SCHINDLER, DIRECTOR OF i DEVELOPMENT a DANOVEMBER SUBJECT- A REQUEST TO INITIATE A ZONING TO SECTION i OF DOWNEY MUNICIPAL CODE RECREATION i RECOMMENDATION That the City Council initiate an amendment to the text of Section 9318 of the Downey Municipal Code to allow commercial recreation uses in manufacturing zones. On November 10, 2015, the City Council directed staff to initiate a zoning text amendment that would allow them to consider whether dance studios should be able to locate in the City's manufacturing zones. The City Council became aware of a situation recently, involving denial of a request to allow a dance studio on property in the M -1 (Light Manufacturing) zone where it is not permitted. The Downey Municipal Code lists dance studios among the types of uses classified as "commercial recreation." The City Council is aware that other cities in the region allow these uses in their manufacturing zones, and would consider allowing them in Downey also. As such, staff is recommending the City Council initiate a Code Amendment, via minute action, that will allow staff to set this matter for a public hearing with the Planning Commission. A subsequent public hearing will be scheduled with the City Council to present the topic. i 01 J1 ► 1 IF-1 W-11 \' - This project is exempt from the requirements of the California Environmental Quality Act ( "CEQA "), pursuant to Section 15061 (b)(3) of the State of California CEQA Guidelines, because the activity is covered by the general rule that CEQA applies only to projects, which have the potential for causing a significant effect on the environment. Initiation of a code amendment does not have the potential to create an environmental impact. Should the Code amendment be initiated, an environmental assessment will be conducted to analyze impacts of said Code Amendment.
