VERIZON WIRELESS TO LOCATE WIRELESS COMMUNICATION
FACILITY ON THE ROOF OF AN EXISTING BUILDING
LOCATION: 9637 IMPERIAL HWY
ZONING: C-M (COMMERCIAL MANUFACTURING)
REPORT SUMMARY
Verizon Wireless is proposing to add a new wireless communication facility at the subject site to
bolster their existing services. The facility will include 12 new panel antennas and one new
microwave antenna located on the roof of the existing building. All related equipment will be
located within the building. Based on the analysis contained in this report, staff is
recommending the Planning Commission adopt the following titled resolution:
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
DOWNEY APPROVING A CONDITIONAL USE PERMIT (PLN-14-00150),
THEREBY ALLOWING VERIZON WIRELESS TO LOCATE A WIRELESS
COMMUNICATION FACILITY ON THE ROOF OF AN EXISTING BUILDING ON
PROPERTY LOCATED AT 9637 IMPERIAL HWY, ZONED C-M
(COMMERCIAL MANUFACTURING).
BACKGROUND
The subject site is a 1.15 acre rectangular-shaped parcel that generally measures 132’ wide by
380’ deep. This site is located on the north side of Imperial Hwy, west of Dunrobin Ave. The
property is within the C-M (Commercial Manufacturing) zone and has a General Plan Land Use
Designation of Commercial Manufacturing. The site is improved with a 23,462 square foot
building that is used by Verizon California primarily as a telephone switching station. Additional
uses in the building include storage area, a tech service area, and an emergency generator.
The building was constructed in 1967, but was expanded to its current size in 1969. This one
story brick building has a white arcade on the front (south) side. A variety of mechanical

equipment (some of which are unscreened) and a penthouse are located on the roof. While the
main portion of the building is 22’ tall, the penthouse extends the height of the building to 34’.
A circular driveway is on the south side of the building, which extends along the west side of the
building to a 37 space parking lot, which is located on the north side of the building. Landscape
on the site is limited to the area between the building and Imperial Hwy.

Surrounding properties include a self-storage facility that wraps around the east and north sides
of the site, and a trucking storage yard on the west side of the project site. The trucking storage
yard and self-storage facility are within the C-M (Commercial Manufacturing) zone and have a
General Plan Land Use Designation of Commercial Manufacturing. Across Imperial Hwy, to the
south of the project site, is a single-family residential neighborhood. This neighborhood is
zoned R-1 5,000 (Single-Family Residential) and has a General Plan Land Use Designation of
Low Density Residential.
On June 26, 2014, the applicant (Marilyn Warren) submitted a Conditional Use Permit
application, on behalf of Verizon Wireless, to install new cellular antennas on the roof of the
existing building. Staff deemed the application incomplete due to missing information on July
25, 2014. On September 5, 2014, the final required information was submitted to the City.
Accordingly, staff deemed the application complete on September 16, 2014.
On October 2, 2014, notice of the pending public hearing was published in the Downey Patriot.
Additionally, the notice was mailed to all property owners within 500’ of the subject site.
DISCUSSION
In order to bolster signal strength in the area and provide their customers improved service,
Verizon Wireless is proposing to install 12 panel antennas on the roof of the penthouse. The
antennas are broken into three sectors, with four antennas per sector. Each of the panel
antennas are eight feet tall and will extend to ten feet above the roof of the penthouse. This will
give the antennas a maximum height of 44’, whereas the maximum height in the C-M zone is
75’. In addition to the panel antennas, the applicant is proposing to install one microwave
antennas that has a four foot diameter. The microwave antenna is not used to connect to cell
phones, but rather is used for backhaul and allows the site to communicate with other sites. All

