANCE NO. 16 - - -- , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING AN INTEGRATED WASTE MANAGEMENT SERVICES FRANCHISE AGREEMENT TO CALMET SERVICES, INC.: Administration. Mayor Saab opened "the 'Public Nearing at 7:08 p.m. City Clerk Jimenez affirmed receipt of the Proof of Publication. It was moved by Council Member Brossmer, seconded by Mayor Pro Tern Vasquez and so ordered by the Mayor to receive and file. City Clerk Jimenez noted there was no correspondence received. The staff report was provided by Assistant City Manager Oskoui. Mr. Oskoui provided a brief summary of the background of the current contract with CalMet Services for exclusive residential and commercial solid waste and recycling services. The contract became effective on January 1, 2005 and is due to expire on March 31, 2016. In 2014, the City Council created a sub- committee for the purpose of evaluating various options available to the City beyond March 31, 2016. The sub - committee met to City Council Minutes Regular Meeting — February 9, 2016 2 review the existing contract and opted to hire a professional consulting firm, R3 Consulting, with expertise in the area of solid waste management services in order to complete a comprehensive study of the existing contract, discuss the current market trends and conditions, the impact of new legislations on trash collection and recycling services, and recommend the most viable options available to the City. The study concluded that it was in the best interest of the City to pursue the option of negotiating a new 10 year contract with CalMet Services. In April 2015, City staff, assisted by R3 Consulting, began to negotiate a new agreement with CalMet Services. In November 2015, a preliminary draft of the agreement was presented to the Solid Waste Sub - Committee for review. The new agreement with CalMet includes significant modifications that will benefit the City residential and commercial customers. Highlights of the new 10 year contract which would commence in April 1, 2016, include: A freeze on residential rate increases for the first year; replacement of CalMet's existing fleet of gasoline fueled trucks with new compressed natural gas vehicles; replacement of approximately 63,000 carts and bins; 10% discount for qualified senior citizens; 5% Franchise Fee to the City, in addition to a 10% vehicle impact fee to be used for the City's local road improvements; implementation of a new customer services program that includes free a -waste and dry cell battery collection events, paper shredding and mulch events. On January 26, 2016, the City Council adopted a resolution declaring its intention to grant an integrated waste management services franchise agreement to CalMet Services and set the date of the public hearing for February 9, 2016, Mayor Saab opened this item for public comment at 7:16 p.m. Bill Minasian, commented in favor of the proposed CalMet agreement and was pleased with the new incentives. Resident, no name provided, commented on the rate for trash services and bulky items and trash on City streets. He requested the current trash rate be extended for two years rather than one year. John Lacey, resident, asked what the new rate would be after the 14 months in which the rate will remain the same. Assistant City Manager Oskoui stated the rate will be determined based on the Refuse Rate Index, which includes fuel, labor, and dumping costs. John Lacey, resident, asked what CalMet's rate of profit is. Mark Alberts, R3 Consulting, the rate of profit in the industry is approximately 10 percent, Having no one else come forward, Mayor Saab closed public comment at 7 :29 p.m.. Council Member Brossmer commented in favor of CalMet's previous and proposed contract. He acknowledged Mayor Pro Tern Vasquez for his idea of the reduced rate for seniors and said this is a good contract for the residents. Mayor Pro Tern Vasquez, thanked City staff and R3 Consulting for their thorough analysis of the contract. He commented on the responsibility of having an efficient and cost effective contract for the residents and on the contract's incentives. He acknowledged City staff for their work negotiating the contract. Council Member Ashton commented on the higher trash rates being paid in other cities and on the incentives of the new proposed contract. Council Member Marquez acknowledged the Waste Management Sub - Committee and City staff for their work on bringing this contract forward for the residents. City Council Minutes Regular Meeting — February 9, 2016 3 Mayor Saab thanked the Waste Management Sub- Committee and City staff for a thorough and transparent process. He commented on CalMet's willingness to support the non- profit groups in the community as well as the Chamber of Commerce. He commented on the low rates, the senior discount and the funding for street repairs. It was moved by Council Member Brossmer, seconded by Council Member Ashton and approved unanimously to introduce an Ordinance of the City Council of the City of Downey granting an integrated Waste Management Services Franchise Agreement to CalMet Services, Inc. NON - AGENDA PUBLIC COMMENT Resident, no name provided, commented on sidewalk and street services, the American Disability Act, compliance of the Act by the City and establishing a grievance process. Jacklyn Cardona, resident, acknowledged the Downey Police Department. She thanked Council Member Ashton for guiding her in the right direction on how to be better informed about her neighborhood. She requested information about a proposed Jack in the Box at Pangborn Avenue and Firestone Boulevard. She stated her concern for traffic conditions and rodents during the spring and summer. CONSENT CALENDAR Council Member Brossmer announced his abstention from Item Nos. 5 and 10 due to potential conflict of interest with his employer, Downey Unified School District. It was moved by Mayor Pro Tern Vasquez, seconded by Mayor Saab, and carried unanimously with Council Member Brossmer abstaining from Item Nos. 5 and 10, to approve the remainder of the Consent Calendar. 2.
