HomeMy WebLinkAboutResolution No. 15-7555-Supporting AB 201 and SB 267RESOLUTION NO. 15 -7555 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING ASSEMBLY BILL 201 AND SENATE BILL 267, TO ALLOW CITIES TO ADOPT LOCAL RESTRICTIONS FOR REGISTERED SEX OFFENDERS WHEREAS, the City Council of the City of Downey has a sworn duty to uphold the interests of the residents of the City of Downey; and, WHEREAS, in keeping with this duty and understanding the life -long psychological, emotional and physical effects on survivors of sexual trauma, the City of Downey in 2009 adopted a local ordinance enacting restrictions related to registered sex offenders; and, WHEREAS, the City's ordinance restricted registered sex offenders from residing in a "Residential Exclusion Zone" defined as 2000 feet from child care centers, public or private schools (K -12), parks and a public library; and the City enacted an anti - loitering provision that prohibits registered sex offenders from loitering in a "Child Safety Zone" defined as 300 feet from a child care center, public or private schools (K -12), parks, a public library, a commercial establishment with a child playground and a location that holds classes or group activities for children, and a school bus stop; and, WHEREAS, recent State Court decisions have held that ordinances such as the City of Downey's ordinance are too restrictive and violate the rights of the registered sex offenders; and, WHEREAS, under protest, the Downey City Council was forced to amend its ordinance to remove its sex offender residency regulations and to conform its anti - loitering provision to the less- restrictive State law; and, WHEREAS, AB 201 and SB 267 have been introduced that would allow cities to adopt more restrictive rules, ordinances, laws and codes to protect Downey residents and visitors. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. To support the passage of AB 201 and SB 267, as may be amended in keeping with the original legislative intent. SECTION 2. To authorize Downey elected officials, the City Manager or designee and Downey's registered lobbyists, as appropriate, to sign letters, deliver testimony, or perform similar efforts in support of the passage of this legislation. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 14th day of April, 2015. UIS H. MARQUEZ ayor ATTE ADRIA M.