related telecom and electrical equipment will be located within a lease area inside the existing
building. Since the building already has an emergency generator, the applicant is not proposing
to add a generator to the site.
Photo Simulation with Screen Walls
To hide the antennas from view, a new ten-foot tall FRP (Fiberglass Reinforced Plastic) screen
wall will be added to the top of the penthouse. The screen wall will have an appearance of brick
that matches the brick facades of the building. Additionally, a simulated brick will be placed on
the facades of the penthouse to blend the penthouse and screen wall into the building. In
addition to the screen wall to hide the equipment, the applicant has also agreed to add a second
screen wall above the arcade of the building to hide the equipment some of the existing roof
mounted equipment; thereby, in staff’s opinion, enhancing the overall aesthetics of the building.
Since the cellular antennas are unmanned and only require a once a month visit by a technician
for maintenance, it is not anticipated that this project will increase traffic and/or intensify parking
demand on the site.
Staff has reviewed the application for compliance with the development standards of the C-M
zone. The antennas meet all of the development standards for the zone. In addition to the C-M
zone development standards, wireless communication facilities are also subject to the
standards set forth in Municipal Code Section 9426.04. It is staff’s opinion that the proposed
development complies with the standards listed in section 9426.04 of the Municipal Code.
ENVIRONMENTAL ANALYSIS
Staff has reviewed the proposed Conditional Use Permit for compliance with the California
Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that
this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15301
(Class 1, Existing Facilities). Categorical Exemptions are projects, which have been determined
not to have a significant effect on the environment and have been exempted from the
requirements of the California Environmental Quality Act. Class 1 exemptions are intended for
projects that have a negligible expansion to existing uses on the site. Operation of an
unmanned cell site at the location will not expand the existing uses on site. Furthermore, it does
not increase traffic or parking on the site. As such, staff believes that the proposed project
qualifies for the Class 1 exemption.

FINDINGS
Pursuant to Municipal Code Section 9824.06, there are four (4) findings that must be adopted
prior to the Planning Commission approving the Conditional Use Permit. A discussion of the
findings follows:
A. The requested Conditional Use Permit will not adversely affect the intent and
purpose of the Zoning Code or the City’s General Plan or the public convenience
or general welfare of persons residing or working in the neighborhood thereof.
The subject site has a General Plan Land Use Designation of Commercial
Manufacturing, which is being implemented by the C-M zone. The proposal will allow
Verizon Wireless to enhance their coverage and provide new services to their
customers. General Plan Policy 2.7.1 states, “Provide adequate utility and
communication systems.” Staff is of the opinion that the proposed project is consistent
with this General Plan policy since it will provide better wireless communications
connectivity and services to those who live and work in the area. Staff is of the further
opinion that the proposed wireless facility complies with all requirements of the Municipal
Code, all while providing proper screening of the antennas and enhancing the overall
appearance of the building. As such, staff believes that approval of the does not
adversely affect the General Plan or the Zoning Code, nor will the approval affect the
public convenience or general welfare.
B. The requested use will not adversely affect the adjoining land uses and the growth
and development of the area in which it is proposed to be located.
The proposed wireless communication facility will locate 12 panel antennas and one
microwave antenna for Verizon Wireless on the roof of the existing building. All of the
antennas will be located behind a FRP screen wall that matches the building façade to
blend the wireless equipment into the existing building. This screen wall will hide the
antennas from the public right-of-way and adjoining properties. It is Staff’s opinion that
since the antennas are located on the roof of the building and will not be visible from
other properties, they will not have an adverse effect the adjoining land uses or the
continued growth thereof.
C. The size and shape of the site proposed for the use is adequate to allow the full
development of the proposed use in a manner not detrimental to the particular
area.
The subject site is a 1.15 acre rectangular shaped parcel that is improved with an
existing one story building. The antennas will be mounted to the roof of the building and
will not require an expansion of the building. Additionally, all telecom and power
equipment will be located within the existing building. Due to the proposed location of
the antennas and equipment, staff is of the opinion that the site has sufficient size and
shape to accommodate the use.
D. The traffic generated by the proposed use will not impose an undue burden upon
the streets and highways in the area.
The subject site is accessed directly from Imperial Hwy, a primary arterial roadway.
Imperial Hwy has three traffic lanes in each direction of travel and currently

