HomeMy WebLinkAboutResolution No. 15-7569-Paid Sick Leave Policy-Temp/PT-FT Employees=1*01 ItIl I Lei ;z I NO-)9&1y&T-E RESOLUTION OF • OF OF • APPROVING PAID POLICY • AB 1522 FOR EMPLOYEES TEMPORARY/PART-TIME AND FULL-TIME/TEMPORARY EMPLOYMENT STATUS WHEREAS, on September 10, 2014, the Governor of the State of California signed AB 1522, the Healthy Workplaces, Healthy Families Act of 2014 providing paid sick leave for eligible employees; and, WHEREAS, the AB 1522 paid sick leave provisions are to take effect July 1, 2015; and, WHEREAS, AB 1522 establishes the obligations for the City to set the terms and conditions of this statutory paid sick leave; and, WHEREAS, for compliance with the Healthy Workplaces, Healthy Families Act of 2014, the City of Downey establishes a paid sick leave policy pursuant to AB 1522 for temporary /part time and full- time /temporary employment status employees who are not currently covered by a City paid sick leave provision or who are not represented by a collective bargaining agreement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOEW '.-]'EREBYRESOLVE AS FOLLOWS: SECTION 1. This resolution establishes the Paid Sick Leave Policy for temporary/part- time and full- time /temporary employment status employees hereto as Exhibit A, and by this reference, is hereby adopted. SECTION 2. This resolution shall become effective July 1, 2015, and any conflicting provisions previously adopted are hereby rescinded. SECTION 3. JIMEN , C City Clerk CV I HEREBY CERTIFY that the foregoing Resolution was adopted by the City Council of the City of Downey at a regular meeting held on the 23rd day of June, 2015, by the following vote, to wit: CITY OF DOWNEY PAID SICK LEAVE POLICY EFFECTIVE JULY 1, 2015 1) Twenty -four (24) hours, or 2) Three (3) times the number of hours in a single regularly scheduled shift of the Employee All full- time /temporary employment status Employees in the classification of Ambulance Operator shall receive Paid Sick Leave in the amount of whichever of the following is greater: 1) Forty (40) hours of paid sick leave, or 2) Three (3) times the number of hours in single regularly scheduled shift. For each subsequent year of employment, Employees shall be provided annual upfront Paid Sick Leave on the first date of the pay period that includes July 1 in an amount established under this Section. Timing_ 9 Usage Employees are eligible to request and use available Paid Sick Leave on the ninetieth (90th) calendar day of employment following their Date of Hire. 1 M * r S Employees are entitled to use Paid Sick Leave for personal illness or injuries to obtain relief to help ensure the health, safety and welfare of themselves or their child(ren) if victims of domestic violence, sexual assault, or stalking; or to attend to the illness of a family member. Family members include a child, parent, registered domestic partner, spouse, grandparent, grandchild, or sibling. Employees may only utilize Paid Sick Leave to receive compensation for scheduled work days. Paid Sick Leave shall be used in increments of no less than one (1) hour.- If the need for Paid Sick Leave is foreseeable, an Employee shall provide reasonable advance notice to a supervisor, in writing or orally, of his /her intent to use Paid Sick Leave. If the need for Paid Sick Leave is not foreseeable, an Employee shall provide notice for the need to use Paid Sick Leave as soon as practical. Calculation of Paid Sick Leave Paid Sick Leave shall be calculated at the Employee's regular hourly wage. For Employees who had different rates of pay in the 90 days prior to taking Paid Sick Leave, Paid Sick Leave will be paid at the rate of pay calculated by dividing the employee's total wages, not including overtime pay, by the employee's total hours worked in the full pay periods of the ninety (90) days of employment prior to taking such Paid Sick Leave. No Carry Over Any upfront Paid Sick Leave provided that is not fully used by the Employee within one (1) year of when it was provided shall not carry over to the following year period and shall expire. �p low .. The remaining balance of any unused Paid Sick Leave shall not be paid out to an Employee upon termination, resignation, retirement or other separation of employment. If an Employee separates from City of Downey employment and is rehired within three hundred sixty five (365) days, the Employee is entitled to the reinstatement of any previously earned and unused Paid Sick Leave.
