Svc. to CalmetRESOLUTION NO. 16-7611 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO GRANT AN INTEGRATED WASTE MANAGEMENT SERVICES FRANCHISE TO CALMET SERVICES, IN AND SETTING A PUBLIC HEARING FOR FEBRUARY 9,2016 1 WHEREAS, the City of Downey has previously entered into a Solid Waste Handling Services Agreement with CalMet Services dated September 13, 2005 for refuse collection service; and, WHEREAS, the City of Downey has also entered into a First Amendment to Solid Waste Handling Agreement with CalMet Services dated March 24, 2009; and, WHEREAS, said franchise was for a term of 7 years, and expires on March 31, 2016; and, WHEREAS, CalMet Services Inc. approached the City with a proposal to extend the term of its franchise for solid waste services; and, WHEREAS, pursuant to Downey City Charter Section 1403, the City Council is required to adopt a resolution of intention to grant such franchise, and direct the City Clerk to publish this resolution in a newspaper of general circulation within ten (110) days before the hearing, and to post this resolution in three public places fifteen (115) days before the hearing; and, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Consistent with the provisions of Downey City Charter Section 1403, it is the intention of the City Council of the City of Downey to grant a franchise to CalMet Services Inc., for integrated waste management services. A copy of the proposed franchise is available in the Office of the City Clerk. SECTION 2. Notice is hereby given that on February 9, 2016, at 6:30 p.m., in the City Council Chambers of Downey City Hall located at 11111 Brookshire Avenue, Downey, California, all interested persons may appear before the City Council and be heard concerning the integrated waste management services franchise agreement as proposed and all other matters relating thereto. All protests may be lodged in person during the hearing or in writing and must be filed with the City Clerk prior to the conclusion of the public hearing. Any such protest shall state all grounds of the objection. SECTION 3. The City Clerk shall cause the notice of the public hearing to be given by causing the Resolution of Intention to be published and posted in the manner required by Downey City Charter Section 1403. WON SECTION 4. The City Clerk shall certify to the adoption of this resolution, APPROVED AND ADOPTED this 26th day of January, 2016.