accommodates approximately 30,000 vehicle trips per day. The proposed wireless
facility is unmanned and does not generate vehicle trips other than a monthly
maintenance trip. Staff is if the opinion that this monthly maintenance trip does not
represent a significant increase in traffic on Imperial Hwy thus will not create an undue
burden on the streets and highways in the area.
In addition to the findings required to approve a Conditional Use Permit, Municipal Code Section
9426.04(b)(4) requires the Planning Commission to adopt the following additional finding for the
roof mounted wireless antennas:
A. All antennas and equipment that are located on the side, roof, and/or penthouse of
an existing building are properly integrated into the subject building’s design so
that they are not identifiable as such by a casual observer.
The proposed antennas will be located in the roof of the existing building surrounded by
a FRP screen wall that will have a finish to match the building. Staff believes that this
design will blend the screen wall into the existing building, thus looking like an extension
of the building. Based on this, staff is of the opinion that the casual observer will not
recognize the extension as a wireless facility, thus this finding can be adopted.
CORRESPONDENCE
As of the date that this report was printed, staff has not received any correspondence regarding
this application.
CONCLUSION
Based on the analysis contained within this report, staff is concluding that the proposed wireless
facility is consistent with the goals and intent of the General Plan and Zoning Code. Finally, as
noted above, staff believes that all four findings required approving a Conditional Use Permit
and the one finding for the wireless facility can be made in a positive manner. As such, staff is
recommending that the Planning Commission approve the Conditional Use Permit (PLN-14-
00150), subject to the recommended conditions of approval.

RESOLUTION NO. _____________
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY
APPROVING A CONDITIONAL USE PERMIT (PLN-14-00150), THEREBY ALLOWING
VERIZON WIRELESS TO LOCATE A WIRELESS COMMUNICATION FACILITY ON
THE ROOF OF AN EXISTING BUILDING ON PROPERTY LOCATED AT 9637
IMPERIAL HWY, ZONED C-M (COMMERCIAL MANUFACTURING)
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find,
determine and declare that:
A. The building on the subject site was constructed in 1967 and later expanded in 1969.
This building is a telephone switching station for Verizon California; and,
B. On June 26, 2014, the applicant (Marilyn Warren) submitted a request, on behalf of
Verizon Wireless, to install new cellular antennas on the roof of the building. This
application was deemed incomplete due to missing information on July 25, 2014; and,
C. On September 16, 2014, the applicant submitted the final information needed to
complete the request; as such, staff deemed the application complete on September 16,
2014; and,
D. On October 2, 2014, notice of the pending application published in the Downey Patriot
and mailed to all property owners within 500' of the subject site; and,
E. The Planning Commission held a duly noticed public hearing on October 15, 2014, and
after fully considering all oral and written testimony and facts and opinions offered at the
aforesaid public hearing adopted this resolution.
SECTION 2. The Planning Commission further finds, determines and declares the
environmental impact of the proposed development has been reviewed and has been found to
be in compliance with the California Environmental Quality Act (CEQA) and is categorically
exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities).
SECTION 3. Having considered all of the oral and written evidence presented to it at
said public hearings regarding the Conditional Use Permit, the Planning Commission further
finds, determines and declares that:
1. The requested Conditional Use Permit will not adversely affect the intent and purpose of
the Zoning Code or the City’s General Plan or the public convenience or general welfare
of persons residing or working in the neighborhood thereof. The subject site has a
General Plan Land Use Designation of Commercial Manufacturing, which is being

SECTION 5. Based upon the findings set forth in Sections 1 through 4 of this
Resolution, the Planning Commission of the City of Downey hereby approves the Conditional
Use Permit (PLN-14-00150), subject to conditions of approval attached hereto as Exhibit A,
which are necessary to preserve the health, safety and general welfare of the community and
enable the Planning Commission to make the findings set forth in the previous sections. The
conditions are fair and reasonable for the accomplishment of these purposes.

