HomeMy WebLinkAboutPC Resolution 14-2898RESOLUTION NO. 14 -2898 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -14- 00110, A REQUEST TO MERGE THE LOTS AT 8767 FIRESTONE BOULEVARD AND 11101 LAKEWOOD BOUEVARD, ZONED LAKEWOOD /FIRESTONE SPECIFIC PLAN (SP- 91 -2). (APPLICANT: IN -N -OUT BURGER) THE PLANNING COMMISSION OF THE CITY OF DOWNEY, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. An application was filed by In -N -Out Burger (hereinafter referred to as the "Applicant ") requesting a lot merger to consolidate the adjoining lots at 8767 Firestone Boulevard and 11101 Lakewood Boulevard, which are zoned Lakewood /Firestone Specific Plan (SP- 91 -2). B. On November 5, 2014, the Planning Commission held a public meeting to consider this lot merger application, and after fully considering all oral and written testimony and facts and opinion offered at said meeting, adopted Resolution No. 14 -2898, approving PLN -14- 00110. SECTION 2. That the Planning Commission further finds, determines and declare that: SECTION 3. That the Planning Commission of the City of Downey, based upon the findings contained hereinabove, in accordance with Section 9960.09 of the Downey Municipal Code, hereby determines that the affected lots at 8767 Firestone Boulevard, and 11101 Lakewood Boulevard in the City of Downey, California are to be merged and directs the merger of the properties identified as: See Exhibits "A" through "D" of the attached Lot Merger document, dated October 18, 2014 and labeled "PLN -14- 00110" and which includes exhibits of the unmerged and merged parcels their accompanying legal descriptions. SECTION 4. The Secretary of the Planning Commission is hereby directed to: A. Record the Notice of Merger within thirty (30) days of the conclusion of hearing this matter. The Notice of Merger shall contain the name of the recorded owner, exhibits and legal descriptions of the existing unmerged parcels and newly- merged parcel. . B. Certify the adoption of this Resolution. Resolution No. 14 -2898 Downey Planning Commission PASSED, APPROVED AND ADOPTED THIS 19th day of November, 2014.
