HomeMy WebLinkAboutResolution No. 15-298-Approving Sale & Transfer for 9010 Buhman AveRESOLUTION NO. 15 -298 A RESOLUTION APPROVING THE SALE AND TRANSFER OF DOWNEY HOUSING SUCCESSOR AGENCY PROPERTY LOCATED AT 9010 BUHMAN AVENUE, DOWNEY, CA, TO ROBERT AND HERMILIA GUTIERREZ WHEREAS, the Community Development Commission of the City of Downey, in its capacity to function as a housing authority and as the "Housing Successor Agency" for the assets and functions of the former redevelopment operations of the Community Development Commission of the City of Downey pursuant to Health and Safety Code section 34172(a) and 34176 (the "Downey Community Development Commission /Housing Successor Agency "), is authorized to dispose of the property located at 9010 Buhman Avenue (the "Subject Property "), further described as: Lot 51, of Tract No. 14395, in the City of Downey, County of Los Angeles, State of California, as per map recorded in book 364 Page(s) 21 to 24 of Maps, in the office of the County Recorded of said County, and; WHEREAS, the sale price for the Subject Property is not less than the fair market value, and; WHEREAS, the Downey Community Development Commission /Housing Successor Agency held a public hearing on Tuesday, April 28, 2015, at 6:30 p.m., in the City Hall Council Chambers in City Hall, and that the public notice of the time and place of said hearing was given by publication in the Downey Patriot as required by the Downey Municipal Code and in accordance with Health and Safety Code Section 34312.3(b) prior to consideration of the sale and transfer of the Subject Property. NOW, THEREFORE, THE DOWNEY COMMUNITY DEVELOPMENT COMMISSION/ HOUSING SUCCESSOR AGENCY, HEREBY RESOLVES AS FOLLOWS: SECTION 1. The sale of the Subject Property is exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines, as an existing facility. SECTION 2. The net proceeds of the sale of the Subject Property shall be deposited into the Low and Moderate Income Housing Asset Fund administered by the Community Development Commission /Housing Successor Agency pursuant to Health and Safety Code sections 34176 and 34176.1, and any other applicable law. SECTION 3. Pursuant to Health and Safety Code section 33433, 34176, and 34312.3, and any other applicable laws, the Community Development Commission /Housing Successor Agency prepared a "Summary Findings Report," available to the public for review in connection with the sale and transfer of the Subject Property. The Summary Findings Report was available for public review at the City Hall, and all of the contents within the Summary Findings Report are hereby incorporated by reference into this Resolution. SECTION 4. The Secretary shall certify to the adoption of this resolution. RESOLUTION NO. 15 -298 PAGE 2 APPROVED AND ADOPTED this 28th day of April, 2015. AK- LUIS H.