CONDITIONAL USE PERMIT (PLN-14-00150)
EXHIBIT A - CONDITIONS
PLANNING
1) The approval of this Conditional Use Permit allows the installation of 12 panel antennas
(three sectors, four antennas per sector) and one microwave antenna on the penthouse
roof of the existing building located at 9637 Imperial Hwy. This approval shall also
authorize any related GPS antenna and RRU’s on the roof of the building. All other
telecom and power equipment shall be located within the building. .
2) Approval of this Conditional Use Permit shall not be construed to mean any waiver of
applicable and appropriate zoning regulations, or any Federal, State, County, and City
laws and regulations. Unless otherwise expressly specified, all other requirements of
the City of Downey Municipal Code shall apply.
3) The City Planner is authorized to make minor modifications to the approved preliminary
plans or any of the conditions if such modifications shall achieve substantially the same
results as would strict compliance with said plans and conditions.
4) The Owner/Applicant agrees, as a condition of approval of this resolution, to indemnify,
defend and hold harmless, at Applicant's expense, City and City's agents, officers and
employees from and against any claim, action or proceeding commenced within the time
period provided in Government Code Section 66499.37 to attack, review, set aside, void
or annul the approval of this resolution, to challenge the determination made by City
under the California Environmental Quality Act or to challenge the reasonableness,
legality or validity of any condition attached hereto. City shall promptly notify Applicant of
any such claim, action or proceeding to which City receives notice, and City will
cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City
for any court costs and attorney's fees that the City may be required to pay as a result of
any such claim, action or proceeding. City may, in its sole discretion, participate in the
defense of any such claim, action or proceeding, but such participation shall not relieve
Applicant of the obligations of this condition.
5) All conditions of approval set forth in this resolution shall be complied with before the
Conditional Use Permit becomes valid.
6) The antennas shall not extend more than 10’ above the roof of the existing penthouse.
7) The applicant shall install a screen wall around the antennas to hide them from view.
The screen wall shall have a minimum height of 10’, as measured from the roof of the
penthouse. The screen wall shall have a finished appearance (texture and color) of
brick to match the building.
8) The façade of the penthouse shall be modified to have an appearance (texture and
color) of brick to match the building.
9) A new screen wall shall be installed around the roof mounted equipment on the south
side of the building. The screen wall shall be tall enough to screen this equipment from
view and shall have a finished appearance (texture and color) of brick to match the
building.

10) There shall be no signs on the site related to the wireless facility, other than required
regulatory signs.
BUILDING
11) All construction shall comply with the most recent version of the California Building
Code, as adopted by the City of Downey, and Title 24 of the California Energy Code.
12) Prior to the commencement of construction, the applicant shall obtain all required
permits. Additionally, the applicant shall obtain all necessary inspections and permit
final prior to beginning operation of the site.
FIRE DEPARTMENT
13) Plans to be submitted through Building and Safety and shall comply with the most recent
version or the California Fire Code, as adopted by the City of Downey; current Downey
Municipal Code Ordinances and any other pertinent requirements to be determined at
time of plan submission and review.
14) Knox access shall be provided and maintained to the building and all roof/penthouse
access ladders.
15) The building street address shall be mounted to the front façade of the building. The
street address shall be visible from the street, have a minimum letter height of 4”, and
shall be a contrasting color to the building.
PUBLIC WORKS
16) All new onsite utilities shall be installed underground.
17) The owner/applicant shall be required to complete a construction & demolition (C&D)
waste management plan per Article V, Chapter 8 of the Downey Municipal Code.
18) All areas within the scope of work of this project shall comply with the National Pollutant
Discharge Elimination System (NPDES) requirements of the Federal Clean Water Act;
the General Construction Activities Stormwater Permit (GCASP) of the State, the
Stormwater Quality Management Plan (SQMP) of the Los Angeles County Department
of Public Works, and Ordinance 1142 of the Downey Municipal Code. Furthermore, the
owner/applicant shall provide a design that conveys all onsite drainage over a vegetative
swale a minimum distance of 20 feet and retain the first 0.75 inches of drainage onsite
using either surface detention basins or below grade facilities with flow in excess of the
first 0.75 inches allowed to overflow by underground drains to an existing Los Angeles
County Public Works storm drain
19) The owner/applicant shall provide that all construction graffiti created as part of this
project in the public right of way to be removed.
