PRESENT: Council Members: Luis H. Marquez Mayor Alex Saab Mayor Pro Tern (Excused) Sean Ashton Council Member Roger C._Brossmer Council Member Fernando Vasquez Council Member ALSO PRESENT: Gilbert Livas, City Manager Yvette M. Abich Garcia, City Attorney Adria M. Jimenez, CMC, City Clerk Mayor Marquez opened the meeting for Public Comment. Having no one come forward,- Mayor Marquez closed Public Comment. Mayor Marquez announced the City Council is recessing to Closed Session at 5:33 p.m. to discuss the matters under the authority of the following sections of the Government Code: 1?, Government Code Section 54956(4)(1): Conference with Legal Counsel - Existing Litigation: State Water Regional Control Board File No. A- 2236 Petition for Review of Order No R4 2012 0175 NPDES No. CAS - 004001 by the Los Angeles Regional Water Quality Control Board. 2. Government Code Section 54956.9(4)(4) - Initiation of Litigation: (1) case 3. Government Code Section 54956.9(4)(3): Anticipated Litigation (1) case 4. Government Code Section 54956.9(d)(1): Conference with Legal Counsel-- Existing Litigation: City of Downey v. Downey Land Limited, et al., Los Angeles Superior Court, Case No. BC 540492 5. Government Code Section 54957.6 - Conference with Labor Negotiators John Oskoui /Irma Youssefieh re: Direction for Labor Negotiations with Downey Police Officers' Association and Downey Firemen's Association. 6. Government Code Section 54956.8 — Conference with City of Downey real property negotiator: City Manager Livas /Community Development Director Schindler Re: Property at 9066 Firestone Blvd: Negotiating Parties: Land Developers and Associates, Corporation; CHC Hotels and Associates; Kamla Hotels; Under Negotiation: Price and Terms. City Council Minutes Special Meeting — July 14, 2015 The Special City Council Meeting reconvened in Open Session at 6:30 p.m. with Mayor Pro Tern Saab excused. City Attorney Abich Garcia reported on the closed session reports as follows: In regards to Item Nos. 1, 2 and 3, the City Council received a status report and directed that the law firm of Richards Watson & Gershon defend the City in any future lawsuit filed to challenge the State Water Board's approved Stormwater permit; the City Council declined to initiate litigation regarding the Stormwater permit; Item No. 4, the City Council unanimously approved, with Mayor Pro Tern Saab excused, to approve the settlement of the eminent domain case in the amount of $615,000 for the acquisition of properties at Imperial Highway and Bellflower Boulevard for the City's street widening project. The settlement will be approved by the Court on September 1, 2015. For Item No. 5, the City Council received a status report and gave direction to its labor negotiators.
